Yadav, Advocate, for the petitioner.\n              Mr. Tarun Aggarwal, Senior DAG, Haryana.\n\nRajan Gupta, J.\n<\/pre>\n<p>              The petitioner has prayed for pre-arrest bail in a case<\/p>\n<p>registered against him under Sections 323, 324, 307, 506 read with<\/p>\n<p>Section 34 IPC at Police Station Shahzadpur, District Ambala, vide FIR<\/p>\n<p>No.35 dated 25.03.2009.\n<\/p>\n<p>              Allegation against the petitioner is that he gave a Gandasi<\/p>\n<p>blow on the head of the complainant. He attacked the complainant<\/p>\n<p>alongwith other accused.\n<\/p>\n<p>              Learned counsel for the petitioner has argued that though<\/p>\n<p>the petitioner may have been armed with a Gandasi, he only caused a<\/p>\n<p>simple injury. No injury under Section 307 IPC can be attributed to the<\/p>\n<p>petitioner.\n<\/p>\n<p>              Learned counsel for the State has opposed the prayer for<\/p>\n<p>anticipatory bail on the ground that accused in the FIR are habitual<br \/>\n<span class=\"hidden_text\">   CRM No. M-13329 of 2009                          2<\/span><\/p>\n<p>offenders and there are other cases registered against them. According<\/p>\n<p>to the counsel, custodial interrogation of the petitioner is required for<\/p>\n<p>taking the investigation to its logical end.<\/p>\n<p>              I have heard learned counsel for the petitioner and given<\/p>\n<p>careful thought to the facts of the case.<\/p>\n<p>              It is evident that the petitioner alongwith other accused<\/p>\n<p>attacked the complainant and caused number of injuries to him. The<\/p>\n<p>petitioner, who was armed with a Gandasi, tried to hit the petitioner on<\/p>\n<p>the head. However, the complainant raised his hand to save himself due<\/p>\n<p>to which he did not get a fatal injury on his head. Instead he received an<\/p>\n<p>injury on his wrist.\n<\/p>\n<p>              In the facts and circumstances of the case, I do not consider<\/p>\n<p>it a fit case for extending the concession of anticipatory bail to the<\/p>\n<p>petitioner.   The allegations against him are serious.
