Justice K.HEMA\n\n Dated :06\/02\/2009\n\n O R D E R\n                                K.HEMA, J.\n\n                  -------------------------------------------\n                          B.A.No.570 of 2009\n                   ------------------------------------------\n            Dated, this the 6th      day of February, 2009\n\n                               ORDER\n<\/pre>\n<p>             Petition for bail.\n<\/p>\n<p>            2.   Alleged offence is under Section 8(2) of the<\/p>\n<p>Abkari Act. According to prosecution, petitioner was found in<\/p>\n<p>possession of 32 litres of illicit arrack on 15.10.2008. Petitioner<\/p>\n<p>was arrested on 9.12.2008 and she is in custody since then.<\/p>\n<p>            3.     Learned Public Prosecutor submitted that<\/p>\n<p>petitioner is aged 63 years and she is involved in two other<\/p>\n<p>cases of similar nature in the years 2006 and 2008.            Hence<\/p>\n<p>stringent conditions may be imposed while granting bail, but he<\/p>\n<p>has no objection in granting bail.<\/p>\n<p>            4. On hearing both sides, I am satisfied that bail<\/p>\n<p>can be granted to petitioner on stringent conditions.<\/p>\n<p>           Hence the following order is passed:<\/p>\n<p>           i)       Petitioner shall execute a bond for<\/p>\n<p>                    Rs.50,000\/with      two   solvent    sureties<\/p>\n<p>                    each for the like sum to the satisfaction<\/p>\n<p>                    of the Magistrate Court concerned.<\/p>\n<p>B.A.No.570 of 2009<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>           ii)     Petitioner   shall  report  before   the<\/p>\n<p>                   investigating officer on every alternate<\/p>\n<p>                   day     between 10 AM and 1 P.M. until<\/p>\n<p>                   further orders.\n<\/p>\n<\/p>\n<p>           iii)    Petitioner shall not leave the limits of<\/p>\n<p>                   the Excise Range Office within which the<\/p>\n<p>                   crime is registered,    except with the<\/p>\n<p>                   previous permission of the    Magistrate<\/p>\n<p>                   Court concerned.\n<\/p>\n<p>           iv)      Petitioner shall not commit any offence<\/p>\n<p>                   while on bail and in case of breach of<\/p>\n<p>                   this condition, the bail is liable to be<\/p>\n<p>                   cancelled.\n<\/p>\n<p>            Petition is allowed.\n<\/p>\n<\/p>\n<p>                                          K.HEMA, JUDGE<br \/>\nvns<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sarojini vs The Excise Inspector on 6 February, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 570 of 2009() 1.
