\tThe
\npresent application is filed by the applicant-accused for grant of
\nregular bail under section 439 of the Code of Criminal Procedure
\nafter charge sheet is filed, which is a successive application as
\nearlier Criminal Misc. Application No.11365 of 2010 has been filed by
\nthe  present applicant, before charge sheet.\n<\/p>\n
2.\tThe
\napplicant-accused is charged with the offences having committed under
\nsections 506(2) and 507 of the Indian Penal Code for which an F.I.R.
\nbeing C.R. No.II-3015 of 2010 has been registered with Suigam Police
\nStation.\n<\/p>\n
3.\tLearned
\nadvocate Mr.Mehul Rathod referred to the F.I.R.  and other papers and
\nsubmitted that considering the nature of the offence and also the
\nfact that now charge sheet has been filed the present application may
\nbe allowed. He submitted that there was some business transaction and
\ndispute for which settlement was arrived at and there was no payment
\nof contract killing as sought to be stated in the F.I.R.  He
\ntherefore, submitted that this complaint has been filed as an
\nafterthought and the present application may be allowed considering
\nthe nature of offence and the role attributed to the
\napplicant-accused. He submitted that there is no person like
\nReshmaben as stated and therefore, the present application may be
\nallowed.\n<\/p>\n
4.\tLearned
\nAPP Mr.Sejpal verified the record regarding payment pursuant to the
\nsubmissions made on the last occasion and was asked to make
\nclarification.  \tThe learned APP has, therefore, referred to the
\nstatements and resisted the application.  However, learned counsel
\nMr.Satta has submitted on behalf of the complainant that the amount
\nhas partly been paid by the applicant towards the contract killing
\nfor which he referred to the statements and submitted that the
\npresent application may not be entertained.  Learned advocate Mr.Rana
\nalso supported his submissions.\n<\/p>\n
5.\tIn
\nview of the rival submissions it is required to be considered whether
\nthe present application can be entertained or not. It is well
\naccepted that this Court is not required to appreciate the evidence
\nin detail at this juncture. However, considering the prima facie
\ncase, the relevant aspects like nature of offence, the manner in
\nwhich the offence alleged to have been committed, the role
\nattributed, etc. are required to be considered.  In the facts of the
\ncase, whether the amount was paid towards settlement arrived at
\nregarding the business transaction or it was an amount for the
\nalleged contract killing can be decided on the basis of the evidence
\nat the trial.  Therefore, without any further elaboration considering
\nthe statement of witnesses and the guidelines with regard to grant of
\nbail, the present application deserves to be allowed.\n<\/p>\n
6.\tThe
\napplication is accordingly allowed. The applicant is ordered to be
\nreleased on bail in connection with C.R. No.II-3015 of 2010
\nregistered with Suigam Police Station, on the applicant executing a
\npersonal bond of Rs.5,000\/- (Rupees five thousand only) with one
\nsolvent surety for the like amount to the satisfaction of the lower
\ncourt subject to further conditions that the applicant :\n<\/p>\n
(a)\tshall
\nnot take undue advantage of their liberty or abuse his \tliberty;\n<\/p>\n
(b)\tshall
\nnot try to tamper or pressurize the prosecution \twitnesses or the
\ncomplainant in any manner;\n<\/p>\n
(c)\tshall
\nnot act in any manner injurious to the interest of the \tprosecution;\n<\/p>\n
(d)\tshall
\nmaintain law and order and should cooperate with the \tinvestigating
\nofficers;\n<\/p>\n
(e)\tshall
\nmark  his presence  before  the concerned Police Station<\/p>\n
on the first
\nMonday of every calendar month between 11.00 AM and 02.00 PM till the
\ntrial commences.\n<\/p>\n
(f)\tshall
\n furnish  address  of  his residence to the Investigating<\/p>\n
Officer and
\nalso to the Court at the time of execution of the bond and shall not
\nchange his residence without prior permission of the Court.\n<\/p>\n
(g)\tshall
\nsurrender his passport, if any, to the lower court, \twithin a week.\n<\/p>\n
7.\tIf
\nbreach of any of the above conditions is committed, the concerned
\nSessions Judge will be free to issue warrant or take appropriate
\naction in the matter.\n<\/p>\n
8.\tBail
\nbefore the lower court having jurisdiction to try the case.  It would
\nbe open to the trial court concerned to give time to furnish the
\nsolvency certificate, if prayed for.\n<\/p>\n
9.\tRule
\nis made absolute. Direct service is permitted.\n<\/p>\n
