SATHASIVAM\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>CIVIL APPEAL NO 1668                    2008<br \/>\n(Arising out of S.L.P. (C) No.16312 of 2006)<\/p>\n<p>Dr. ARIJIT PASAYAT, J<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in this appeal is to the order of a Division<br \/>\nBench of the Allahabad High Court in First Appeal under<br \/>\nOrder 41 Rule 1 (r) of the Code of Civil Procedure, 1908 (in<br \/>\nshort &#8216;CPC&#8217;) <\/p>\n<p>3.\tBackgrounds facts in a nutshell are as follows:\n<\/p>\n<p>\tThe appellants as plaintiffs filed a suit (suit No.445 of<br \/>\n1999) for three reliefs:\n<\/p>\n<p>(i)\tThe sale deed executed by defendant-respondent<br \/>\nno.1 on 22.2.1999 in favour of defendant-<br \/>\nrespondent no.3 be declared as void.\n<\/p>\n<p>(ii)\ta permanent injunction be issued restraining the<br \/>\ndefendants from dispossessing the plaintiffs from<br \/>\nthe property in dispute.\n<\/p>\n<p>(iii)\tAnother permanent injunction restraining the<br \/>\ndefendants no.1, 2 and 4 from letting, selling and<br \/>\ndisposing of the property.\n<\/p>\n<p>4.\tAn application for injunction was also filed.  On 4.5.1999<br \/>\nex-parte order of injunction was granted.  The prayer to modify<br \/>\nthe same was rejected.  On 24.11.2001 a consent order was<br \/>\npassed by the Division Bench of the High Court.  The Division<br \/>\nBench directed disposal of the suit within six months and<br \/>\nfurther directed maintenance of status quo of the suit property<br \/>\ntill its disposal on certain conditions. Subsequently,<br \/>\napplication was filed by respondent no.4 by making a<br \/>\ngrievance that her counsel was not heard.  It is the stand of<br \/>\nthe appellants that her defence was struck off. In any event<br \/>\nthe order was recalled on 9.1.2002. High Court dismissed the<br \/>\nappeal holding prayer for interim injunction.\n<\/p>\n<p>5.\tIt is stated by learned counsel for the appellants that the<br \/>\norder of status quo continued for nine years and by the<br \/>\nimpugned order the position has been changed. The<br \/>\nconditions stipulated are really of no consequential relevance,<br \/>\nas in that case during pendency of the case there may be a<br \/>\nnecessity for impleading the vendees.\n<\/p>\n<p>6.\tLearned counsel for the respondents on the other hand,<br \/>\nsubmitted that the order is really one of concurrence and,<br \/>\ntherefore, there was no need to repeat the reasoning.\n<\/p>\n<p>7.\tWe find that the order of status quo continued for<br \/>\nconsiderable length of time.  It would, therefore, be<br \/>\nappropriate to direct maintenance of status quo as was<br \/>\noriginally granted by order dated 24.11.2001.  We make it<br \/>\nclear that by giving this protection it shall not be construed as<br \/>\nif we have expressed any opinion on the merits of the case.<br \/>\nWe request the Trial Court to dispose of the suit as early as<br \/>\npracticable preferably by the end of 2008.\n<\/p>\n<p>8.\tThe appeal is accordingly disposed with no order as to<br \/>\ncosts.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Ravi Prakash Agarwal &amp; Ors vs Rajesh Prasad Agarwal &amp; Ors on 29 February, 2008 Author: .
