No.23031 of 2011\n                           Abhay Sharma, son of Ramanuj Sharma,\n                                            Versus\n                                    The State Of Bihar\n                                          -----------\n<\/pre>\n<p>2.   28.7.2011                    Heard learned counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                                  The petitioner seeks bail in a case instituted for<\/p>\n<p>                 the offence under Sections 147, 148, 149, 354, 302 of the<\/p>\n<p>                 Indian Penal Code, Section 27 of the Arms Act and Section 17<\/p>\n<p>                 of C.L.A. Act.\n<\/p>\n<p>                             Considering that there is no specific overt act<\/p>\n<p>                 alleged against the petitioner and the petitioner is in custody<\/p>\n<p>                 since 16.2.2011, let the petitioner above named, be released on<\/p>\n<p>                 bail on furnishing bail bond of Rs. 5,000\/- (Five thousand) with<\/p>\n<p>                 two sureties of the like amount each or any other surety to be<\/p>\n<p>                 fixed by the court concerned to the satisfaction of Additional<\/p>\n<p>                 Sessions Judge (F.T.C.-IV), Jehanabad, in connection with<\/p>\n<p>                 Sessions Trial No. 183 of 2011\/43 of 2011 subject to the<\/p>\n<p>                 following conditions: (i) That one of the bailors will be a close<\/p>\n<p>                 relative of the petitioner, who will give an affidavit giving<\/p>\n<p>                 genealogy as to how he is related with the petitioner. The bailor<\/p>\n<p>                 will undertake to furnish information to the court about any<\/p>\n<p>                 change in the address of the petitioner (ii)That the bailor shall<\/p>\n<p>                 also state on affidavit that he will inform the court concerned if<\/p>\n<p>                 the petitioner is implicated in any other case of similar nature<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>        after his release in the present case and thereafter the court<\/p>\n<p>        below will be at liberty to initiate the proceeding for cancellation<\/p>\n<p>        of bail on the ground of misuse (iii)That the petitioner will give<\/p>\n<p>        an undertaking that he will receive the police papers on the<\/p>\n<p>        given date and be present on date fixed for charge and if he<\/p>\n<p>        fails to do so on two given dates and delays the trial in any<\/p>\n<p>        manner, his bail will be liable to be cancelled for reasons of<\/p>\n<p>        misuse.
