Kodekar for the applicant  referred to the papers<br \/>\n\tand submitted that as now the chargesheet has been filed, the<br \/>\n\tpresent application may be allowed looking to the nature of offence.\n<\/p>\n<p>Learned<br \/>\n\tA.P.P., Ms.Nair resisted the present application and submitted that<br \/>\n\the has been arrested from the place and there are other five cases<br \/>\n\tregistered against him.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel appearing for the applicant-accused and<br \/>\n\tlearned A.P.P. for the State  and having considered the nature of<br \/>\n\toffence, role attributed as well as antecedents as also the fact<br \/>\n\tthat the chargesheet has now been filed, the present application<br \/>\n\tdeserves to be allowed.\n<\/p>\n<p>Accordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.159\/2010<br \/>\n\tregistered with Salabatpura Police Station, Surat on his executing a<br \/>\n\tbond of Rs.5,000\/- (Rupees Five Thousand Only) with one solvent<br \/>\n\tsurety of the like amount to the satisfaction of the lower Court and<br \/>\n\tsubject to the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark<br \/>\nhis presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM till the trial<br \/>\ncommences.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
