No. 1855 of 2009\n               ==================\n          Dated this the 16th day of June, 2009.\n\n                          O R D E R\n<\/pre>\n<p>     Petitioners are accused 1 and 2 in C.C.No.213\/2008 on<\/p>\n<p>the file of Chief Judicial Magistrate Court, Kalpetta, taken<\/p>\n<p>cognizance by the Magistrate on Annexure III complaint<\/p>\n<p>filed by the Sheristadar of Sessions Court, Wayanad<\/p>\n<p>pursuant to the directions given by the learned Sessions<\/p>\n<p>Judge in Annexure I order in a petition filed by first<\/p>\n<p>respondent. This petition is filed under Section 482 of Code<\/p>\n<p>of Criminal Procedure to quash Annexure III complaint as<\/p>\n<p>well as the cognizance taken pursuant to Annexure I order.<\/p>\n<p>     2.   Learned Counsel appearing for the petitioners<\/p>\n<p>was heard.\n<\/p>\n<p>     3.   The argument of the learned Counsel is that in<\/p>\n<p>Annexure I order, learned Sessions Judge wrongly found<\/p>\n<p>that petitioners committed offences under Sections 191,<\/p>\n<p>192 and 193 of Indian Penal Code without even granting an<\/p>\n<p>Crl.M.C.No.1855\/2009<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>opportunity to the petitioners to be heard and though the<\/p>\n<p>order is purported to be passed under Section 340 of Code<\/p>\n<p>of Criminal Procedure, there is no finding that permission is<\/p>\n<p>to be granted to prosecute the petitioners as it is expedient<\/p>\n<p>in the interest of justice and therefore Annexure I order is<\/p>\n<p>illegal.    Learned Counsel also argued that there is no<\/p>\n<p>material before the Sessions Court to find that the<\/p>\n<p>certificate issued by second petitioner, after examination of<\/p>\n<p>first respondent to the first petitioner, which was produced<\/p>\n<p>by first petitioner in the bail application filed before the<\/p>\n<p>Sessions Court is a forged document and based on the<\/p>\n<p>evidence of another doctor, who claims to have treated the<\/p>\n<p>first respondent, Sessions Judge should not have found that<\/p>\n<p>petitioners falsely created the medical certificate issued by<\/p>\n<p>second petitioner to the effect that first respondent was<\/p>\n<p>pregnant prior to her marriage with first petitioner.<\/p>\n<p>Learned      Counsel  therefore   argued   that  the   entire<\/p>\n<p>proceedings is to be quashed.\n<\/p>\n<p>Crl.M.C.No.1855\/2009<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>      4.    Though the learned Sessions Judge conducted an<\/p>\n<p>enquiry under Section 340 of Code of Criminal Procedure<\/p>\n<p>and under Annexure I order directed lodging a complaint<\/p>\n<p>before the Magistrate for offences under Sections 191, 192<\/p>\n<p>and 193 of Indian Penal Code, when there is no case for the<\/p>\n<p>first respondent before the Sessions Court in Crl.M.P.No.<\/p>\n<p>1458\/2008, or for the Sessions Court that the certificate<\/p>\n<p>produced before the Court was tampered from court<\/p>\n<p>subsequent to its production, Section 340 of Code of<\/p>\n<p>Criminal Procedure does not apply. The offence alleged in<\/p>\n<p>Annexure III complaint is not in relation to a document<\/p>\n<p>during the time when the document was in custodia legis.<\/p>\n<p>Then only action as required under Section 340 of Code of<\/p>\n<p>Criminal Procedure is required as expedient in the interest<\/p>\n<p>of justice. This is a case where first petitioner obtained a<\/p>\n<p>false certificate allegedly prepared by second petitioner and<\/p>\n<p>produced it before the Court. There is no allegation that<\/p>\n<p>anything was done to the certificate produced before the<\/p>\n<p>Crl.M.C.No.1855\/2009<br \/>\n<span class=\"hidden_text\">                              -4-<\/span><\/p>\n<p>court subsequent to its production when it was in the<\/p>\n<p>custody of the court. In such circumstances, Annexure III<\/p>\n<p>complaint cannot be challenged for the reason that the<\/p>\n<p>procedure provided under Section 340 of Code of Criminal<\/p>\n<p>Procedure was not complied with.\n<\/p>\n<p>      5.    Then the question is when the Sessions Judge is<\/p>\n<p>prima facie satisfied that the certificate produced before the<\/p>\n<p>court by first petitioner and issued by second petitioner is a<\/p>\n<p>false document, Sessions Judge is competent to direct<\/p>\n<p>prosecution of petitioners for an offence under Section 193<\/p>\n<p>of Indian Penal Code. The Sessions Judge is competent to<\/p>\n<p>direct action when it is prima facie found that offence is<\/p>\n<p>committed. If so the complaint or the proceeding initiated<\/p>\n<p>cannot be quashed as sought for. In such circumstances,<\/p>\n<p>the question whether the certificate issued by the second<\/p>\n<p>petitioner that the first respondent was pregnant even<\/p>\n<p>before her marriage with first petitioner is a false document<\/p>\n<p>or not is to be decided by the Chief Judicial Magistrate, on<\/p>\n<p>Crl.M.C.No.1855\/2009<br \/>\n<span class=\"hidden_text\">                             -5-<\/span><\/p>\n<p>the evidence to be let in and untramelled by whatever is<\/p>\n<p>stated in Annexure III. In any case, this is not a case where<\/p>\n<p>the extraordinary jurisdiction of this Court is to be<\/p>\n<p>exercised as sought for by the petitioners. Petitioners are<\/p>\n<p>entitled to claim discharge under Section 239 of Code of<\/p>\n<p>Criminal Procedure, if charge is not framed.
