Writ Petition No. 37792 of 2010.\n\n                    Vinod Kumar Sharma\n                            Versus\n                   State of U.P. and others.\n\n\n\n\nHon'ble Arun Tandon, J.\n<\/pre>\n<p>The facts on record of the present writ petition are as follows :<br \/>\nPetitioner, who is employed as Cadre Secretary of Sadhan<br \/>\nSahkari Samiti Ltd., Bhagwanpur, Tehsil Nagina, District<br \/>\nBijnore, was served with an order dated 31.01.2008<br \/>\nwhereunder after completion of the departmental proceeding,<br \/>\nhe was held liable for payment of Rs.1,35,894\/- for the loss<br \/>\ncaused. This order was challenged by the petitioner by<br \/>\nmeans of Civil Misc. Writ Petition No. 15640 of 2008 wherein<br \/>\nan interim order was granted on 01.05.2008 and the recovery<br \/>\nwas stayed. The writ petition is pending and the stay order is<br \/>\nin operation. The petitioner was thereafter served with a<br \/>\ncharge sheet on 13.07.2009. This charge sheet according to<br \/>\nthe petitioner was bad as it was in respect of the same<br \/>\ncharges which were subject matter of the order of<br \/>\npunishment dated 31.01.2008. He challenged the charge<br \/>\nsheet by means of Civil Misc. Writ Petition No. 37206 of<br \/>\n2009. In the said writ petition an interim order has been<br \/>\n granted by this Court whereby the charge sheet has been<br \/>\nstayed. By means of this third writ petition, he seeks<br \/>\nquashing of the order dated 20.05.2010 whereunder he has<br \/>\nbeen temporarily reinstated on the post of Secretary pending<br \/>\nconclusion of the proceeding against the petitioner in terms of<br \/>\nthe charge sheet which has been stayed by this Court.<br \/>\nCounsel for the petitioner contends that although he has<br \/>\nbeen reinstated, he has not been assigned any duties nor<br \/>\nhas been permitted to work. In paragraph 19 it is stated that<br \/>\neven though the petitioner has been reinstated under orders<br \/>\nof the Secretary of the Society, he is still being paid<br \/>\nsubsistence allowance and the Officiating Secretary is<br \/>\ncontinuing to exercise powers of the Secretary despite the<br \/>\nreinstatement of the petitioner.\n<\/p>\n<p>I have heard learned counsel for the parties and have<br \/>\nexamined the records of the present writ petition.<br \/>\nFrom the records of the present writ petition, this Court finds<br \/>\nthat the petitioner was placed under suspension under<br \/>\nresolution of the District Administrative Committee as notified<br \/>\non 26.05.2009. The petitioner was served with a charge<br \/>\nsheet in terms of the said resolution on 13.07.2009. The<br \/>\npetitioner, for the reasons best known to him, has either not<br \/>\nchallenged the order of suspension dated 26.08.2009 or else<br \/>\nhe challenged the said order in Civil Misc. Writ Petition 37206<br \/>\nof 2009, butn no interim order has been granted staying the<br \/>\norder of suspension. Since the Secretary\/General Manager,<br \/>\nZila Sahkari Bank has informed the petitioner under the<br \/>\nimpugned order that the Administrative Committee in its<br \/>\ndecision taken on 13.05.2010, as per the interim order of this<br \/>\nCourt has decided to keep the order of suspension in<br \/>\n abeyance inasmuch as the enquiry cannot proceed because<br \/>\nof the stay of the charge sheet. The petitioner has<br \/>\naccordingly been reinstated with a direction that for the period<br \/>\nof suspension, he shall not be paid anything over and above<br \/>\nthe   subsistence    allowance.    However    the   period    of<br \/>\nsuspension can be treated to have been spent on duty.<br \/>\nThis Court is of the considered opinion that the issue as to<br \/>\nwhether an employee should be paid full salary or only<br \/>\nsubsistence allowance for the period of suspension, has to be<br \/>\nadjudicated upon only after the departmental proceedings are<br \/>\ncompleted and at an interim stage, there cannot be a<br \/>\ndirection for the payment of full salary for the period of<br \/>\nsuspension. In the facts and circumstances of the case the<br \/>\npetitioner has got the enquiry proceedings stayed from this<br \/>\nCourt because of the stay of the charge sheet, the District<br \/>\nCommittee is legally justified in directing that the petitioner<br \/>\nshall not be entitled to anything over and above the<br \/>\nsubsistence allowance for the suspension period. Suffice is to<br \/>\nrecord that such direction of the District Administrative<br \/>\nCommittee shall be subject to the directions which may be<br \/>\npassed by the writ Court or to the orders which may be<br \/>\npassed by the disciplinary authority in accordance with the<br \/>\nRules applicable after completion of the departmental<br \/>\nproceedings if permitted by this Court while deciding the Writ<br \/>\nPetition No. 37206 of 2009.\n<\/p>\n<p>Consequently this Court finds no good ground to interfere<br \/>\nwith the order dated 20.05.2010.\n<\/p>\n<p>So far as the other relief prayed for qua non payment of<br \/>\nsalary after his reinstatement is concerned, the petitioner may<br \/>\napproach the Branch Manager of the Bank for enforcing the<br \/>\n decision of the District Administrative Committee in letter and<br \/>\nspirit and for ensuring that the petitioner is permitted to<br \/>\ndischarge his duties and is paid his salary regularly.<br \/>\nAccordingly the present writ petition is disposed of with liberty<br \/>\nto the petitioner to make a representation ventilating all his<br \/>\ngrievances noticed above before the respondent no. 6 within<br \/>\ntwo weeks from today along with a certified copy of this order.<br \/>\nOn such a representation being made the respondent no. 6<br \/>\nshall call for the records and shall pass a reasoned speaking<br \/>\norder preferably within six weeks, thereafter.<br \/>\nDated : 02.07.2010<br \/>\nVR\/37792\/10\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Vinod Kumar Sharma vs State Of U.P.
