Respondents\n\n\n        Petition under Article 226 of the Constitution of  India  praying  for\nthe issue of a writ of Mandamus as stated therein.\n\nFor Petitioner         :       Miss.K.Suguna\n\nFor Respondents        :\n                R1      :       Mr.Robin Raj\n                                for Mr.Peppin Fernando\n        RR 2 &amp; 3        :       Mr.Mahimai Raj\n                                Government Advocate\n\n\n:O R D E R\n<\/pre>\n<p>        The  writ petitioner is an unfortunate teacher, who has been a prey of<br \/>\nthe vagaries of the school management.  She was appointed for the  first  time<br \/>\nin the  year  1971  as  a  Higher Grade teacher.  She became a Secondary Grade<br \/>\nAssistant in 1973.  Thereafter, she was elevated  as  a  Headmistress  of  the<br \/>\nprimary  school  in the year 1976 and she continued to be so till 1.7.1987, on<br \/>\nwhich date she was re-posted as a Secondary Grade Assistant.   The  status  of<br \/>\nthe headmistress of the primary school and the Secondary Grade Assistant, till<br \/>\nthen, was  equal.    However,  since  she  was  re-posted as a Secondary Grade<br \/>\nAssistant, she filed an appeal on 3.7.1987.   Perhaps,  as  a  result  of  the<br \/>\nappeal, she was posted back on 27.10.1989 by the school management.  The order<br \/>\ndated 27 .10.1989 specifically uses the word &#8220;reinstatement&#8221;.  It is suggested<br \/>\nin that order, which is signed by the Correspondent, M.D.Elementary and Middle<br \/>\nSchool,  Ranipet  Circle,  that  Mrs.T.Sarojini,  who  was  &#8221;  reverted&#8221;  from<br \/>\nHeadmistress in 1987 and  now  working  as  Assistant  in  the  M.D.Elementary<br \/>\nSchool,  Marikuppam is &#8220;reinstated&#8221; as Headmistress in the same school and the<br \/>\npresent Headmaster  Mr.Manoharan,  being  the  junior  most,  is  reverted  as<br \/>\nAssistant  for  work of vacancy posted in the same school, where he is working<br \/>\nnow.  This was not objected to either by  Mr.Manoharan  or  by  the  Education<br \/>\nDepartment  and  the  petitioner  continued  to  serve  in the capacity of the<br \/>\nHeadmistress upto 11.12.1992.  It is to  be  noted  that  from  1.6.1988,  the<br \/>\nHeadmistress post became a promotional post and earned better salary.  Be that<br \/>\nas it may.\n<\/p>\n<p>        2.  While the petitioner kept on working, she was slapped with another<br \/>\norder dated 11.12.1992, wherein she was directed to be reverted to the post of<br \/>\nAssistant in  the  same  school.   A glance at this order would show that this<br \/>\norder was passed in pursuance  of  the  orders  of  the  District  Educational<br \/>\nOfficer dated  17.9.1992  bearing  No.3790\/A2\/92.    There  appears  to  be  a<br \/>\nreference to another order also purported to have been passed by the Assistant<br \/>\nEducational Officer dated 28.9.1992 bearing  R.C.No.305\/A2\/92.    Perhaps,  in<br \/>\npursuance  of these two orders, the management again switched the positions of<br \/>\nManoharan vis-a-vis the petitioner.  The petitioner filed  an  appeal  to  the<br \/>\nDirector  because  obviously and admittedly Mr.Manoharan was junior to her and<br \/>\nshe could not have thrown out from her  position  as  a  Headmistress.    That<br \/>\nappeal,  perhaps,  prevailed  and  the  Management again passed an order dated<br \/>\n1.10.1994 again promoting her as Headmistress.  This time, the Management took<br \/>\nadequate care to see that the order would take effect only from 1.10.1994.\n<\/p>\n<p>        3.  The petitioner has now come before us and has asked  for  fixation<br \/>\nof her  salary  in  the  scale  of  a  Headmistress.    More particularly, the<br \/>\npetitioner&#8217;s prayer is that her salary for the period  between  1.7.19  87  to<br \/>\n5.11.1989  and  15.12.1992  to  13.9.1994  should  be  paid  to  her  with all<br \/>\nconsequential benefits as she has obviously retired in the meantime.\n<\/p>\n<p>        4.  Miss.Suguna, learned counsel appearing for the  petitioner  points<br \/>\nout  that  if  it  was  an  admitted position that the petitioner was a senior<br \/>\nperson and Manoharan was the junior most person and if this  was  acknowledged<br \/>\nand  the  petitioner was reinstated on 27.10.1989, it would only mean that she<br \/>\ncontinued to be in the post of a Headmistress right from 1.7.1987 and as such,<br \/>\nshe would be entitled to the salary in that post.   She  further  pointed  out<br \/>\nthat even after she continued to work up to 11.12.1992, she has been, perhaps,<br \/>\nat the behest of some officers in the Education Department, again reverted for<br \/>\nno fault of her, and she then continued to serve in the reverted capacity upto<br \/>\n1.1 0.1994.    She points out that this reversion has no basis whatsoever and,<br \/>\ntherefore, she was liable  to  be  paid  the  salary  in  her  capacity  as  a<br \/>\nHeadmistress between the period 11.12.1992 till 1.10.1994 and further, because<br \/>\nshe was  admittedly  appointed as Headmistress again on 1 .10.1994.  There can<br \/>\nbe no doubt that the petitioner was much more senior  to  Manoharan,  who  was<br \/>\nadmittedly the  junior  most  person.    There  can  also be no doubt that the<br \/>\npetitioner was actually working and has been reverted at the vagaries  of  the<br \/>\nschool  management,  without holding any enquiry or without finding her guilty<br \/>\nof any misconduct.  Therefore, it must be deemed that the petitioner continued<br \/>\nto be the Headmistress right from 3.7.1987 upto 1.10.1994 and that  she  would<br \/>\nbe entitled to that salary.\n<\/p>\n<p>        5.   The  learned  Government  Advocate  could  not support the orders<br \/>\nallegedly passed by the District Educational Officer on 17.9.1992  or  by  the<br \/>\nAssistant  Educational  Officer on 28.9.1992 and could not justify as to under<br \/>\nwhat circumstances these orders came to  be  passed  and  why.    The  learned<br \/>\nGovernment Advocate  drew  complete  blank  in  this behalf.  When the learned<br \/>\ncounsel for the Management was specifically asked, he could not get out of the<br \/>\nposition that Mr.  Manoharan was a junior most person.  There is  a  seniority<br \/>\nlist  at  page  7  of  the  typed set, which also shows that the petitioner is<br \/>\nsenior, she being at Serial number 19.   Though  Mr.J.Manoharan  is  shown  at<br \/>\nserial number 18, it is really not understood, because obviously he has joined<br \/>\nas  a  secondary grade teacher on 1.10.1973, whereas the petitioner has joined<br \/>\non 1.10 .1971.  That apart, there is an order passed by the Management  itself<br \/>\ndated 27.10.1989, where Mr.Manoharan is shown as the junior most person and he<br \/>\nis also  reverted.   Therefore, there cannot be any difficulty in holding that<br \/>\nthe petitioner was senior to Mr.Manoharan.\n<\/p>\n<p>        6.  Be that as it may.  We are  not  concerned  with  the  dispute  of<br \/>\nseniority in  this writ petition.  Once the petitioner was serving properly in<br \/>\nthe post of headmistress and once she was liable to be continued there,  there<br \/>\nwas no point in reverting her without any justification or without holding any<br \/>\nenquiry against her.\n<\/p>\n<p>        7.  Under such circumstances, it must be held that she would be deemed<br \/>\nto  have  continued as a headmistress all through and she would be entitled to<br \/>\nthe salary.  She shall be accordingly granted the salary in between the period<br \/>\nof 1.7.1987 to 1.10.1994 and her pension shall be fixed and calculated  as  if<br \/>\nshe was never reverted and she continued to be working as a headmistress. The<br \/>\nsalary shall  be  payable  by the management.  But, if the management fails to<br \/>\npay the salary within two months from today, the salary shall  be  payable  by<br \/>\nthe  Government,  whose  officers have passed the concerned orders, within two<br \/>\nmonths thereafter.  The Government shall, however, be entitled to recover  the<br \/>\nsalary from  the  non-salary  grants  of the school, if necessary.
