Details of irregularities that Director Liaison observed in         Same as above.\n<\/pre>\n<p>       compliance of DOPT OM&#8217;s on special recruitment drive in the<br \/>\n       undersigned representation.\n<\/p>\n<p>First Appeal:\n<\/p>\n<p>Misleading and unsatisfactory reply sent by PIO.\n<\/p>\n<p>Order of the FAA:\n<\/p>\n<p>&#8220;Complete information was not provided to the appellant as the matter to NSES, therefore PIO (NSES) is<br \/>\ndirected to provide to the appellant complete information within 7 days of receipt of this order.&#8221;\n<\/p>\n<p>Ground of the Second Appeal:\n<\/p>\n<p>No information was provided by PIO(NSES)<br \/>\n Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant : Mr. Hakam Singh<br \/>\nRespondent : Mrs. Chitra, Public Information Officer &amp; Dy. Director Liaison;\n<\/p>\n<p>       The PIO admits that PIO of Navyug School Education Society (NSES) has not provided any<br \/>\ninformation after the order of the FAA. A reminder has been sent on 24\/11\/2010 and on 28\/01\/2011 to the<br \/>\nPIO of NSES. On 02\/02\/2011 again another reminder has been sent. The Appellant also states he has not<br \/>\nreceived any information from the PIO NSES so far.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>PIO, NSES Ms. Spolia is directed to provide the complete information to the Appellant<br \/>\nbefore 28 February 2011.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the PIO,<br \/>\nNSES within 30 days as required by the law.\n<\/p>\n<p>From the facts before the Commission it is apparent that the PIO NSES is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within 30 days, as<br \/>\nper the requirement of the RTI Act. She has further refused to obey the orders of her superior officer,<br \/>\nwhich raises a reasonable doubt that the denial of information may also be malafide. The First Appellate<br \/>\nAuthority has clearly ordered the information to be given.\n<\/p>\n<p>It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1). A show cause notice is<br \/>\nbeing issued to her, and she is directed give her reasons to the Commission to show cause why penalty<br \/>\nshould not be levied on her.\n<\/p>\n<p>PIO, NSES Ms. S. R. Spolia will present herself before the Commission at the above address on<br \/>\n18 March 2011 at 10.30am alongwith her written submissions showing cause why penalty should not be<br \/>\nimposed on her as mandated under Section 20 (1). She will also submit proof of having given the<br \/>\ninformation to the appellant.\n<\/p>\n<p>It also appears that they persistently refused to give the information inspite of repeated reminders<br \/>\nto the respondent hence the Commission is also considering recommending disciplinary actions<br \/>\nunder Section 20(2) against her.\n<\/p>\n<p>If there are other persons responsible for the delay in providing the information to the Appellant the<br \/>\nPIO is directed to inform such persons of the show cause hearing and direct them to appear before the<br \/>\nCommission with her.\n<\/p>\n<p>This decision is announced in open chamber.<br \/>\nNotice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                        Shailesh Gandhi<br \/>\n                                                                                              Information Commissioner<br \/>\n                                                                                                       07 February 2011<br \/>\n(In any correspondence on this decision, mention the complete decision number.)
