Justice S.S.SATHEESACHANDRAN\n\n Dated :22\/09\/2010\n\n O R D E R\n             S.S.SATHEESACHANDRAN\n         ----------------------------------------\n                  S.A.No.538 of 2002\n        -----------------------------------------\n    Dated this the 22nd day of September, 2010\n\n                      JUDGMENT\n<\/pre>\n<p>       The second appeal is preferred against<\/p>\n<p>the    concurrent        decision        rendered    in<\/p>\n<p>O.S.No.444\/90 on the file of the Munsiff&#8217;s<\/p>\n<p>Court, Adoor, by the two courts below granting<\/p>\n<p>a  preliminary      decree      in    favour     of the<\/p>\n<p>plaintiff\/1st respondent in the appeal.<\/p>\n<p>       2.   Suit    was    one    for    partition  and<\/p>\n<p>admittedly, the plaint property belonged to one<\/p>\n<p>Chacko Varghese.      Plaintiff is one among the<\/p>\n<p>daughters of the above Chacko Varghese. Her<\/p>\n<p>claim  for   partition       was    resisted     by the<\/p>\n<p>contesting   defendants       contending       that the<\/p>\n<p>daughters who have been given away in marriage<\/p>\n<p>with &#8216;Sthreedhana&#8217; are not entitled to claim<\/p>\n<p>any share in the property of their father.<\/p>\n<p>S.A.No.538 of 2002<\/p>\n<p><span class=\"hidden_text\">                         2<\/span><\/p>\n<p>Provisions      of   the   Travancore   Christian<\/p>\n<p>Succession Act, which spelt out the rule of<\/p>\n<p>succession disinheriting the daughters given<\/p>\n<p>away in marriage on payment of &#8216;Sthreedhana&#8217;<\/p>\n<p>from claiming shares in the family property was<\/p>\n<p>pressed into service to decline the suit claim<\/p>\n<p>of the plaintiff for separate allotment of<\/p>\n<p>share over the property of the father, who died<\/p>\n<p>intestate.     Both the courts below, taking note<\/p>\n<p>that the Travancore Christian Succession Act,<\/p>\n<p>stood repealed with the coming into force of the<\/p>\n<p>Part   B   States   (Laws)  Act,  1951,  and  the<\/p>\n<p>succession of the parties who are Christians is<\/p>\n<p>governed   by    the  provisions  of  the  Indian<\/p>\n<p>Succession Act, 1925 repelled the contention<\/p>\n<p>raised by the defendants      resisting the suit<\/p>\n<p>claim for partition. In that view of the matter,<\/p>\n<p>a preliminary decree was passed in favour of the<\/p>\n<p>plaintiff\/1st respondent.
