{"id":124396,"date":"2010-05-04T00:00:00","date_gmt":"2010-05-03T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/yogesh-kumar-vs-rishikul-bramhacharya-ashram-on-4-may-2010"},"modified":"2018-02-06T20:22:30","modified_gmt":"2018-02-06T14:52:30","slug":"yogesh-kumar-vs-rishikul-bramhacharya-ashram-on-4-may-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/yogesh-kumar-vs-rishikul-bramhacharya-ashram-on-4-may-2010","title":{"rendered":"Yogesh Kumar vs Rishikul Bramhacharya Ashram &#8230; on 4 May, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Yogesh Kumar vs Rishikul Bramhacharya Ashram &#8230; on 4 May, 2010<\/div>\n<pre>                                W.P.\u00a0No.\u00a03989\/2010\n       4.5.2010\n              Shri\u00a0K.S.\u00a0Rajput,\u00a0counsel\u00a0for\u00a0the\u00a0petitioners.\n              This \u00a0 petition \u00a0 is \u00a0 directed \u00a0 against \u00a0 the \u00a0 order \u00a0 dated\u00a0\n       23.1.2009\u00a0by\u00a0the\u00a0Additional\u00a0Judge\u00a0to\u00a0the\u00a0Court\u00a0of\u00a0First\u00a0Civil\u00a0\n       Judge,\u00a0Class\u00adI,\u00a0Hoshangabad\u00a0by\u00a0which\u00a0an\u00a0application\u00a0filed\u00a0by\u00a0\n       the\u00a0plaintiff\u00a0under\u00a0Order\u00a06\u00a0Rule\u00a017\u00a0of\u00a0the\u00a0C.P.C.,\u00a0was\u00a0allowed.\n              Learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 petitioners \u00a0 submitted \u00a0 that \u00a0 by\u00a0\n       allowing \u00a0 the \u00a0 application, \u00a0 the \u00a0 respondents \u00a0 have \u00a0 changed \u00a0 the\u00a0<\/pre>\n<p>       entire\u00a0nature\u00a0of\u00a0suit,\u00a0the\u00a0application\u00a0ought\u00a0not\u00a0to\u00a0have\u00a0been\u00a0<br \/>\n       allowed.\n<\/p>\n<p>              From\u00a0perusal\u00a0of\u00a0the\u00a0application\u00a0filed\u00a0by\u00a0the\u00a0respondents\u00a0<br \/>\n       and \u00a0 the \u00a0 impugned \u00a0 order, \u00a0 we \u00a0 find \u00a0 that \u00a0 more \u00a0 or \u00a0 less \u00a0 the\u00a0<br \/>\n       amendment\u00a0application\u00a0was\u00a0filed\u00a0to\u00a0correct\u00a0the\u00a0description\u00a0of\u00a0<br \/>\n       the\u00a0two\u00a0defendants\u00a0and\u00a0certain\u00a0other\u00a0corrections\u00a0were\u00a0sought\u00a0<br \/>\n       in\u00a0the\u00a0body\u00a0of\u00a0the\u00a0plaint.\u00a0By\u00a0the\u00a0aforesaid\u00a0amendment,\u00a0nature\u00a0<br \/>\n       of\u00a0the\u00a0suit\u00a0is\u00a0not\u00a0change\u00a0but,\u00a0on\u00a0the\u00a0contrary\u00a0the\u00a0defects\u00a0in\u00a0the\u00a0<br \/>\n       suit\u00a0have\u00a0been\u00a0cured.\u00a0The\u00a0earlier\u00a0mistakes\u00a0were\u00a0rectified\u00a0by\u00a0the\u00a0<br \/>\n       plaintiff.\n<\/p>\n<p>              In\u00a0view\u00a0of\u00a0the\u00a0aforesaid,\u00a0no\u00a0error\u00a0of\u00a0jurisdiction\u00a0is\u00a0found\u00a0<br \/>\n       in \u00a0 the \u00a0 impugned \u00a0 order \u00a0 warranting \u00a0 our \u00a0 interference \u00a0 under\u00a0<br \/>\n       Articles\u00a0226\u00a0and\u00a0227\u00a0of\u00a0the\u00a0Constitution\u00a0of\u00a0India.\n<\/p>\n<p>              This \u00a0 petition \u00a0 is \u00a0 found \u00a0 without \u00a0 merit \u00a0 and \u00a0 is \u00a0 dismissed\u00a0<br \/>\n       with\u00a0no\u00a0orders\u00a0as\u00a0to\u00a0costs.\n<\/p>\n<pre>              (K.K.\u00a0Lahoti)                                (G.S.\u00a0Solanki)\n              \u00a0\u00a0\u00a0\u00a0JUDGE                                    \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0JUDGE\nravi\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Yogesh Kumar vs Rishikul Bramhacharya Ashram &#8230; on 4 May, 2010 W.P.\u00a0No.\u00a03989\/2010 4.5.2010 Shri\u00a0K.S.\u00a0Rajput,\u00a0counsel\u00a0for\u00a0the\u00a0petitioners.
