The said property was jointly purchased by the<br \/>\noriginal plaintiffs and original defendants nos. 1 , 3 and 4.  Since<br \/>\nthe said property was agricultural land, NA permission was applied<br \/>\nfor and the competent authority in the month of July, 2009 granted<br \/>\nthe NA permission. Thereafter, on oral agreement the said land was<br \/>\ndivided amongst the original plaintiffs and original defendants nos.<br \/>\n1, 3 &amp; 4.  Original defendants no. 1 sold 1\/5th of his<br \/>\nshare to the appellant vide registered sale deed dated 02.08.2010.<br \/>\nOn the said plot, the appellant constructed fence and office premises<br \/>\nas per  the building regulations. The respondents-original plaintiffs<br \/>\npreferred suit being Special Civil Suit No. 672 of 2010 against the<br \/>\nappellant and original defendants nos. 1, 3 &amp; 4 praying<br \/>\nprohibitory injunction qua the suit property. In the said suit the<br \/>\nrespondents-original plaintiffs preferred application Exhibit-5. The<br \/>\ntrial Court vide order dated 08.02.2011 directed the parties to<br \/>\nmaintain status-quo qua the suit property. Hence, this appeal.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. After appreciating the evidence on record, the Court below<br \/>\nfound that the property in question was undivided property. Learned<br \/>\ncounsel for the appellant was not able to point out from the record<br \/>\nthat the said finding recorded by the Court below is erroneous. In<br \/>\nview of the above, the Court below has rightly not granted interim<br \/>\ninjunction. I am in complete agreement with the finding recorded by<br \/>\nthe Court below in the impugned order and hence, find no reasons to<br \/>\nentertain this appeal.\n<\/p>\n<p>4.\t\tIt<br \/>\nis however, observed that if  an application is preferred by the<br \/>\nappellant requesting the Court below to dispose of the suit<br \/>\nexpeditiously, the trial Court concerned shall consider the same and<br \/>\nshall try to dispose of the suit being Special Civil Suit No.672\/2010<br \/>\nas expeditiously as possible. It is clarified that while deciding the<br \/>\nsuit in question, the Court below shall not be influenced by the<br \/>\nobservations made by it in the impugned order dated 08.02.2011 passed<br \/>\nbelow application Exhibit-5 and shall decide the suit independently<br \/>\non its own merits.\n<\/p>\n<p>5.\t\tWith<br \/>\nthe above observations, the appeal as well as civil application stand<br \/>\ndisposed of.
