Justice ANTONY DOMINIC\n\n Dated :05\/10\/2009\n\n O R D E R\n                    ANTONY DOMINIC,J.\n                ---------------------\n                W.P.(C).No.23019 OF 2008\n              ------------------------\n            Dated this the 5th day of October, 2009.\n\n                         JUDGMENT\n<\/pre>\n<p>      Petitioner is now working as Lecturer in Computer<\/p>\n<p>Science under the first respondent. In October, 2007,<\/p>\n<p>applications are invited for the post of Assistant Professor.<\/p>\n<p>Petitioner and another        candidate had submitted their<\/p>\n<p>applications. In terms of the Special Rules, Senior Staff<\/p>\n<p>Section Committee should consist of 7 members including<\/p>\n<p>the Principal Secretary, Higher Education as Chairman,<\/p>\n<p>Director as the Member Secretary and nominees of AICTE<\/p>\n<p>and CUSAT, expert members and Principal of the College.<\/p>\n<p>According to the petitioner in the Selection Committee<\/p>\n<p>there was no nominee        of    AICTE and CUSAT and the<\/p>\n<p>Principal was also absent, besides an expert member.<\/p>\n<p>      2.   Be that as it may, candidates        including the<\/p>\n<p>petitioner were interviewed on 3.11.2007         but however<\/p>\n<p><span class=\"hidden_text\">WP(c).No.23019\/08               2<\/span><\/p>\n<p>none was selection. The list was published on 24.12.2007.<\/p>\n<p>When the petitioner applied for copy of the proceedings, she<\/p>\n<p>was issued Ext.P3 mark list indicating that out of the 100<\/p>\n<p>marks she secured only 15. It was thereafter on 22.7.2008 this<\/p>\n<p>writ petition was filed seeking to quash selection proceedings<\/p>\n<p>and to direct that a fresh Senior Staff Selection Committee<\/p>\n<p>shall be constituted in terms of the Special Rules and conduct<\/p>\n<p>selection to the post notified. Subsequent to the filing of this<\/p>\n<p>writ petition and     pursuant to the orders, petitioner was<\/p>\n<p>issued Ext.P4 showing the marks that she secured and also the<\/p>\n<p>marks that the other candidate had secured.<\/p>\n<p>      3. The respondents also have filed counter affidavit. The<\/p>\n<p>first respondent justifies the selection procedure by it. In so<\/p>\n<p>far as the 4th respondent, a member of the selection<\/p>\n<p>committee is concerned, personal allegations of mala fides<\/p>\n<p>have been levelled on the basis        that when he was the<\/p>\n<p>Principal of the college, while granting maternity leave, the<\/p>\n<p>petitioner was denied salary. It is also alleged that when the<\/p>\n<p><span class=\"hidden_text\">WP(c).No.23019\/08                3<\/span><\/p>\n<p>petitioner availed leave under Qualification       Improvement<\/p>\n<p>Programme, she was denied study leave with salary. This<\/p>\n<p>allegation has been denied in the counter affidavit filed.<\/p>\n<p>      4. As already stated, the prayer made in this writ petition<\/p>\n<p>is to direct the respondents to initiate fresh process of<\/p>\n<p>selection. In the counter affidavit filed, the first respondent<\/p>\n<p>has no case that the post has been filled up. The first<\/p>\n<p>respondent also has no case that         the post of Assistant<\/p>\n<p>Professors in Computer Science need not be filled. In such<\/p>\n<p>circumstances the Selection Committee should be constituted<\/p>\n<p>in terms of the provisions contained in the Special Rules and<\/p>\n<p>steps shall be taken for filling up the post.<\/p>\n<p>      5. Petitioner submits that certain other posts were filled<\/p>\n<p>pursuant to the interview that was held in November, 2007<\/p>\n<p>and that the process as directed above should be concluded<\/p>\n<p>with effect from that date and promotions given with<\/p>\n<p>retrospective effect, as otherwise, even if selected,        the<\/p>\n<p>petitioner will be junior to the persons who got promoted<\/p>\n<p><span class=\"hidden_text\">WP(c).No.23019\/08               4<\/span><\/p>\n<p>earlier.\n<\/p>\n<p>      6. First of all, the petitioner has no claim of seniority<\/p>\n<p>over those persons selected in the interview. None of those<\/p>\n<p>persons have been impleaded in the writ petition also.<\/p>\n<p>Therefore no relief affecting the seniority or other rights of<\/p>\n<p>those persons can be granted in this writ petition.        In the<\/p>\n<p>circumstances the only order that can be passed in this writ<\/p>\n<p>petition is to direct the the first respondent to initiate a fresh<\/p>\n<p>process of selection to the post of Assistant Professor, which<\/p>\n<p>post is lying vacant even as of now.\n<\/p>\n<p>      7. The petitioner has raised several allegations of mala<\/p>\n<p>fides against the 4th respondent.        Those allegations are<\/p>\n<p>relating to the grant of maternity leave and leave under the<\/p>\n<p>Qualification    Improvement Programme. According to the<\/p>\n<p>petitioner admissible benefits available during that period<\/p>\n<p>were denied       by the 4th respondent.   Therefore she filed<\/p>\n<p>complaints and because of that the 4th respondent was<\/p>\n<p>inimical    towards her. For that reason, according to the<\/p>\n<p><span class=\"hidden_text\">WP(c).No.23019\/08              5<\/span><\/p>\n<p>petitioner the 4th respondent shall not be a member of the<\/p>\n<p>selection committee to be constituted. These allegations have<\/p>\n<p>been answered by the 4th respondent by filing a counter<\/p>\n<p>affidavit. Therefore the allegation made by the petitioner is<\/p>\n<p>refuted by the 4th respondent in the counter affidavit filed. In<\/p>\n<p>the light of the allegations and counter allegations contained<\/p>\n<p>in the writ petition and the counter affidavit and in the<\/p>\n<p>absence of any further reliable materials,       I am not in a<\/p>\n<p>position to accept the plea of mala fides on the part of the 4th<\/p>\n<p>respondent.\n<\/p>\n<p>      8. In the circumstances, the writ petition is disposed of<\/p>\n<p>directing the first respondent to initiate selection to the post<\/p>\n<p>of Assistant Professor, to which post the petitioner was also an<\/p>\n<p>applicant, constituting   Senior Staff Selection Committee in<\/p>\n<p>accordance with the special rules which is applicable.
