Justice R.BASANT\n\n Dated :17\/01\/2008\n\n O R D E R\n                             R.BASANT, J\n                      ------------------------------------\n                        B.A.No.259 of 2008\n                     -------------------------------------\n             Dated this the 17th day of January, 2008\n\n                                  ORDER\n<\/pre>\n<p>     Application for anticipatory bail.                   Petitioners are the<\/p>\n<p>Secretary, the loanee and a convenor of an administrative<\/p>\n<p>committee of a Co-operative Society. The loanee allegedly made<\/p>\n<p>an application for loan. That application was allowed and loan<\/p>\n<p>was released to the said loanee. It is alleged that the loanee at<\/p>\n<p>the relevant time had no title over the property which he had<\/p>\n<p>pledged before the bank. The subsequent secretary in office filed<\/p>\n<p>a private complaint which was referred by the learned Magistrate<\/p>\n<p>to the police under Section 156(3) Cr.P.C.                 Investigation is in<\/p>\n<p>progress. The petitioners apprehend imminent arrest.<\/p>\n<p>     2.    The learned counsel for the petitioner prays, the<\/p>\n<p>learned Public Prosecutor does not oppose the said prayer and I<\/p>\n<p>am satisfied that the petitioners can be granted anticipatory bail.<\/p>\n<p>In the absence of opposition, I am not adverting to facts in any<\/p>\n<p>greater detail.  I take note of the submissions of the learned<\/p>\n<p>Public Prosecutor that the loan has been repaid and the liability<\/p>\n<p>has been discharged in full by now. Appropriate conditions can<\/p>\n<p><span class=\"hidden_text\">B.A.No.259 of 2008               2<\/span><\/p>\n<p>be imposed in the interests of a fair, efficient and expeditious<\/p>\n<p>investigation.\n<\/p>\n<p>      3.   In the result, the Bail Application is, allowed.     The<\/p>\n<p>following directions are issued under Section 438 Cr.P.C.<\/p>\n<p>      i)   The petitioners shall appear before the learned<\/p>\n<p>Magistrate at 11 a.m on 24.01.2008. They shall be enlarged on<\/p>\n<p>regular bail on their executing bond for Rs.50,000\/- (Rupees Fifty<\/p>\n<p>thousand only) each with two solvent sureties each for the like<\/p>\n<p>sum to the satisfaction of the learned Magistrate;<\/p>\n<p>      ii)  The petitioners shall make themselves available for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and<\/p>\n<p>3 p.m on 25.01.08 and 28.01.08.          During that period, the<\/p>\n<p>Investigating Officer shall be at liberty to interrogate the<\/p>\n<p>petitioners in custody and take all necessary for the proper<\/p>\n<p>conduct of the investigation.     Thereafter the petitioners shall<\/p>\n<p>make     themselves   available   for  interrogation   before   the<\/p>\n<p>Investigating Officer between 10 a.m and 12 noon on all Mondays<\/p>\n<p>and Fridays for a period of one month and subsequently          the<\/p>\n<p>petitioners shall make themselves available for interrogation as<\/p>\n<p>and when directed by the Investigating Officer in writing to do so;<\/p>\n<p><span class=\"hidden_text\">B.A.No.259 of 2008                3<\/span><\/p>\n<p>      iii)  If the petitioners do not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to<\/p>\n<p>arrest the petitioners and deal with them in accordance with law<\/p>\n<p>as if those directions were not issued at all;\n<\/p>\n<p>      iv)   If the petitioners were arrested prior to their surrender<\/p>\n<p>on 24.01.2008 as directed in clause (1) above, they shall be<\/p>\n<p>released from custody on their executing a bond for Rs.25,000\/-<\/p>\n<p>(Rupees Twenty Five thousand only) each without any sureties<\/p>\n<p>undertaking to appear before the learned Magistrate on<\/p>\n<p>24.01.2008.\n<\/p>\n<\/p>\n<p>                                              (R.BASANT, JUDGE)<br \/>\nrtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Laly Varghese vs State Of Kerala on 17 January, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 259 of 2008() 1.
