Justice V.GIRI\n\n Dated :12\/06\/2008\n\n O R D E R\n                         V.GIRI, J\n                       -------------------\n                    W.P.(C).17123\/2008\n                      --------------------\n           Dated this the 12th day of June, 2008\n\n                       JUDGMENT\n<\/pre>\n<p>      I do not propose to embark upon a detailed<\/p>\n<p>appreciation of the facts involved in this case in<\/p>\n<p>circumstances    where      it    is     now conceded that<\/p>\n<p>notwithstanding the directions in Ext.P6 judgment,<\/p>\n<p>petitioner was not heard by the Devaswom Commissioner<\/p>\n<p>before passing Ext.P7 order. Learned Standing Counsel<\/p>\n<p>for the Travancore Devaswom Board, Mr.Sreekumar<\/p>\n<p>submits that the petitioner&#8217;s representation is considered<\/p>\n<p>by Commissioner, but he was not heard in person.<\/p>\n<p>      In the result, writ petition is disposed of directing<\/p>\n<p>the second respondent to reconsider the case of the<\/p>\n<p>petitioner in terms of the directions in Ext.P6 judgment.<\/p>\n<p>Petitioner shall be heard and if the Commissioner feels<\/p>\n<p>that it is necessary to hear the fourth respondent in<\/p>\n<p>Ext.P6, as also the fourth respondent in the present writ<\/p>\n<p>petition, they shall be heard and fresh orders shall be<\/p>\n<p>passed by the Commissioner in relation to the petitioner<\/p>\n<p>W.P.(C).17123\/2008<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>within a period of one month from the date of receipt of a<\/p>\n<p>copy of     this judgment.
