Justice V.GIRI\n\n Dated :29\/07\/2008\n\n O R D E R\n                          V.GIRI, J\n                        -------------------\n                     W.P.(C).6384\/2008\n                       --------------------\n            Dated this the 29th day of July, 2008\n\n                        JUDGMENT\n<\/pre>\n<p>      Petitioner was appointed as Police Constable in the<\/p>\n<p>year 1987. While working as ASI in the District Armed<\/p>\n<p>Reserve, he applied for appointment to the post of Sub<\/p>\n<p>Inspector of Police Trainee (General Executive) in the<\/p>\n<p>Kerala Police. He passed the written test and physical<\/p>\n<p>efficiency test and was included in the rank list, but was<\/p>\n<p>not appointed due to lack of vacancies.<\/p>\n<p>2.    Thereafter,    the PSC initiated proceedings for<\/p>\n<p>appointment to the post of Sub Inspector of Police Trainee,<\/p>\n<p>General Executive Branch.           Petitioner applied for the<\/p>\n<p>same. He was successful in the written test. But when the<\/p>\n<p>physical efficiency test was conducted, he could pass only<\/p>\n<p>four out of the total eight items. Petitioner then moved<\/p>\n<p>the Government by Ext.P2 representation seeking to<\/p>\n<p>invoke the powers of the Government under Rule 39 of<\/p>\n<p>Part-II of K.S. &amp; S.S.R. In Writ Petition No.2691\/2006<\/p>\n<p>filed by the petitioner praying for a direction         to the<\/p>\n<p>W.P.(C).6384\/2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>respondents to appoint the petitioner as Sub Inspector of<\/p>\n<p>Police Trainee (General Executive),     petitioner further<\/p>\n<p>pointed out that in a similar case involving one Sri. John,<\/p>\n<p>Government had invoked its power under Rule 39 and<\/p>\n<p>directed that he be appointed in spite of the fact that he<\/p>\n<p>had not passed the physical efficiency test. Government<\/p>\n<p>in Ext.P6      counter affidavit filed in   Writ Petition<\/p>\n<p>No.2691\/2006      took  the stand that John&#8217;s case was<\/p>\n<p>considered as a special case because he had been<\/p>\n<p>included in the rank list of Armed Police Sub Inspector<\/p>\n<p>(AP Battalion) and the physical fitness was such that<\/p>\n<p>he could pass the physical efficiency test for the post in<\/p>\n<p>question. The writ petition was ultimately disposed of<\/p>\n<p>directing the Government to consider the petitioner&#8217;s<\/p>\n<p>representation.     The matter was considered by the<\/p>\n<p>Government         and  this   led   to   Ext.P10   order.<\/p>\n<p>Government,       while   considering     the petitioner&#8217;s<\/p>\n<p>contention       that he has been subjected to hostile<\/p>\n<p>discrimination vis-a vis Sri.John, found that John was<\/p>\n<p>actually included in the rank list of APSI of Police ( AP<\/p>\n<p>W.P.(C).6384\/2008<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>Battalion) as he has passed the written test and five out<\/p>\n<p>of eight items in the physical efficiency test for the post<\/p>\n<p>of SI of Police (AP Battalion).        On this premise,<\/p>\n<p>petitioner&#8217;s claim came to be rejected. Ext.P10 order<\/p>\n<p>passed in this regard and subsequent order passed by<\/p>\n<p>the Government as Ext.P13, which was on application<\/p>\n<p>for review filed by the petitioner himself,     have been<\/p>\n<p>challenged in this writ petition.\n<\/p>\n<\/p>\n<p>3.    Counter affidavit has been filed     by the second<\/p>\n<p>respondent. Essentially it has been demonstrated in the<\/p>\n<p>counter affidavit that John was actually included in the<\/p>\n<p>list of SI of Police (AP Battalion) and therefore,   while<\/p>\n<p>invoking its power under Rule 39 in relation to John,<\/p>\n<p>Government had material on the basis of which it could<\/p>\n<p>justify its exercise of power.     Case of the petitioner<\/p>\n<p>stands on a different footing. Therefore, even in the<\/p>\n<p>context of invoking powers of the Government under<\/p>\n<p>Rule 39, petitioner cannot be legitimately plead a case<\/p>\n<p>of hostile discrimination.\n<\/p>\n<p>W.P.(C).6384\/2008<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>4.   There is force in the above submission made on<\/p>\n<p>behalf of the respondents. Apart from the above, this<\/p>\n<p>Court cannot compell the Government to necessarily<\/p>\n<p>invoke its power under     Rule 39 of Part-II of K.S. &amp;<\/p>\n<p>S.S.R.    In the circumstances, I do not find any error in<\/p>\n<p>the stand taken by the Government either in Exts.P10 or<\/p>\n<p>P13.
