Sinha, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tAppellant  National Insurance Company is before us, aggrieved by<br \/>\nand dissatisfied with the judgment and order dated 14th July, 2003, passed by<br \/>\na learned Single Judge of the Karnaraka High Court in M.F.A. No.<br \/>\n7788\/2002 dismissing the appeal preferred against an award dated 17.9.2002<br \/>\npassed by the Motor Accident Claims Tribunal (Tribunal for short) in<br \/>\nM.V.C No.124\/2000.\n<\/p>\n<p>3.\tThe fact of the matter relevant for the purpose of disposal of this<br \/>\nappeal is as under :\n<\/p>\n<p>     The vehicle involved in the accident was a Matador Van bearing<br \/>\nregistration No. KA-23\/2890. It had a Goods Carriage permit granted in<br \/>\nterms of Form No.7 of the Motor Vehicles Act.  It was insured with the<br \/>\nappellant. The said vehicle met with an accident on 9.12.1999 causing death<br \/>\nof one Gangawwa wife of the respondent No.1 herein. A contention was<br \/>\nraised on behalf of the appellant that the driver of the said vehicle did not<br \/>\npossess an effective licence to drive a transport vehicle.\n<\/p>\n<p>4.\tAn issue (being Issue No.3), inter alia, was framed in that behalf<br \/>\nbefore the Tribunal, which reads as under:<br \/>\nWhether the R-3 proves that driver of offending<br \/>\nvehicle was not an authorised person to drive the<br \/>\nsame?<\/p>\n<p>5.\tThe learned Tribunal in support of its award on Issue No.3, held:<br \/>\nDW-1 in this cross examination admitted that<br \/>\noffending vehicle is authorised to transport 3500<br \/>\nkgs. goods. Further, in this cross-examination<br \/>\nstated that LMV means transport vehicle which<br \/>\nunladen weight does not exceed 7500 kgs. Ex.D-2<br \/>\nat Column No.12 clearly shows that the unladen<br \/>\nweight of the offending vehicle is 3500 kgs.<br \/>\nThereby it is very much clear that said unladen<br \/>\nweight of the offending vehicle is much less than<br \/>\n7500 kgs. as admitted by DW-1 in his cross-<br \/>\nexamination which is also the effect as defined in<br \/>\nthe MV Act. So when the unladen weight of the<br \/>\noffending vehicle is less than 7500 kgs. the RW-1<br \/>\ndriver who is having DL as per Ex.D-3 is certainly<br \/>\nauthorised to drive the offending vehicle. The<br \/>\ndecision relied upon by Adv. for petitioners at<br \/>\nserial No.2 ruling reported in 2000(5) KLJ 473<br \/>\n(DB) or own Hon&#8217;ble High Court had clearly held<br \/>\nthat where offending vehicle is weighing 4960 kgs.<br \/>\ndriven by a person having DL to drive the LMV,<br \/>\nthere is breach of issuance policy, as statute<br \/>\nclassifies vehicle weighing below 7500 kgs. as<br \/>\nLMVs and Insurer is liable to satisfy award in<br \/>\nrespect of accident that occurred when the vehicle<br \/>\nwas being driven by driver holding such licence.<br \/>\nSo in view of the decision of Division Bench of<br \/>\nour own Hon&#8217;ble High Court and also the decision<br \/>\nof Supreme Court referred at Sl. No.1 Adv. for<br \/>\npetitioners it is very much clear that RW1 is<br \/>\nhaving valid DL as per Exh.D3 and the offending<br \/>\nvehicle unladen weight is 3500 kgs. is certainly<br \/>\nwas having effective and valid DL and so R3 has<br \/>\nfailed to prove the issue No.3 and accordingly I<br \/>\nanswer the same in the negative.<\/p>\n<p>6.\tThe High Court on an appeal preferred by the appellant herein<br \/>\nopined :\n<\/p>\n<p>Counsel for the appellant-Insurance Company,<br \/>\nquestioning the liability, contended that the driver<br \/>\ndid not possess a valid licence to drive LMV.<br \/>\nAccording to the respondents, the driver had<br \/>\ndriving licence to drive LMV, a transport vehicle.<br \/>\nAccording to the appellant, the vehicle in question<br \/>\ninvolved in the accident is a transport vehicle. The<br \/>\nsaid contention cannot be accepted by this Court,<br \/>\nin view of the fact that claimants are third parties<br \/>\neven on the ground that there is violation of terms<br \/>\nand conditions of policy, the insurance company<br \/>\ncannot be permitted to contend that it has no<br \/>\nliability. Accordingly, I do not see any merit in this<br \/>\nappeal.<\/p>\n<p>7.\tMr. Vishnu Mehra, learned counsel appearing on behalf of the<br \/>\nappellant would submit that the High Court committed a serious error in<br \/>\npassing the impugned judgment in so far as it failed to take into<br \/>\nconsideration that a light motor vehicle cannot be a transport vehicle<br \/>\nwithin the meaning of the provisions of the Act. It was submitted that for the<br \/>\npurpose of grant of licence for driving a vehicle, an application has to be<br \/>\nfiled in Form No.4, whereafter only a licence is granted in Form No.6.<br \/>\nLearned counsel contended that the said forms have been prescribed in terms<br \/>\nof Rules 14 and 16 of the Central Motor Vehicles Rules, 1989, and on a<br \/>\nperusal thereof as also the aforementioned Forms, it would be clear that a<br \/>\nlight motor vehicle does not answer the description of a transport vehicle.\n<\/p>\n<p>8.\tMr. S.N. Bhat, learned counsel appearing on behalf of the<br \/>\nrespondents, on the other hand, submitted that the contention raised herein<br \/>\nby the appellant has neither been raised before the Tribunal nor before the<br \/>\nHigh Court.  In any event, it was urged, that keeping in view the definition of<br \/>\nthe light motor vehicle as contained in Section 2(21) of the Motor vehicles<br \/>\nAct, 1988 (Act for short), a light goods carriage would come within the<br \/>\npurview thereof.\n<\/p>\n<p>\t\tA light goods carriage having not been defined in the Act, the<br \/>\ndefinition of the light motor vehicle clearly indicates that it takes within its<br \/>\numbrage, both a transport vehicle and a non-transport vehicle.<br \/>\n\t\tStrong reliance has been placed in this behalf by the learned counsel<br \/>\nin <a href=\"\/doc\/528251\/\">Ashok Gangadhar Maratha  vs.  Oriental Insurance Company Ltd.,<\/a> [1999<br \/>\n(6) SCC 620].\n<\/p>\n<p>9.\tThe Motor Vehicles Act, 1988, which was enacted to consolidate<br \/>\nand amend the law relating to motor vehicles, is a complete code.\n<\/p>\n<p>10.\tSection 2 of the Act provides for interpretation of the terms<br \/>\ncontained herein. It employs the words unless the context otherwise<br \/>\nrequires. Section 2(16) of the Act defines heavy goods vehicle  to mean<br \/>\nany goods carriage the gross vehicle weight  of which, or a tractor or a road-<br \/>\nroller the unladen weight of either of which, exceeds 12,000 kilograms.\n<\/p>\n<p>11.\tSection 2(21) defines light motor vehicle and Section 2(23)<br \/>\ndefines medium goods vehicle as under:<br \/>\nLight motor vehicle means a transport vehicle or<br \/>\nomnibus  the gross vehicle weight of either of<br \/>\nwhich or a motor car or tractor or road-roller the<br \/>\nunladen weight of any of which, does not exceed<br \/>\n7500 kilograms.<br \/>\nMedium goods vehicle means any goods carriage<br \/>\nother than a light motor vehicle or a heavy goods<br \/>\nvehicle.<\/p>\n<p>     Section 3 of the Act is in the following terms:<br \/>\n3. Necessity for driving licence.- (1) No person<br \/>\nshall drive a motor vehicle in any public place<br \/>\nunless he holds an effective driving licence issued<br \/>\nto him authorising him to drive the vehicle; and no<br \/>\nperson shall so drive a transport vehicle other than<br \/>\na motorcab or motor cycle hired for his own use or<br \/>\nrented under any scheme made under sub-section<br \/>\n(2) of section 75 unless his driving licence<br \/>\nspecifically entitles him so to do.<\/p>\n<p>12.\tThe Central Government has framed Rules known as The Central<br \/>\nMotor Vehicles Rules, 1989.\n<\/p>\n<p>13.\tThe word Form has been defined in Rule 2(e) to mean a Form<br \/>\nappended to the rules.\n<\/p>\n<p>I Apply for a licence to enable me to drive<br \/>\nvehicles of the following description:\n<\/p>\n<p>\t(d) Light motor vehicle\n<\/p>\n<p>\t(e) Medium goods vehicle\n<\/p>\n<p>\t(g) Heavy goods vehicle\n<\/p>\n<p>     (j)\tMotor vehicles of the following<br \/>\ndescription:&#8230;.<\/p>\n<p>     \tAfter amendment the relevant portion of Form 4 reads as under:\n<\/p>\n<p>I Apply for a licence to enable me to drive<br \/>\nvehicles of the following description:\n<\/p>\n<p>     (d) Light motor vehicle\n<\/p>\n<p>     (e) Transport vehicle\n<\/p>\n<p>(j)\tMotor vehicles of the following<br \/>\ndescription:&#8230;.<\/p>\n<p>14.\tRule 14 prescribes for filing of an application in Form 4, for a<br \/>\nlicence to drive a motor vehicle, categorizing the same in nine types of<br \/>\nvehicles.\n<\/p>\n<p>\t\tClause (e) provides for Transport vehicle which has been<br \/>\nsubstituted by G.S.R. 221(E) with effect from 28.3.2001. Before the<br \/>\namendment in 2001, the entries medium good vehicle and heavy goods<br \/>\nvehicle existed which have been substituted by transport vehicle.  As<br \/>\nnoticed hereinbefore, Light Motor Vehicles also found place therein.\n<\/p>\n<p>15.\tLight Motor Vehicle is defined in Section 2(21) and, therefore, in<br \/>\nview of the provision, as then existed, it included a light transport vehicle.<br \/>\n\tForm 6 provides for the manner in which the licence is to be granted, the<br \/>\nrelevant portion whereof read as under:<br \/>\nAuthorisation to drive transport vehicle<\/p>\n<p>Number&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.\t\tDate&#8230;&#8230;..<br \/>\nAuthorised to drive transport vehicle with effect<br \/>\nfrom&#8230;&#8230;. Badge number &#8230;&#8230;&#8230;\n<\/p>\n<p>                      Signature&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.\n<\/p>\n<p>\t\t\t&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.\n<\/p>\n<p>\t\t\tDesignation of the licensing<br \/>\n \t\t\tauthority <\/p>\n<p>Name and designation of their<br \/>\nauthority who conducted the<br \/>\ndriving test.<\/p>\n<p>16.\tFrom what has been noticed hereinbefore, it is evident that<br \/>\ntransport vehicle has now been substituted for &#8216;medium goods vehicle&#8217; and<br \/>\n&#8216;heavy goods vehicle&#8217;.  The light motor vehicle continued, at the relevant<br \/>\npoint of time, to cover both, light passenger carriage vehicle and light<br \/>\ngoods carriage vehicle.\n<\/p>\n<p>       A driver who had a valid licence to drive a light motor vehicle,<br \/>\ntherefore, was authorised to drive a light goods vehicle as well.\n<\/p>\n<p>17.\tThe amendments carried out in the Rules having a prospective<br \/>\noperation, the licence held by the driver of the vehicle in question cannot be<br \/>\nsaid to be invalid in law.\n<\/p>\n<p>18.\tFor the reasons aforementioned there is no merit in this appeal and it<br \/>\nis dismissed with costs which we quantify at Rs.25,000\/-(Rupees Twenty<br \/>\nFive Thousand only).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India National Insurance Company Ltd vs Annappa Irappa Nesaria &amp; Ors on 22 January, 2008 Author: S Sinha Bench: S.B.
