DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/07\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP waives service of rule.\n<\/p>\n<p>Learned<br \/>\n\tcounsel appearing for the applicant submitted that investigation<br \/>\n\tis over and charge sheet is filed.  It is further submitted<br \/>\n\tthat even as per the statement of the victim, aged around 17 years<br \/>\n\tand 4 months, she had admitted her relationship with the accused and<br \/>\n\tconsensual act is converted into crime.  It is further submitted<br \/>\n\tthat considering the Medico Legal Certificate dated<br \/>\n\t09.04.2011 and other attending circumstances, the applicant may be<br \/>\n\tenlarged on bail by imposing suitable conditions.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the  statement of the victim,<br \/>\n\taged around 17 years and 4 months, who had admitted her relationship<br \/>\n\twith the accused and Medico Legal Certificate dated 09.04.2011,<br \/>\n\tprima facie it appears that a consensual act is converted into<br \/>\n\tcrime.  Therefore, considering the overall facts and circumstances<br \/>\n\tof the case and considering the fact that<br \/>\n\tcharge sheet is filed, without discussing the evidence in<br \/>\n\tdetail, at this stage, I am inclined to enlarge the applicant on<br \/>\n\tbail  in connection with C.R.No.I-25\/2011 of Pansina Police Station<br \/>\n\tfor the offences punishable under sections 363, 366, 376 &amp; 114<br \/>\n\tof the Indian Penal Code, on furnishing   bond of Rs.10,000\/-<br \/>\n\t(Rupees ten thousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and on conditions that the applicant<br \/>\n\tshall :\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m for three months;\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the prima<br \/>\n\tfacie observations made by this Court while enlarging the applicant<br \/>\n\ton bail.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
