M. SAHAI)<\/a><\/p>\n<p>1.\tWe have<br \/>\nheard learned counsel Mr. Manav A. Mehta for the appellant and<br \/>\nlearned Assistant Government Pleader Ms. Jirga Jhaveri for the<br \/>\nrespondent.\n<\/p>\n<p>2.\tThe<br \/>\nlearned Single Judge has decided in favour of the petitioner and set<br \/>\naside the order of compulsory retirement and modified the punishment.<br \/>\nAppeal against such an order is not maintainable as the appellant is<br \/>\nnot an aggrieved person.  No appeal lies against the finding or<br \/>\npunishment which was modified in favour of the petitioner.
