No.12685 of 2008\n                      SURENDRA PRASAD\n                           Versus\n                       STATE OF BIHAR\n                        -----------\n<\/pre>\n<p>03   9.7.2008                   Petitioner       apprehends        his    arrest<\/p>\n<p>                in Rajgir P.S. case No. 52 of 2007 registered<\/p>\n<p>                under    Section     409   and     420\/34    of    the    Indian<\/p>\n<p>                Penal Code and prays for grant of anticipatory<\/p>\n<p>                bail.\n<\/p>\n<pre>                                Mr.     Amish      Kumar,     appearing        on\n\n                behalf    of   the    petitioner         submits     that     the\n\n<\/pre>\n<p>                learned Sessions Judge on its own finding ought<\/p>\n<p>                to    have     acceded      to     the      prayer       of   the<\/p>\n<p>                petitioner. He points out that while rejecting<\/p>\n<p>                the prayer of bail the learned Sessions Judge<\/p>\n<p>                has observed that &#8221; not handing over                 charge of<\/p>\n<p>                the amount has been made against the accused<\/p>\n<p>                Surendra Paswan and from para 56 and 52 of the<\/p>\n<p>                case diary, it transpires that Surendra Paswan<\/p>\n<p>                has not made over charge of the amount.&#8221;<\/p>\n<p>                               Mr. Bhupesh Kumar,Additional Public<\/p>\n<p>                Prosecutor, appears on behalf of the State.<\/p>\n<p>                               Having      heard    learned       Counsel     for<\/p>\n<p>                the   party    and    taking     into    consideration        the<\/p>\n<p>                facts and circumstances of the case, I allow<\/p>\n<p>                this application and direct that the petitioner<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>          abovenamed,          in        the     event        of        his<\/p>\n<p>          arrest\/surrender within four weeks, be released<\/p>\n<p>          on     bail    on     furnishing       personal     bond       of<\/p>\n<p>          Rs.10,000\/-(ten thousand) with two sureties of<\/p>\n<p>          the like amount each to the satisfaction of the<\/p>\n<p>          Chief Judicial Magistrate, Nalanda in Rajgir<\/p>\n<p>          P.S.    case    No.       52   of    2007,subject        to   the<\/p>\n<p>          conditions as laid down under Section 438(2) of<\/p>\n<p>          the Code of Criminal Procedure.<\/p>\n<p>                         Let a copy of this order be also<\/p>\n<p>          forwarded      to the District and Sessions Judge,<\/p>\n<p>          Nalanda.\n<\/p>\n<\/p>\n<p>                              (Chandramauli Kr.Prasad,J.)<\/p>\n<p>A.Kumar\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Surendra Prasad vs State Of Bihar on 9 July, 2008 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
