As the petitioner wanted<br \/>\nto go abroad, he made an application dated 26.02.2001 to the<br \/>\nrespondent-authority to sanction leave  from 19.04.2001 to<br \/>\n01.07.2001, which was ultimately granted by  the<br \/>\nrespondent-authority.  Thereafter, the petitioner made another<br \/>\napplication for extension of leave from 02.07.2001 to 16.02.2002 on<br \/>\nsome personal ground. Pursuant thereto, the concerned<br \/>\nrespondent-authority forwarded the same to the higher authority for<br \/>\nsanctioning the leave of 231 days i.e. from 02.07.2001 to<br \/>\n16.02.2002. However, no decision was taken on the said application.\n<\/p>\n<p>2.1.\t\tOn<br \/>\n12.02.2002, the petitioner made another application to the<br \/>\nrespondent-authority for Half Pay Leave on the ground of ailment of<br \/>\nhis wife for the period upto 12.05.2002. Pursuant thereto, the<br \/>\nconcerned respondent-authority forwarded the same to the higher<br \/>\nauthorities for sanctioning of the said leave. As the petitioner did<br \/>\nnot report for the duty, the respondent authority on 23.09.2004<br \/>\nissued charge sheet for unauthorized absenteeism. The petitioner vide<br \/>\nletter dated 24.12.2004 requested for time to file his reply. But the<br \/>\nrespondent authority did not grant time to file his reply.<br \/>\nThereafter, departmental inquiry was initiated against the petitioner<br \/>\nfor the alleged charges levelled against him and on completion of<br \/>\ninquiry the petitioner was held guilty for the alleged charges<br \/>\nlevelled against him.  The respondent-authority on the basis of the<br \/>\nInquiry Report,  dismissed the petitioner from the service vide order<br \/>\ndated 25.10.2006. Being aggrieved by the said order of dismissal, the<br \/>\npetitioner has approached this Court by way of this petition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record.  The impugned order under challenge is of the year 2006<br \/>\nand it is sought to be challenged after about three years.<br \/>\nConsidering the facts of the case, it would be beneficial to refer to<br \/>\na decision of the Apex Court in the case of <a href=\"\/doc\/796287\/\">Shiv Dass v. Union of<br \/>\nIndia &amp; Ors.<\/a> reported in AIR 2007 SC. 1330, wherein it<br \/>\nhas been held that the cause of action continues from month to month<br \/>\nand that if the petition is filed beyond reasonable period, the Court<br \/>\nwould reject the same or restrict the relief. Similar principle has<br \/>\nbeen laid down by the Apex Court in the case of  <a href=\"\/doc\/26187086\/\">Union of India &amp;<br \/>\nOrs. v. Tarsem Singh<\/a> reported in (2008) 8 SCC 648.\n<\/p>\n<p>4.\t\tLooking<br \/>\nto the facts of the case and keeping in mind the principle laid down<br \/>\nin the aforesaid decisions,  I am of the opinion that the petition<br \/>\ndeserves to be rejected on the  ground of delay itself.\n<\/p>\n<p>5.\t\tConsequently,<br \/>\nthe petition is summarily dismissed.
