Learned advocate Mr. Soni for respondent nos. 3\/2 pointed out<br \/>\nthat the affidavit filed for having effected the Direct Service,<br \/>\ncontains incorrect statement.  Learned advocate Mr. AJ Patel for the<br \/>\npetitioner sought time to take instructions<br \/>\nin the matter.\n<\/p>\n<p>1.1\tLearned<br \/>\nadvocate for the petitioner files an Explanation pertaining to<br \/>\naffidavit of Direct Service of one Shri Ravi Joshi, Son of Shri<br \/>\nMukeshbhai Manubhai Joshi.\n<\/p>\n<p>1.3\tOn<br \/>\nperusal of the affidavit, the Court finds that there is no intention<br \/>\non the part of the person, who has filed affidavit, of making any<br \/>\nincorrect statement and whatever statements are made, they are made<br \/>\ninadvertently and therefore, the affidavit tendering Explanation by<br \/>\nsaid Shri Ravi Joshi, is accepted.\n<\/p>\n<p>2.0\tPursuant<br \/>\nto order dated 13th December 2010, learned advocate Mr.<br \/>\nSoni has, now, received the Vakalatnamas for respondent nos. 3\/1, 3\/4<br \/>\nand 3\/5.  Learned advocate Mr. Soni states that, either the said<br \/>\nVakalatnamas are filed or they are in the process of being filed.\n<\/p>\n<p>2.1\tSo<br \/>\nfar as respondent no. 3\/3 is concerned, learned advocate<br \/>\nMr. Soni<br \/>\nhas learnt from the other respondents that she died in the year 1995.<br \/>\n Learned advocate for the petitioner requests<br \/>\nMr. Soni to supply<br \/>\nthe details of the heirs of respondent no. 3\/3.\n<\/p>\n<p>2.2\tTo<br \/>\nenable the learned advocate Mr. Soni to collect the details and give<br \/>\nit to Mr. Patel, so that he can take appropriate action, the matter<br \/>\nis adjourned to 27th December 2010.\n<\/p>\n<p>[<br \/>\nRavi R.
