Court, Vadodara in E.S.I. Applications No. 29\/2003,<br \/>\n32\/2003, 34\/2003, 36\/2003, 37\/2003, 40\/2003 and 42\/2003 dated<br \/>\n16.11.2006 whereby, the said applications were allowed.\n<\/p>\n<p>2.0\t\tThe<br \/>\nfacts in brief are that the opponents, original applicants, had filed<br \/>\nindividual applications before the E.S.I. Court, Vadodara claiming<br \/>\ndependency benefits on the ground that their deceased husbands had<br \/>\nexpired as they were suffering from a disease called Silicosis<br \/>\nwhich was caused during the course of employment.\n<\/p>\n<p>2.1\t\tOn<br \/>\ncompletion of the pleadings and after hearing the parties, the E.S.I.<br \/>\nCourt allowed the applications preferred by the opponents. Hence,<br \/>\nthese appeals.\n<\/p>\n<p>3.0\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. The main contention raised before this Court is that the<br \/>\napplications preferred before the E.S.I. Court were barred by<br \/>\nlimitation and that the Court below ought not to have entertained the<br \/>\nsame. It is also contented that the said aspect of limitation is a<br \/>\npure question of law and deserves to be adjudicated with in view of<br \/>\nthe provisions of the E.S.I. Act, 1948.\n<\/p>\n<p>4.0\t\tHaving<br \/>\ngone through the impugned orders, I am of the opinion that the<br \/>\ncontention regarding limitation shall not hold any ground as the same<br \/>\nwas not raised before the Court below at the relevant point of time.<br \/>\nThe said contention has been raised for the first time only before<br \/>\nthis Court in these Appeals, which is not permissible. In my view,<br \/>\nthe question of limitation is a mixed question of law and facts.<br \/>\nMoreover, as no issue was framed before the Court below regarding the<br \/>\nsaid aspect, it could not be permitted to be canvassed in these<br \/>\nappeals.\n<\/p>\n<p>5.0\t\tConsidering<br \/>\nthe facts of the case and keeping in mind the object and reasons of<br \/>\nthe E.S.I. Act, 1948, these appeals do not deserve to be entertained.<br \/>\nNo substantial questions of law have been raised in these appeals<br \/>\nwithin the meaning of Section 100 of the Civil Procedure Code.\n<\/p>\n<p>6.0\t\tFor<br \/>\nthe foregoing reasons, the Appeals stand dismissed.
