\nThis Criminal Appeal has been directed by Dev
\nKaran, accused against the judgment and order dated
\n23.7.1996 passed by the Additional Sessions Judge,
\nKurukshetra, whereby he found him guilty and convicted him
\nunder Sections 498-A and 308 IPC and sentenced him to one
\nand a half years R.I. and a fine of Rs. 500\/- under
\nSection 498-A IPC. In default of payment of fine, he was
\nfurther sentenced to undergo R.I. for 3 months; to
\nundergo R.I. for 5 years and a fine of Rs. 5,000\/- under
\nSection 308 IPC. In default of payment of fine he was
\nfurther sentenced to undergo R.I. for one year. Out of
\nthe fine realised Rs. 5,000\/- were ordered to be paid to
\nSunita Devi, PW-7. However, the substantive sentences
\nwere ordered to run concurrently.\n<\/p>\n

\nBriefly stated, the facts are that Sunita Devi
\nd\/o Roop Chand, complainant, was married with Dev Karan,
\nappellant, at Village Dudla about one year prior to the
\noccurrence. Roop Chand had spent upon the marriage beyond
\nhis means but the appellant was not satisfied with the
\ndowry given and right from the day one, started harassing
\nher on account of dowry. He put up a demand for scooter
\nor Rs. 25,000\/- in cash but the father of Sunita Devi could
\nnot pay the same or provide a scooter.\n<\/p>\n

\nIt is next alleged that on one occasion, the
\nappellant tried to strangulate Sunita Devi, as a result of
\nwhich blood had flown from her eyes, mouth and anus and on
\nalarm raised by her, she was rescued by her neighbours.
\nOn other occasion, the appellant had tried to give poison
\nto her.\n<\/p>\n

\nRoop Chand, father of Sunita Devi, approached
\nthe police but the police did not register the case and
\nultimately he approached the Chief Minister of Haryana and
\non his orders, the case was registered under Section 498A
\nIPC.\n<\/p>\n

\nPW-10 Simru Ram, ASI to Police Station Sadar,
\nThanesar, conducted investigation. He went to Village
\nAurangabad on 15.7.1995 and recorded the statement of
\nShakuntla Devi wife of Roop Chand, on 19.7.1995, Roop
\nChand, Sunita Devi and Shakuntla Devi visited Police
\nStation, Pipli and he alongwith them went to Village
\nDudhla and recorded the statements of Darshana Devi,
\nPhoolo Devi and Ram Dhari. He also prepared rough site
\nplan, Ex.PE. The appellant and his co-accused were
\narrested.\n<\/p>\n

\nAfter the completion of the investigation, the
\nchallan was put up in the Court of Judicial Magistrate,
\nwho in turn committed the case to the Court of Sessions.\n<\/p>\n

\nHaving made out a prima-facie case, the
\nappellant was charged under Sections 498-A\/308 IPC, while
\nhis co-accused were charged under Section 498-A IPC, to
\nwhich they pleaded not guilty and claimed trial.\n<\/p>\n

\nIn order to prove the allegations, the
\nprosecution examined 10 witnesses. Smt. Darshana Devi,
\nPhoolo Devi and Ram Dhari were given up as won over.\n<\/p>\n

\nAfter the closure of the prosecution evidence,
\nthe statements of the appellant and his co-accused were
\nrecorded under Section 313 Cr.P.C., where they denied the
\nallegations of the prosecution and stated that Roop Chand
\nwanted Dev Karan, appellant, to shift to Yamuna Nagar
\nalongwith Sunita Devi and he promised to arrange some
\nemployment for him and Sunita Devi but Dev Karan refused
\nand as such, falsely implicated in this case.\n<\/p>\n

\nAfter hearing the learned PP for the State and
\nthe defence counsel, the Additional Sessions Judge, vide
\nhis judgment dated 23.2.1996 found Dev Karan Guilty under
\nSections 498-A and 308 IPC, while he acquitted the
\nremaining persons giving benefit of doubt and sentenced
\nDev Karan as stated above vide order of even date.\n<\/p>\n

\nAggrieved by the said judgment and order, Dev
\nKaran, accused, has filed the present appeal.\n<\/p>\n

\nI have heard Shri R.S. Mamli, counsel for the
\nappellant, Shri Sudhir Nehra, AAG, Haryana, for the State
\nand carefully gone through the record.\n<\/p>\n

\nPW-7 Sunita Devi had stated that the appellant
\ntried to strangulate her with a cord and as a result of
\nstrangulation, blood had flown from her eyes, mouth, ears and
\nanus and she cried and attracted Phoolo and her
\ndaughter-in-law. This occurrence, according to her, had
\ntaken place on 25.3.1995 at 12 Noon. Smt. Phoolo and her
\ndaughter-in-law have not been produced to corroborate the
\nversion as stated by Sunita Devi as they were given up as
\nwon over. The only inference is that if they had been
\nproduced, they would not have supported the
\nprosecution version. PW-3 Dr. Arvind Gupta, Medical
\nSuperintendent of General Charitable Hospital, Village
\nJourian, District Yamuna Nagar, stated that Smt. Sunita
\nDevi, daughter of Roop Chand, visited his hospital on
\n31.3.1995 and he found redness in both of he eyes which
\nwas alleged to be caused by strangulation. He further
\nstated that the said redness could be due to
\nstrangulation. He did not state that blood had come from
\nher eyes, mouth, ears or anus. Simply because there was
\nredness in the eyes of Sunita Devi, it cannot be said that
\nthe same was due to strangulation. Admittedly, he did not
\nfind any mark of violence on the neck of Sunita Devi.\n<\/p>\n

\nPW-10 Investigating Officer had admitted in his
\nstatement that during investigation it had not come to his
\nnotice that the appellant had tried to strangulate Sunita
\nDevi and blood had flown from her eyes, ears, mouth and
\nanus. Thus, the allegation regarding strangulation
\nappears to be false and it is not proved beyond reasonable
\ndoubt. Hence, the appellant is given benefit of doubt and
\nis acquitted under Section 308 IPC.\n<\/p>\n

\nNow, further question to be seen is whether the
\nappellant had committed an offences punishable under
\nSection 498-A IPC. PW-7 Sunita Devi categorically
\nstated that soon after the marriage, the appellant had
\nstarted mal-treating her on account of demand of
\nadditional dowry i.e. scooter or Rs. 25,000\/- in cash but
\nher parents could not pay the same and as such, she was
\nconstantly harassed. Her evidence is supported by PW-8
\nRoop Chand. Thus, it is proved that she was being
\nharassed on account of demand of dowry and thus, he has
\nbeen rightly convicted under Section 498-A IPC.\n<\/p>\n

\nCounsel for the appellant has not pressed the
\nappeal on merits as far as Section 498-A IPC is concerned.
\nHe contended that the appellant had remained in custody
\nfor about one year and three months and as such, he be
\nreleased after taking into consideration the above
\nmentioned imprisonment.\n<\/p>\n

\nKeeping in view the facts and circumstances of
\nthe case and the fact that the appellant has been
\nsuffering the agony of the trial for the last about 8
\nyears, I take a lenient view and sentence him to the
\nimprisonment already undergone. However, the appellant
\nhas undertaken to deposit the fine within one month. It
\nthe fine is not paid within the stipulated time, then he
\nwill suffer one month R.I.\n<\/p>\n
