DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/11\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tMr. Kartik Pandya, learned APP, waives service of notice of Rule for<br \/>\n\trespondent &#8211; State.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I-77 of 2010 with Bhiloda Police Station,  for the offences<br \/>\n\tpunishable under Sections Sections 376, 323 and 506(2) of Indian<br \/>\n\tPenal Code.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tH.B. Champavat, learned advocate for the applicant submits that<br \/>\n\talleged incident took place out of love affair and there was consent<br \/>\n\tof the prosecutorix.  It is further submitted that even statement of<br \/>\n\tthe victim and other attending circumstances would go to show that<br \/>\n\tthe applicant is falsely implicated for the offences alleged and by<br \/>\n\timposing suitable conditions the applicant be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tMr. Kartik Pandya, learned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and looking to the fact that, I am inclined to enlarge the<br \/>\n\tapplicant on bail.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicants are ordered to be released on bail in connection<br \/>\n\twith first information report registered at CR No.I-77 of 2010 with<br \/>\n\tBhiloda Police Station, on executing bond of Rs.10,000\/- (Rupees Ten<br \/>\n\tThousand only) each with one surety of the like amount to the<br \/>\n\tsatisfaction of the trial Court and subject to the conditions that<br \/>\n\tthey shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\ttheir passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\ttheir presence at the concerned police station on the first Sunday<br \/>\n\tof every month between 10.00 a.m. and 3.00 p.m. for three months<br \/>\n\tonly;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of residences to the I.O. and also to the Court<br \/>\n\tat the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<blockquote><p>\t\t\tThe<br \/>\n\t\t\tAuthorities will release the applicant only if he is not required<br \/>\n\t\t\tin connection with any other offence for the time being.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tIf<br \/>\n\t\t\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\t\t\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\t\t\taction in the matter.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tBail<br \/>\n\t\t\tbond to be executed before the lower court having jurisdiction to<br \/>\n\t\t\ttry the case.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tAt<br \/>\n\t\t\tthe trial, the trial court shall not be influenced by the<br \/>\n\t\t\tobservations of preliminary nature, qua the evidence at this<br \/>\n\t\t\tstage, made by this Court while enlarging the applicant on bail.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tRule<br \/>\n\t\t\tis made absolute to the aforesaid extent.
