The
\n\tpetitioners by this petition have challenged the  action on the
\n\tpart of the  respondent Bank seeking to take physical possession of
\n\tthe  residential premises under the Securitisation &
\n\tReconstruction of Financial Assets & Enforcement of Security
\n\tInterest Act (hereinafter referred to as  Securitisation Act ),
\n\tdespite the  petitioners are ready and willing to pay the
\n\toutstanding dues of Rs.5.51 Lakhs as mentioned in the  notice.\n<\/p>\n
Heard
\n\tMr. Rachh for the  petitioners and Mr.Samal for the  respondent
\n\tBank.\n<\/p>\n
It
\n\tappears that the  principal grievance on the  part of the
\n\tpetitioners is that the  petitioners were ready and willing to pay
\n\tall the  outstanding dues of the  Bank as per the  notice under the
\n\tSecuritisation Act. In spite of the  same, the  Bank contemplated to
\n\texercise the  power for taking possession and therefore, the
\n\tpresent petition.\n<\/p>\n
This
\n\tCourt when considered the  matter at the initial stage on
\n\t27.03.2009, following order was passed –\n<\/p>\n
 Heard
\nlearned advocate Mr.Rachh for the petitioners.  The learned advocate
\ninvited attention of the Court to Annexure ‘E’, Page 53,
\ncommunication dated 23.03.2009 addressed by the petitioners to the
\nManager, Central Bank of India, Main Branch, Jamnagar.  The learned
\nadvocate submitted that the petitioners are ready to deposit a sum of
\nRs.3,00,000\/- by Demand Draft either with the Bank or before this
\nCourt by 30th
\nMarch 2009.  The petitioners shall deposit a sum of Rs.3,00,000\/-
\n(Rupees three lacs only) on or before 30th
\nMarch 2009.\n<\/p>\n
2.\t Notice
\nreturnable on 31st
\nMarch 2009. In the meantime, the respondents are directed to maintain
\nstatus quo as on today qua possession of the property in question.
\nDirect service is permitted today <\/p>\n
Thereafter,
\n\tthe  amount of Rs.3 Lakhs has been deposited. Further, when the
\n\tCourt considered the  matter on 30.06.2009, following order was
\n\tpassed.\n<\/p>\n
\t 1\tHeard
\nlearned counsels for the parties.\n<\/p>\n
 2\tLearned
\ncounsel for the petitioners submits that, apart from deposit of Rs.3
\nlakhs with the Registry of this Court on 31.3.2009, further amount of
\nRs.1,75,000\/- to be deposited by the petitioners with  the Registry
\nof this Court.\n<\/p>\n
3\tLearned
\ncounsel for the respondent- Central Bank of India submits that, even
\nafter depositing the above-mentioned amount, there still remains
\noutstanding amount to be paid.\n<\/p>\n
4\tConsidering
\nthe peculiar facts and circumstances of the case, the following
\ndirections are issued:\n<\/p>\n
[a]\tThe
\npetitioner shall deposit Rs.1,75,000\/-  with the Registry of this
\nCourt;\n<\/p>\n
[b]\tThe
\nAuthorized Officer of  the respondent- Central Bank of India shall
\nsubmit an application with endorsement of the learned counsel for the
\npetitioners for withdrawal of the entire amount deposited with the
\nRegistry of this  Court by the petitioners.\n<\/p>\n
[c]\tOn
\nreceipt of such application, the Registry of this Court is directed
\nto release the entire amount deposited by the petitioners in favour
\nof   the respondent- Central Bank of India by way of account payee
\ncheque;\n<\/p>\n
[d]\tIn
\nthe meanwhile, the petitioners shall make all endeavours to dispose
\nof the hypothecated goods for which the respondent-Bank shall not
\nraise any objection.\n<\/p>\n
Accordingly,
\n\tthe  further amount of Rs.1.75 Lakhs is also deposited by the
\n\tpetitioners. It appears that thereafter, the  vide order dated
\n\t14.09.2009, the  petitioners had to deposit the proceeds of the
\n\tgoods which were hypothecated with the  Bank and as stated by the
\n\tlearned counsel for the  petitioners, the  said amount of
\n\tRs.22,000\/- has been deposited, for which, Mr. Samal states that the
\n\t said aspect is yet to be verified by him.\n<\/p>\n
In
\n\tview of the  aforesaid, so far as the  value of the  goods
\n\thypothecated is concerned, in any case, the  petitioners would be
\n\trequired to deposit the  said amount and the  Bank will be entitled
\n\tto appropriate the  same.\n<\/p>\n
As
\n\tregards the other outstanding amount and the  house property which
\n\tis mortgaged with the  Bank, it was submitted by the  learned
\n\tcounsel for the  petitioners that the  petitioners have deposited
\n\tRs.4.75 Lakhs and further, if some reasonable time of three months
\n\tis granted, the  petitioners are also ready to deposit
\n\tRs.6,58,057\/-, as per the  valuation made by the  valuer of the
\n\tBank and it was submitted that the  Bank would get the  full value
\n\tof the  house. Thereafter, the  said property may be released from
\n\tthe  charge of the  Bank and the  loan account may be settled by the
\n\t Bank.\n<\/p>\n
Whereas,
\n\ton behalf of the  respondent Bank, it was submitted by Mr.Samal that
\n\tas per his instruction, the  Bank may consider the proposal if the
\n\tpetitioners are desirous to pay Rs. 7.5 Lakhs including the  amount
\n\talready deposited pending the  petition minus the  value of the
\n\tgoods hypothecated and he also submitted that if the  said amount in
\n\tany case is Rs.7 Lakhs, then he would request his client to consider
\n\tthe proposal.\n<\/p>\n
In
\n\tview of the  aforesaid, it appears that the Bank is having the
\n\tsecurity interest over the house for which, as per the  petitioners,
\n\tthe  value is 4.75 Lakhs. Whereas, as per the  Bank, the  value
\n\tassessed is of Rs.6.58 Lakhs. The  petitioners have shown desire to
\n\tpay the  full price, whereas the  insistence on the  part of he
\n\tBank is that it should be minimum Rs.7.5 Lakhs.\n<\/p>\n
Under
\n\tthese circumstances, if the  petitioners are desirous to submit the
\n\tproposal for such purpose, the  petitioners may do so within a
\n\tperiod of 15 days from today and the  Bank may in its banking wisdom
\n\tconsider the  proposal for settling the  account of the petitioners
\n\tand release of the  property as may be permissible in law as per the
\n\t prevailing policy of the  Bank. However, in the  event the Bank is
\n\tnot desirous to accept the  proposal and is desirous to proceed for
\n\tsale of the property, then in that case the  amount already
\n\tdeposited by the  Bank pending the  petition would be required to be
\n\trefunded by the  Bank except the amount of the  sale proceeds of the
\n\thypothecated goods which is of Rs.22,000\/-. It is only thereafter,
\n\tthe  Bank will be at the liberty to realise the  amount of the
\n\toutstanding loan amount in accordance with law and may be under the
\n\tSecuritisation Act, if permissible in law.\n<\/p>\n
In
\n\tview of the  aforesaid, the  following directions are issued –\n<\/p>\n
The
\n\tpetitioners if desirous, may submit the proposal within 15 days from
\n\ttoday to the  Bank.\n<\/p>\n
The
\n\t Bank shall consider the same in its banking wisdom in light of the
\n\tobservations made in the present order and shall take appropriate
\n\tdecision within a period  of one month from the  receipt of such
\n\trepresentation and the  decision shall be communicated to the
\n\tpetitioners.\n<\/p>\n
In
\n\tthe  event the  Bank is not desirous to accept the  proposal, the
\n\tBank will have to abide by the observations made in the  present
\n\torder for refund of the  amount and thereafter only the  Bank will
\n\tbe at the  liberty to take action against the property in question
\n\tin accordance with law under the  Securitisation Act and at that
\n\tstage, the rights and contentions of both the  sides shall remain
\n\topen.\n<\/p>\n
Until
\n\tthe  aforesaid, no further coercive steps shall be taken by the
\n\tBank.\n<\/p>\n
It
\n\tis also observed that if the  petitioners fail to make any
\n\trepresentation to the  Bank, they would not be entitled for
\n\tprotection of the  present order.\n<\/p>\n
Petition
\n\tis disposed of in terms of the aforesaid directions. No order as to
\n\tcosts.\n<\/p>\n
