T. Jasani, learned advocate for the applicant invited attention<br \/>\n\tto the averments made in the application to submit that the<br \/>\n\tapplicant being a poor person could not arrange for fees and<br \/>\n\texpenses to be incurred for engaging a lawyer and that the opponent<br \/>\n\thas taken possession of the suit premises immediately after the stay<br \/>\n\tperiod of 30 days was over due to which, the applicant and his<br \/>\n\tfamily were thrown out on the streets.  That in view of the<br \/>\n\taforesaid circumstances, the applicant could not vend fruits in his<br \/>\n\thandcart and had to search for a hut else where.  It is in the<br \/>\n\taforesaid circumstances, that there was a delay in filing the<br \/>\n\trevision application and as such, sufficient and reasonable cause<br \/>\n\thas been made out so as to condone the delay.\n<\/p>\n<p>On<br \/>\n\tthe other hand, Mr. Pankaj Soni, learned advocate for the respondent<br \/>\n\thas opposed the application submitting that the applicant herein has<br \/>\n\tlost upto the Supreme Court and that on merits, the applicant does<br \/>\n\tnot have any case. It is submitted that in the circumstances, the<br \/>\n\tdelay does not deserve to be condoned.\n<\/p>\n<p>Having<br \/>\n\tregard to the averments made in the memorandum of application, it is<br \/>\n\tapparent that the applicant has sufficiently explained the delay of<br \/>\n\t44 days that has occurred in filing the revision. Moreover, it is<br \/>\n\tapparent that there is no deliberate negligence or inaction on the<br \/>\n\tpart of the applicant in filing the revision, nor has he ever given<br \/>\n\tup the cause.  In the circumstances, the application deserves to be<br \/>\n\tallowed.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the application is allowed.  The delay of 44<br \/>\n\tdays that has occasioned in filing Civil Revision Application<br \/>\n\t(Stamp) No.67 of 2001 is hereby condoned.
