No. 195 OF 2009\n           ----------------------------------------\n        Dated, the 22nd day of October, 2009\n\n                          ORDER\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<p>      Even after service of notice, there is no appearance<\/p>\n<p>for the    respondent.   However, since the Tribunal has<\/p>\n<p>followed the Division Bench judgment in <a href=\"\/doc\/1990315\/\">Thresiamma<\/p>\n<p>L.Chirayil v. State of Kerala<\/a> (2007(1) KLT 303) and<\/p>\n<p>allowed the appeal, the only matter to be considered is<\/p>\n<p>the case of the State that appeal is pending against the<\/p>\n<p>judgment of the Division Bench         before the Supreme<\/p>\n<p>Court.\n<\/p>\n<p>      2. In the circumstances,     we dispose    of this S.T<\/p>\n<p>Revision    by holding that the     order of the    Tribunal<\/p>\n<p>impugned in this STRV will be subject to the result of the<\/p>\n<p>appeal pending before the Supreme Court. In other<\/p>\n<p>words, if the said appeal is allowed, then the assessing<\/p>\n<p>officer will make assessment and demand tax consistent<\/p>\n<p>STRV 195\/09<br \/>\n<span class=\"hidden_text\">                             -:2:-<\/span><\/p>\n<p>with the Supreme Court judgment in appeal, after notice<\/p>\n<p>to the assessee.
