   The facts relevant for the purpose of this petition<\/p>\n

Siddaraju a resident of Horayala Village belonging to
\nSchedule Tribe community submitted his complian.t_Vtop_lPolice<\/p>\n
on 25.10.2009. The facts in the complaint reve’al’th_at:<\/p>\n
5 days earlier to the incident, there was a…quarrel:’betvre’en <\/p>\n
two parties, namely, Krishna and;:Ra_;ieishV  0
\nregard was registered by theVpPolicei4ic;ni’the said,
\n3.00 p.m. when he was procerepding Heycre ta
\nBegur Village, he caIn\u00e9~.;_1\ufb02ear.*th\u00e9 lat”‘th’ait time, he
\nfound all the petitioners  unlawful assembly
\nand armed withljpthe  clubs and
\nstones in   complainant and abused
\nhim  ilhgiivinig threat to his life, the
\nPetitioiierl” No’.  assaulted the complainant<\/p>\n
with the ciho.ppp.er0and._Vtlhel-complainant sustained the injuries<\/p>\n
 p_ near~i.hisiA’ieft eyes .an_d,the rest of the petitioners are said to<\/p>\n
 have assau\u00ab.1,ted__ the injured with the clubs, stones etc..<\/p>\n
l’Mean.while’;\u00bb._pfewV”elders of the village came and after their<\/p>\n
inteiwenitiorii they paci\ufb01ed all of them and as some persons<\/p>\n
H  _fihar.l__ informed the Police and by that time, the Police came<\/p>\n
  ‘t_here;, the petitioners seeing the Police left the clubs, stones<\/p>\n
 ….and chopper at the place and ran away. The injured was<\/p>\n
taken in the Police jeep to the Hospital and was treated in<\/p>\n

Gundlupet Government Hospital. It is at this juncture that
\nthe complainant submitted his compiaint on these facts
\nwhich came to be registered on 25.10.2009 at <\/p>\n
p.111.\n<\/p>\n
3. The petitioners submit thatthey areivinnocent_.f’VThey 1. it<\/p>\n

\npetitioners also submit that   willing to
\nabide by any conditionstliat be for their release

produced they   ..i’etitiener No.7. who is a<\/p>\n
student in Mysf’sre_V:’R1a11.araja College. On these grounds. the
\npetitioners have ‘the grant of anticipatory bail.<\/p>\n
_;jl4.  The “ie_arnedv’High Court Government Pleader has<\/p>\n
 “petition and submits that there is ample material<\/p>\n
tops’-.show prima facie that the petitioners are<\/p>\n
respons_ib1e_= for the offences registered and in the<\/p>\n
Vi”\u00bbcircun.1stances, he has sought for the rejection of the<\/p>\n

5. I have heard the learned counsel for the petitioners
\nand also the High Court Government Pleader. The point that
\narise for my consideration is:\n<\/p>\n
“Whether the petitioners are entitled<\/p>\n
the anticipatory bail sought for ?”\n<\/p>\n
6. As could be seen frommhthe a.liega:tions: in  <\/p>\n
complaint, the first petitioner is said-toflhave…assa’uit.edgt’\u00a3e
\ncomplainant with the chopper aniclpthe in”uruyi4_cert;ificate;
\nproduced by the petitioners reyeals an injuryjiinearitihe left eye<\/p>\n
brow with periorbital ‘haen_ioto:ina._ around  eye with<\/p>\n
bleeding. Furthermore, so far as  l’\u20acB_:vS.l.i->(:}Vf the petitioners are<\/p>\n
concerned;  alleg’ed”in”theuco\ufb01plaint that they assaulted
\nthe coi’nplain’anf _.clubs and stones. The injury<\/p>\n
certificateiireireals-that ‘\u00abapart from the injuries referred to<\/p>\n
 abow\u00a5:_, the compia.ir1__a__n?t sustained the two injuries which is<\/p>\n
   with swelling of left elbow joint and the<\/p>\n
“thir.d_ism’teu\u00bbde’r;a’ess over the right elbow joint and abrasion of<\/p>\n
1\/2   over the tip of left index \ufb01nger. The Doctor<\/p>\n
certi\ufb01ed that the injures are simple in nature. The<\/p>\n
 .._perusal of the certi\ufb01cate further reveals that While the<\/p>\n
 ~ injured was admitted in the hospital. he has stated the<\/p>\n
V correct name of the Petitioner Nos.1 and 8 whereas in respect<\/p>\n

of the other persons, the names are not properly mentioned.
\nThe Petitioner No.2 is Rajesh but in the certi\ufb01cate. it is
\nmentioned as Raju. The Petitioner No.3 is Chikamahadevaiah
\nwhereas, the name mentioned in the  is
\nChikkamada and Petitioner No.5 is
\nthe certi\ufb01cate, it is mentioned as Nlpnprthy ‘.a’nd–  ,VS-autos . <\/p>\n
the extent of the persons whoseV=.,_nam-aflhas been “correctly
\nmentioned in the injury certificatefprima fac’i’e_it is’; to
\nconsidered, as the complainantvlat’ the timeiiiof admission in<\/p>\n
the hospital has given ijthe n_aimVeVsi”,i5’etitionelr l\\ios.1 and 8<\/p>\n
correctly and so far as the ‘T-rest”of’th.–e_pe1fsons are concerned,<\/p>\n
neither”th”e”11aInes;?;are”‘pro’per1y”fnentioned and in respect of
\nsome. there is _no.,”meintien”J_.of the names at all. So in the<\/p>\n
circurnstanc.es.-wh~enA’the.,~incident of assault took place, the<\/p>\n
~ , & possibility of the”‘cor_nplainant implicating some more persons<\/p>\n
 cannot .,b’e.oyer ruled. It is in these circumstances that the<\/p>\n
ll-‘et’itj_on’er”_’i\u00a5los,.2’V to 7 whose name is not properly mentioned<\/p>\n
andxtherei issno specific part attributed against these persons<\/p>\n
Jin ,theV””assau1t, I think that they are entitled to the<\/p>\n
  anticipatory bail sought for. So far as Petitioner Nos.1 and 8<\/p>\n
it = ..are concerned. their names have been clearly mentioned and<\/p>\n

the injury certi\ufb01cate and the prima facie, material placed on
\nrecord reveals their involvement in the crime.<\/p>\n
7. So far as anticipatory bail is concerned, the
\ndiscretion vested with the Court has to be to<\/p>\n
protect the interest of innocent persons and <\/p>\n
granted sparingly in exceptional cases. Tho”ag’l1,lthe_ia.cts’J”<\/p>\n
reveal that an incident has taken   a.s:”th’eV:n.nr11her
\nof persons involved in the’ incidenthisp
\nappears to be some doubt as regar_d’s the  of these
\npersons. ln the circuArns_tan’ces_.’pA of the opinion that<\/p>\n
Petitioner Nos.2 to 7 are’  ‘tlie__’.V–anticipatory bail<\/p>\n
sought’: for  prima facie material against
\nPetitioner  are entitled to the relief. Hence,<\/p>\n
I ansfsverggthe pcintpartiy  affirmative and partly in negative<\/p>\n
.  and ‘epro3c’eed’ to passxthe following:<\/p>\n

\n‘ ‘  Thve.pe:tit’ion of Petitioner Nos.1 and 8 is dismissed.<\/p>\n
‘rr;e;. petitioner Nos.2 to 7 are granted anticipatory bail<\/p>\n

‘  arrest in Crime No.420\/ 2009 for the offence punishable under<\/p>\n

\non bail on their executing a personal bond for a sum of
