INDAL BIND, SON OF BAJARANGI BIND\n                                             Versus\n                                   THE STATE OF BIHAR\n                                           -----------\n<\/pre>\n<p>2.   06.08.2010               Heard learned counsel for the petitioners and the<\/p>\n<p>                   State.\n<\/p>\n<p>                              The petitioners seek bail in a case instituted for the<\/p>\n<p>                   offence under Section 3 R.P. (U.P.) Act.\n<\/p>\n<p>                              Considering that the petitioners are in custody since<\/p>\n<p>                   9.5.2010 and they have never been implicated in any other of<\/p>\n<p>                   similar nature of case, let the petitioners above named, be<\/p>\n<p>                   released on bail on furnishing bail bond of Rs. 5,000\/- (Five<\/p>\n<p>                   thousand) each with two sureties of the like amount each to the<\/p>\n<p>                   satisfaction of Railway Judicial Magistrate, Gaya, in Sasaram<\/p>\n<p>                   R.P.F. Case No. 11 of 2010 subject to the following conditions:<\/p>\n<p>                   (i)That one of the bailors will be a close relative of the petitioner<\/p>\n<p>                   who will give an affidavit giving genealogy as to how he is<\/p>\n<p>                   related with the petitioners and the other shall be the<\/p>\n<p>                   father\/brother\/mother    of   the   petitioners.   The   bailor   will<\/p>\n<p>                   undertake to furnish information to the Court about any change<\/p>\n<p>                   in address of the petitioners. (ii)That the bailor shall also state<\/p>\n<p>                   on affidavit that he will inform the court concerned if the<\/p>\n<p>                   petitioners are implicated in any other case of similar nature<\/p>\n<p>                   after their release in the present case and thereafter the court<\/p>\n<p>                   below will be at liberty to initiate the proceeding for cancellation<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        of bail on the ground of misuse. (iii)That the petitioners will give<\/p>\n<p>        an undertaking that they will receive the police papers on the<\/p>\n<p>        given date and be present on date fixed for charge and if they<\/p>\n<p>        fail to do so on two given dates and delay the trial in any<\/p>\n<p>        manner, their bail will be liable to be cancelled for reasons of<\/p>\n<p>        misuse.
