GOPINATHAN, JJ.\n                      = = = = = = = = = = = = = =\n                       D.B.A. NO. 9 OF 2009\n                      = = = = = = = = = = = = =\n\n          DATED THIS, THE 8TH DAY OF APRIL, 2010.\n\n                               O R D E R\n<\/pre>\n<p>Raman, J.\n<\/p>\n<\/p>\n<p>      The Ombudsman, in Report No. 107 of 2009 in DBA 9 of 2009,<\/p>\n<p>after due enquiry, has made certain suggestions with regard to the<\/p>\n<p>maintenance of elephants and the care to be taken thereto, which are as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>                   &#8220;On prayer No.1, it is suggested     that<br \/>\n           instead of forming a separate department, a<br \/>\n           seniormost Veterinary Officer can be given the<br \/>\n           charge of Manager for over all management of<br \/>\n           all elephants under the Devaswom Board. He<br \/>\n           can discharge his duties by implementing the<br \/>\n           suggestions of the Veterinary Officer to the<br \/>\n           extent possible.\n<\/p><\/blockquote>\n<blockquote><p>                  ii).  With regard to prayer No.ii, it is<br \/>\n           stated that application is already made for<br \/>\n           ownership certificate to the Chief Conservator of<br \/>\n           Forests and it is pending.\n<\/p><\/blockquote>\n<blockquote><p>                 iii) With regard to prayer No. iii, daily<br \/>\n           maintenance is already raised to Rs. 250. The<br \/>\n           Veterinary Officer has suggested further increase<br \/>\n           up to Rs. 450\/-.     Appropriate orders may be<br \/>\n           passed by the Hon&#8217;ble High court.         In this<\/p>\n<p><span class=\"hidden_text\">DBA 9\/2009                            2<\/span><\/p>\n<p>            connection, it is noticed that the Devaswom Board<br \/>\n            has vast extent of land within the temple<br \/>\n            compounds. Some of the temple compounds are<br \/>\n            having 8 acres and most of the lands are not at all<br \/>\n            put to any use.       In such compounds leaving<br \/>\n            sufficient space for all temple rituals and festivals<br \/>\n            still there will be lot of space for planting palm<br \/>\n            trees and fodder greens. The Devaswom Board<br \/>\n            may be directed to take steps to plant palm trees in<br \/>\n            such lands so that expenses to elephants can be<br \/>\n            reduced after a few years.\n<\/p><\/blockquote>\n<blockquote><p>                   vi. With regard to prayer No. iv, it is stated<br \/>\n            that there are two mahouts for each elephant<br \/>\n            already appointed.\n<\/p><\/blockquote>\n<blockquote><p>                   v).   With regard to prayer No.v. proper<br \/>\n            medical treatment is given and the Manager to be<br \/>\n            appointed can be directed to see it to that proper<br \/>\n            medical treatment is given to all the elephants.\n<\/p><\/blockquote>\n<blockquote><p>                   vi.   With regard to prayer No.vi, the<br \/>\n            suggestion of the Veterinary Officer may be<br \/>\n            accepted to rent out the Devaswom elephants<br \/>\n            based on a sealed tender system and making it a<br \/>\n            condition that the elephants will be transported<br \/>\n            only as per 2003 Rules.\n<\/p><\/blockquote>\n<blockquote><p>                   vii. Prayer No. vii may not be allowed.\n<\/p><\/blockquote>\n<blockquote><p>                   With regard to prayer No. viii, steps have<br \/>\n            already taken to cut the tusks of the elephants of<br \/>\n            the Board.&#8221;<\/p><\/blockquote>\n<p>      Pending further consideration, we direct the Chief Conservator of<\/p>\n<p>Forests to consider and pass appropriate orders on the application made by<\/p>\n<p><span class=\"hidden_text\">DBA 9\/2009                              3<\/span><\/p>\n<p>the Devaswom Board for ownership certificate. The maintenance amount<\/p>\n<p>for each elephant be increased to Rs. 450\/-.         Appropriate sanction be<\/p>\n<p>accorded for increasing the amount alloted for green fodder to Rs. 450\/- and<\/p>\n<p>the amount be expended subject to supervision by the officer concerned to<\/p>\n<p>ensure that the fund is utilized for the purpose for which it is allotted.<\/p>\n<p>      Remaining suggestions deferred for consideration.<\/p>\n<p>                                                                  sd\/-\n<\/p>\n<p>                                                      P.R.
