Whether the judgement should be reported in the Digest ?<\/p>\n<pre>Present :    Mr. Hitesh Verma, Advocate,\n             for the petitioner.\n\n\n                                 ****\n\nAlok Singh, J (Oral)\n\n\n\n<\/pre>\n<p>             This is the second application seeking anticipatory bail in FIR<\/p>\n<p>No.308 dated 9.5.2011, under Sections 420\/465\/467\/468\/471\/120-B of<\/p>\n<p>Indian Penal Code, registered at Police Station City, District Sirsa.<\/p>\n<p>             First application seeking anticipatory bail being CRM<\/p>\n<p>No. M-18362 of 2011 was taken up for hearing on 7.6.2011. On 7.6.2011<\/p>\n<p>Mr. Aman Bansal, learned counsel for the petitioner stated that the<\/p>\n<p>petitioner would surrender\/appear before the competent Magistrate on or<\/p>\n<p>before 25.6.2011 and shall move regular bail application, therefore, he may<\/p>\n<p>be permitted to withdrawn this petition.\n<\/p>\n<p><span class=\"hidden_text\"> CRM-M- No. 19219 of 2011 (O&amp;M)                                          2<\/span><\/p>\n<p>               On the statement made by Mr. Aman Bansal, learned counsel<\/p>\n<p>for the petitioner, first anticipatory bail application was permitted to be<\/p>\n<p>withdrawn with liberty to appear before the competent Magistrate on or<\/p>\n<p>before 25.6.2011 and to seek regular bail therefrom.<\/p>\n<p>               Present second anticipatory bail application is moved by<\/p>\n<p>different counsel Mr. Hitesh Verma.\n<\/p>\n<p>               Mr. Hitesh Verma, learned counsel for the petitioner, has<\/p>\n<p>argued that earlier bail application was withdrawn by Mr. Aman Bansal,<\/p>\n<p>learned counsel for the petitioner, without any instruction from the<\/p>\n<p>petitioner.\n<\/p>\n<p>               Since first anticipatory bail application was withdrawn with<\/p>\n<p>liberty to surrender\/appear before the competent Magistrate and to seek<\/p>\n<p>regular bail therefrom, second pre arrest bail application is not maintainable.<\/p>\n<p>Argument that earlier bail application was withdrawn by the then counsel<\/p>\n<p>without any instruction from the petitioner seems to be after thought.<\/p>\n<p>Moreover, petitioner in paragraph No.2 of this petition has asserted as<\/p>\n<p>under :-\n<\/p>\n<blockquote><p>                            &#8220;Thereafter, the petitioner approached this<\/p>\n<p>              Hon&#8217;ble Court for grant of Anticipatory Bail vide CRM-M<\/p>\n<p>              No.18362 of 2011 which was listed before this Hon&#8217;ble<\/p>\n<p>              Court on 7th June 2011. But due to some inadvertent<\/p>\n<p>              mistake\/miscommunication between the petitioner and his<\/p>\n<p>              counsel, the same was withdrawn by the counsel of the<\/p>\n<p>              petitioner on the ground that petitioner is ready to<\/p>\n<p>              surrender.&#8221;<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\"> CRM-M- No. 19219 of 2011 (O&amp;M)                                       3<\/span><\/p>\n<p>            However, if petitioner surrenders\/appears before the Magistrate<\/p>\n<p>within ten days from today and seeks regular bail, same shall be decided<\/p>\n<p>without any undue delay.
