JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/05\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled, with the following prayers :-\n<\/p>\n<p>&#8220;A)\tYOUR<br \/>\nLORDSHIPS be pleased to admit and allow the present petition of the<br \/>\npetitioner.\n<\/p>\n<p>B)<br \/>\nYOUR LORDSHIPS be pleased to issue appropriate writ of mandamus,<br \/>\ncertiorari, prohibition, or any other suitable writ, order or<br \/>\ndirection which the Hon&#8217;ble Court may deem fit and directed the<br \/>\nrespondent no.1 to 6 to take back present petitioner in service at<br \/>\nthe post from which present petitioner terminated i.e. &#8220;ANGANVADI<br \/>\nKENDRA JALSAN-15(GATE SEAM)&#8221;.\n<\/p>\n<p>C)<br \/>\nYOUR LORDSHIPS be pleased to issue appropriate writ of mandamus,<br \/>\ncertiorari, prohibition, or any other suitable writ, order or<br \/>\ndirection which the Hon&#8217;ble Court may deem fit and be pleased to<br \/>\nquashed and set aside the termination letter dated: 23\/11\/2010 at<br \/>\nANNEXURE:A.\n<\/p>\n<p>D)\tPending<br \/>\nhearing and till the final disposal of the present petition  YOUR<br \/>\nLORDSHIPS be pleased to stay the operation, execution and<br \/>\nimplementation of the recruitment proceeding initiated by way of<br \/>\npublic advertisement dated: 14 \/ 12 \/2010 at ANNEXURE:H COLLY qua the<br \/>\npost of present petitioner i.e. &#8220;ANGANVADI KENDRA<br \/>\nJALSAN-15(GATE SEAM)&#8221;.\n<\/p>\n<p>E)\tPending<br \/>\nhearing and till the final disposal of the present petition YOUR<br \/>\nLORDSHIP be pleased to direct the respondent authority to consider<br \/>\nthe representation of present petitioner dated:9\/12\/2010 at<br \/>\nANNEXURE:G.\n<\/p>\n<p>F)\tAny<br \/>\nother relief&#8217;s, which is deemed fit and proper by YOUR LORDSHIP may<br \/>\npleased be granted in the interest of justice and cost of this<br \/>\npetition may please be quantified suitable and be paid to the<br \/>\npetitioner;&#8221;\n<\/p>\n<p>2.\tThe<br \/>\npetitioner is Anganwadi Karyakar and has been appointed as such on<br \/>\n05.06.1991. By impugned order dated 20.11.2010, the petitioner has<br \/>\nbeen removed from the post of Anganwadi Karyakar pursuant to a<br \/>\nsurprise inspection that took place on 04.09.2010.\n<\/p>\n<p>3.\tThe<br \/>\nmain grievance of the petitioner, as voiced in the present petition,<br \/>\nis that the impugned order has been passed without affording her an<br \/>\nopportunity of hearing and also that the said order is not a reasoned<br \/>\none.\n<\/p>\n<p>4.\tWhen<br \/>\nthe matter is taken up for hearing today, Mr. H.S. Munshaw, learned<br \/>\nadvocate for respondent No.3 states, upon instructions from Ms.<br \/>\nAvantika Singh, District Development Officer, Anand that the<br \/>\ncompetent authority will issue a notice to the petitioner and the<br \/>\npetitioner shall be afforded an opportunity of personal hearing and<br \/>\nof filing a reply to the show-cause notice. After hearing the<br \/>\npetitioner and considering the reply, a fresh order shall be passed,<br \/>\nin accordance with law.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above statement being made by the learned advocate for<br \/>\nrespondent No.3 and as there is no dispute to the fact that no<br \/>\nhearing has been given to the petitioner before passing the impugned<br \/>\norder, the said order dated 20.11.2010, passed by respondent No.3, is<br \/>\nquashed and set aside. The petitioner shall make herself available<br \/>\nfor the personal hearing and cooperate in the proceedings and<br \/>\nrespondent No.3 shall intimate the petitioner regarding the order,<br \/>\nwhen passed.\n<\/p>\n<p>\tIt<br \/>\nis clarified that the impugned order has been quashed and set aside<br \/>\non the ground that it has been passed without affording the<br \/>\npetitioner an opportunity of hearing and other grounds have not been<br \/>\ngone into.\n<\/p>\n<p>6.\tThe<br \/>\npetition is disposed of, in the above terms.
