      The petitioner, who retired from service on 31\/12\/2007<\/p>\n
on attaining the age of superannuation, has filed this writ<\/p>\n
petition aggrieved by the delay in disbursement of the<\/p>\n
retirement benefits.    The brief facts of the case are as<\/p>\n
follows :-\n<\/p>\n
      While the petitioner was working as Head Clerk in the<\/p>\n
Block   Development      Office   at   Sultan    Bathery, the<\/p>\n
Commissioner for Rural Development placed him under<\/p>\n
suspension by Ext.P1 order dated 05\/07\/2006, pending<\/p>\n
detailed enquiry.    The petitioner challenged the order of<\/p>\n
suspension in WP(C) No.19073 of 2006. While the said writ<\/p>\n
petition was pending, an enquiry into the grounds of<\/p>\n
suspension     was    held    by    the   Joint   Development<\/p>\n
Commissioner, pursuant to the directions issued by the<\/p>\n
Commissioner for Rural Development in Ext.P3. The enquiry<\/p>\n

officer gave notice to the petitioner, conducted an enquiry<\/p>\n
and    submitted    his  report   on   25\/08\/2006    to   the<\/p>\n
Commissioner for Rural Development.        The Commissioner<\/p>\n
for Rural Development considered the report of enquiry and<\/p>\n
decided to revoke the order of suspension. He, thereupon,<\/p>\n
passed Ext.P6 order dated 20\/12\/2006 reinstating the<\/p>\n
petitioner in service without prejudice to the continuance of<\/p>\n
the disciplinary action initiated against him. The petitioner<\/p>\n
was also posted in Wayanad district.      A day after Ext.P6<\/p>\n
order was issued, WP(C) No.19073 of 2006 was heard and<\/p>\n
allowed by Ext.P2 judgment. This Court called for the files<\/p>\n
and also the report of enquiry submitted by the Joint<\/p>\n
Development Commissioner and held that the action of the<\/p>\n
respondents in placing the petitioner under suspension is<\/p>\n
patently unjust and an abuse of the statutory and<\/p>\n
administrative power vested in them. The order placing the<\/p>\n
petitioner under suspension was declared to be arbitrary,<\/p>\n
was quashed and the respondents were directed to<\/p>\n

regularize the period during which the petitioner was kept<\/p>\n
out of service in accordance with law. Ext.P2 judgment has<\/p>\n
become final.\n<\/p>\n
      2.   Thereafter,   Ext.P7    memo     of  charges  dated<\/p>\n
02\/06\/2007 was served on the petitioner.           He submitted<\/p>\n
Ext.P8 reply dated 27\/06\/2007 and shortly thereafter,<\/p>\n
retired from service on 31\/12\/2007 on attaining the age of<\/p>\n
superannuation. Before the petitioner retired from service,<\/p>\n
the disciplinary action initiated against him was not<\/p>\n
finalized. It is aggrieved by the delay in finalization of the<\/p>\n
disciplinary proceedings and non-payment of pensionary<\/p>\n
benefits, that the petitioner filed this writ petition.<\/p>\n
      3.   The respondents have filed a counter affidavit<\/p>\n
resisting the writ petition and contending, inter alia that<\/p>\n
terminal benefits can be sanctioned and disbursed to the<\/p>\n
petitioner only after the disciplinary proceedings are<\/p>\n
finalized.   The petitioner has along with I.A.No.13508 of<\/p>\n
2008 produced Ext.P9 order dated 13\/08\/2008 issued by the<\/p>\n
WP(C) No.15109\/2008

Senior Administrative Officer of the Commissionerate of<\/p>\n
Rural Development, whereby the disciplinary action initiated<\/p>\n
against the petitioner was finalized by directing recovery of<\/p>\n
an amount equal to one increment without cumulative effect<\/p>\n
from the DCRG of the petitioner. Ext.P9 further directs that<\/p>\n
orders regularizing the period of suspension will be issued<\/p>\n
separately.\n<\/p>\n
      4.   When the writ petition came up for hearing today,<\/p>\n
Shri.P.Ravindran, learned senior counsel appearing for the<\/p>\n
petitioner submitted that the petitioner does not wish to<\/p>\n
challenge Ext.P9 and that as the disciplinary proceedings<\/p>\n
initiated against the petitioner have been finalized, the<\/p>\n
respondents may be directed to sanction and disburse the<\/p>\n
terminal     benefits  payable   to  him.       Per   contra,<\/p>\n
Smt.T.B.Remani, the learned Government Pleader submitted<\/p>\n
that terminal benefits can be sanctioned and disbursed to<\/p>\n
the petitioner only after the period of suspension is<\/p>\n
regularized.       It was submitted that since a minor<\/p>\n

punishment of barring of one increment without cumulative<\/p>\n
effect was imposed on the petitioner, the petitioner cannot<\/p>\n
claim that he is exonerated of the charges and therefore,<\/p>\n
the disciplinary authority can regularize the period of<\/p>\n
suspension on terms, which it thinks fit to impose.      The<\/p>\n
learned Government Pleader submitted that so long as<\/p>\n
orders regularizing the period of suspension have not been<\/p>\n
issued, the petitioner cannot claim payment of terminal<\/p>\n
benefits.\n<\/p>\n
      5.   From the pleadings and the materials on the<\/p>\n
record, it is evident that the disciplinary proceedings<\/p>\n
initiated against the petitioner have been finalised with the<\/p>\n
passing of Ext.P9 order.     Though after 31\/12\/2007, the<\/p>\n
disciplinary    authority could   not  have   imposed    any<\/p>\n
punishment, the petitioner has fairly and graciously<\/p>\n
conceded that he does not propose to challenge Ext.P9. The<\/p>\n
only prayer made by the petitioner is that accepting Ext.P9,<\/p>\n
the terminal benefits, which he is entitled to, may be<\/p>\n

sanctioned and disbursed after recovering the monetary<\/p>\n
value of one increment without cumulative effect.        The<\/p>\n
stand taken by the respondents is that terminal benefits can<\/p>\n
be sanctioned and disbursed only after orders regularizing<\/p>\n
the period of suspension are passed.       The respondents<\/p>\n
further contend that the disciplinary authority has got wide<\/p>\n
discretion in the matter of regularizing the period of<\/p>\n
suspension and the quantum of terminal benefit, which the<\/p>\n
petitioner is entitled to would depend on the nature of the<\/p>\n
order to be passed by the disciplinary authority regularizing<\/p>\n
the period of suspension. In other words, the stand taken<\/p>\n
by the respondents is that notwithstanding the findings of<\/p>\n
this Court in Ext.P2 judgment, they have the absolute<\/p>\n
discretion in the matter of regularizing the period of<\/p>\n
suspension.\n<\/p>\n
     6.    Though the petitioner was suspended by Ext.P1<\/p>\n
order dated 05\/07\/2006, this Court after calling for and<\/p>\n
perusing the records, entered a finding against the<\/p>\n

respondents and in favour of the petitioner that the order of<\/p>\n
suspension was wholly unwarranted and was uncalled for.<\/p>\n
Ext.P2 judgment has become final. The operative portion of<\/p>\n
Ext.P2 judgment reads as follows :-\n<\/p>\n
           “16. The     respondents     have   not    denied    or<\/p>\n
     controverted the averments in the writ petition. Nothing<\/p>\n
     has been stated in answer to the apparently discriminatory<\/p>\n
     and arbitrary action of the respondents in singling out the<\/p>\n
     petitioner alone for hostile treatment. I have no hesitation<\/p>\n
     to hold that the action of the respondents is patently<\/p>\n
     unjust and is tantamount to abuse of the statutory and<\/p>\n
     administrative power vested in them.         The impugned<\/p>\n
     action offends Article 14 of the Constitution of India, being<\/p>\n
     ex facie arbitrary.\n<\/p>\n
           17.    Ext.P1 is liable to be quashed for reasons<\/p>\n
     stated above. It is essential in the interest of justice to<\/p>\n
     direct respondents 1 & 3 by the issuance of a writ of<\/p>\n
     mandamus to reinstate the petitioner forthwith. I do so.<\/p>\n
     The period during, which the petitioner was kept out of<\/p>\n
     service shall be regularised in accordance with law.”<\/p>\n
     7.    In the light of the findings in Ext.P2 judgment,<\/p>\n
which has become final, the respondents cannot contend<\/p>\n
that they have any discretion in the matter of regularizing<\/p>\n
the   period     during    which     the   petitioner     was    under<\/p>\n

suspension. In the light of the findings in Ext.P2 judgment,<\/p>\n
the disciplinary authority cannot take the stand that the<\/p>\n
order placing the petitioner under suspension was warranted<\/p>\n
or called for. This Court has in categorical terms held in<\/p>\n
Ext.P2 judgment that the action of the respondents in<\/p>\n
placing the petitioner under suspension is an abuse of the<\/p>\n
statutory and administrative power vested in them. Such<\/p>\n
being the situation, the respondents have no other<\/p>\n
alternative but to consider the period during which the<\/p>\n
petitioner was placed under suspension “as duty” for all<\/p>\n
purposes including salary and allowances and payment of<\/p>\n
terminal benefits.\n<\/p>\n
      8.   Ext.P2 judgment was delivered on 21\/12\/2006.<\/p>\n
Though no time limit was fixed therein for passing orders<\/p>\n
regarding regularization of the period of suspension, the<\/p>\n
disciplinary authority ought to have considered the same at<\/p>\n
least when it passed Ext.P9 order on 13\/08\/2008. In the<\/p>\n
light of the findings in Ext.P2 judgment, the respondents<\/p>\n

were not entitled to take further time to pass orders<\/p>\n
regarding regularization of the period of suspension. They<\/p>\n
ought to have taking note of the fact that the petitioner is<\/p>\n
not in service and had retired about seven months back<\/p>\n
complied     with   the  directions  in   Ext.P2    judgment,<\/p>\n
simultaneous with the passing of Ext.P9.<\/p>\n
      9.   For the reasons stated above, I hold that<\/p>\n
petitioner is entitled to payment of terminal benefits by<\/p>\n
treating the period during which he was placed under<\/p>\n
suspension by Ext.P1 order “as duty” for all purposes<\/p>\n
including payment of salary and allowances and payment of<\/p>\n
terminal benefits. The respondents shall within two months<\/p>\n
from the date of receipt of a copy of this judgment compute<\/p>\n
the terminal benefits payable to the petitioner on that basis,<\/p>\n
and disburse the same to him within a period of two months<\/p>\n
thereafter. The respondents shall also compute and pay the<\/p>\n
arrears of salary, which petitioner was entitled to during the<\/p>\n
period when he was under suspension. Payment of arrears<\/p>\n

of salary shall also be made within the said period.<\/p>\n
      10. It is clarified that if the above directions are not<\/p>\n
complied with and the terminal benefits are not paid to the<\/p>\n
petitioner within the aforesaid period of four months, the<\/p>\n
petitioner will be entitled to interest at the rate of 7.5% per<\/p>\n
annum from 01\/09\/2008 till the date of payment. It will be<\/p>\n
open to the Government to recover the interest portion from<\/p>\n
the officers responsible for the delay in complying with the<\/p>\n
directions issued herein.\n<\/p>\n<\/p>\n
