Misra.\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p> D E R<\/p>\n<p>\tIn all\tthese  appeals,\t the  common  question\tthat<br \/>\narises for consideration is whether the High Court of Punjab<br \/>\nand  Haryana  was  right  in  dismissing  the Regular Second<br \/>\nAppeals as abated on account of the  death  of\tone  of\t the<br \/>\nappellants.\n<\/p>\n<p>\tBrief  facts  leading to the filing of these appeals<br \/>\nare as under:-\n<\/p>\n<p>\tThe first respondent herein {since deceased), second<br \/>\nrespondent  and\t the  husband  of   the\t  third\t  respondent<br \/>\n(hereinafter referred to as the &#8216;Plaintiff -respondents&#8217; for<br \/>\nconvenience)  filed  eight  suits for possession of the suit<br \/>\nland by way of redemption  in  the  Court  of  Sub-Judge,lst<br \/>\nClass, Palwal,\tDistrict  Gurgaon.  The appellants contested<br \/>\nthe    suits,\t  contending\t inter\t   alia,that\t the<br \/>\nplaintiff-respondents were not the successors-in-interest of<br \/>\nthe  deceased  Durga  Devi, to whom the suit land originally<br \/>\nbelonged.  It was claimed by the plaintiff-resppondents that<br \/>\ntheir father, Charan Singh, was adopted by one Rattan Singh,<br \/>\nwho was, admittedly, entitled  to  succeed  along  with\t the<br \/>\nappellants on  the  death  of  Durga Devi.  The adoption was<br \/>\ndisputed by the contesting defendants (appellants herein) in<br \/>\nthe suits.    However,\tthe  Trial  Court  as  well  as\t the<br \/>\nAppellate  Court held that the adoption was true and binding<br \/>\non the defendants.  As a matter of  fact,  the\tTrial  Court<br \/>\ndecreed two suits out of eight suits and dismissed the other<br \/>\nsix suits.    The  reasons for dismissal need not detain us.\n<\/p>\n<p>Against\t   the\t  dismissal    of     six     suits,\t the<br \/>\nplaintiffs-respondents\tpreferred  six\tappeals\t before\t the<br \/>\nDistrict Judge, Gurgaon,  and  the  learned  District  Judge<br \/>\nallowed their  appeals.\t Against the judgment of the learned<br \/>\nDistrict Judge, the aforesaid R.S.As.  were preferred,<\/p>\n<p>\tAs pointed out earlier, the High Court dismissed the<br \/>\nappeals on the ground that the legal representatives of\t one<br \/>\nShiv  Lal,  one of the appellants before it, was not brought<br \/>\non record and, therefore, the appeal filed by Shiv Lal stood<br \/>\nabated.\t As a result of\t abatement  of\tShiv  Lal&#8217;s  appeal,<br \/>\naccording  to  the  High Court, the other appeals also stood<br \/>\nabated.\t Because of the common issue regarding the  adoption<br \/>\nof&#8221; plaintiff&#8217;s predecessor-in-interest, there cannot be two<br \/>\nconflicting decrees.  In other words, the adoption issue was<br \/>\ncommon\tand  decisive  in all the appeals pending before the<br \/>\nHigh Court and dismissing one appeal alone on the ground  of<br \/>\nabatement  and\tallowing  the  other  appeals  to proceed on<br \/>\nmerits might end in conflicting decrees in  case  the  other<br \/>\nappeals are accepted on merits.\n<\/p>\n<p>\tMr.    Nambiar,\t  learned  senior  counsel  for\t the<br \/>\nappellants, submitted that.  the High Court was not right in<br \/>\ndismissing the connected appeals  on  the  ground  that\t the<br \/>\nlegal  representatives\tof one of the deceased appellants in<br \/>\none R.S.A.  were not brought on record.\t  According  to\t the<br \/>\nlearned\t counsel, the decision of the High Court was against<br \/>\nthe provision of Order 22  Rule\t 4  of\tthe  Code  of  Civil<br \/>\nProcedure.   In\t support  thereof,  he\tplaced reliance on a<br \/>\njudgment of this Court in Balwant Singh &amp; Anr.\t etc.\t Vs.<br \/>\nDaulat Singh (dead)  by\t L.Rs.\t  &amp;  ors.  [JT 1997 (5) S.C.<br \/>\n703].\n<\/p>\n<p>\tOn the other hand, learned  counsel,  appearing\t for<br \/>\nthe  respondents  submitted that the High Court was right in<br \/>\nholding that on account of a common issue in ail the appeals<br \/>\nthe death of one of the appellants in one R.S.A.   resulting<br \/>\nin  abatement  of that appeal, will also result in abatement<br \/>\nof other appeals.  In support of his contention,  he  placed<br \/>\nreliance  on  two judgments of this Court in State of Punjab<br \/>\nVs.  Nathu Ram [AIR 1962 SC 893 and Sri Chand &amp;\t Ors.\t Vs.<br \/>\nM\/s Jagdish Pershad Kishan Chand &amp; Ors.\t [AIR 1966 SC 1427].\n<\/p>\n<p>\tWe  have considered the rival submissions and we are<br \/>\nof the view that the High Court was right in coming  to\t the<br \/>\nconclusion  that  the  decree  was  based  on a common issue<br \/>\nagainst the appellants in all  the  six\t R.S.As.    and\t the<br \/>\nfailure\t to  bring  the\t legal representatives of one of the<br \/>\ndeceased appellants in one R.S..A.  will result in abatement<br \/>\nof other appeals.   Otherwise,\tthere  will  be\t conflicting<br \/>\ndecrees in  the\t event\tof  other  R.S.As.  being allowed on<br \/>\nmerits, which cannot be allowed.\n<\/p>\n<p>\tWe have noticed earlier that the  common  issue\t for<br \/>\nconsideration  in  all the appeals before the High Court was<br \/>\nwhether\t the  claim   of   the\t plaintiff-respondents\t for<br \/>\npossession  of\tthe  suit  land on the basis of adoption was<br \/>\nsustainable.  The Courts below having found the adoption  in<br \/>\nfavour\tof  the plaintiffs, the consequence will be that the<br \/>\nissue of adoption in respect  of  Shiv\tLal&#8217;s  appeal  would<br \/>\nbecome\tfinal  in that R.S.A., resulting in the abatement of<br \/>\nthat R.S.A.  as\t well  as  other  R.S.\t  Appeals  to  avoid<br \/>\nconflicting decrees.\n<\/p>\n<p>\tThis Court in Nathu Ram&#8217;s case (supra) laid down the<br \/>\nfollowing test:-\n<\/p>\n<p>\t&#8220;The  test  to\tdetermine this has been described in<br \/>\ndiverse forms.\tCourts will not proceed with  anappeal;\t (a)<br \/>\nwhen  the  success  of\tthe  appeal  may lead to the Court&#8217;s<br \/>\ncoming to a  decision  which  be  in.\t conflict  with\t the<br \/>\ndecision  between the appellant and the deceased respondent,<br \/>\nand therefore which would lead\tto  the\t Court&#8217;s  passing  a<br \/>\ndecree\twhich  will be contradictory to the decree which had<br \/>\nbecome final with respect to the same subjectmatter  between<br \/>\nthe  appellant\tand  the  deceased  respondent; (b) when the<br \/>\nappellant  could  not  have  brought  the  action,  for\t the<br \/>\nnecessary  relief  against  those  respondents alone who are<br \/>\nstill before the Court and(c) when the\tdecree\tagainst\t the<br \/>\nsurviving   respondents,   if\tthe   appeal   succeeds,  be<br \/>\nineffective, that is to say, it could  not  be\tsuccessfully<br \/>\nexecuted.&#8221;\n<\/p>\n<p>\tIn  Sri\t Chand&#8217;s  case\t(supra\t),  this Court again<br \/>\nreiterated the same view by observing as follows :-\n<\/p>\n<p>\t&#8220;Counsel for the first respondent contended that the<br \/>\nappeal\thad  abated  in\t its  entirety\tbecause the heirs of<br \/>\nBasant Lal had not been brought on record, and the ground on<br \/>\nwhich the judgment of the High Court proceeded was common to<br \/>\nall the sureties.  In  our  view,  this\t objection  must  be<br \/>\nupheld.\t The appeal of Basant Lal has abated since the legal<br \/>\nrepresentatives\t to  his estate have not been impleaded, and<br \/>\nthe record of the appeal is defective.\tThat is\t not  denied<br \/>\nby the\tappellants.    But  is\tis  urged that this Court is<br \/>\ncompetent to setaside an order of  the\tHigh  Court  in\t its<br \/>\nentirety on the ground that it is not sustainable in law and<br \/>\nin  any\t event\tto set aside the order insofar as it affects<br \/>\nthe claim of appellants 1 and 3 and  the  third\t respondent.<br \/>\nSupport\t was  sought  to be derived for the first contention<br \/>\nfrom 0.41 R.4 of the Code of  Civil  Procedure\tand  it\t was<br \/>\nurged  that  even if the decree be assumed to have proceeded<br \/>\non a ground common to all the sureties, it is  open  to\t any<br \/>\none or more of the sureties to appeal from the order and the<br \/>\nappellate  Court may reverse or vary the decree in favour of<br \/>\nall the sureties.  This plea stands refuted by the  judgment<br \/>\nof this\t Court\tin  Rameshwar  Prasad  V.    Shambehari\t Lal<br \/>\nJagannath, AIR 19&amp;3 SC 1901.  It was held by this  Court  in<br \/>\nRameshwar Prasad&#8217;s case, ATR 1953&#8242; 3C 1901 that an appellate<br \/>\nCourt,\thas  no\t power\tto  proceed  with  an appeal &#8216;and to<br \/>\nreverse and vary the decree in favour of all the plaintiffs,<br \/>\nor defendants under 0.41 R.4 when the decree proceeds  on  a<br \/>\nground common  to all the plaintiffs.  or defendants, if all<br \/>\nthe plaintiffs or the defendants appeal from the decree\t and<br \/>\nany  of them dies dies and the appeal abates so far as he is<br \/>\nconcerned.&#8221;\n<\/p>\n<p>\tIn  the\t light of the decisions of this Court and in<br \/>\nview of the facts of these cases, there cannot be any  doubt<br \/>\nthat  the  High\t Court was perfectly right in dismissing all<br \/>\nthe appeals as abated.&#8217;<\/p>\n<p>\tThe decision cited by the learned  counsel  for\t the<br \/>\nappellants is  distinguishable\ton facts.  In that case, the<br \/>\nCourt has given a  finding  of\tfact  that  the\t decree\t was<br \/>\ndivisible.    Therefore,   that\t  judgment   will   have  no<br \/>\napplication to the facts of the present cases.\n<\/p>\n<p>\tIn the\tcircumstances,\tthe  appeals  fail  and\t are<br \/>\naccordingly dismissed with no order as to costs,<\/p>\n<p>\tIn view of  the\t above,\t all the I.
