K.Hat, District Purnea.\n                                             ............Opposite Parties\n\n                              -----------\n<\/pre>\n<p>02\/-    18-11-2010              Heard     learned       counsel     for        the<\/p>\n<p>                     petitioner and Additional Public Prosecutor<\/p>\n<p>                     for the State.\n<\/p>\n<p>                                Petitioner is named accused in this<\/p>\n<p>                     complaint case with allegation of taking a<\/p>\n<p>                     substantial amount worth Rs. 10,000\/- from<\/p>\n<p>                     the     complainant-opposite        party     no.    2    on<\/p>\n<p>                     execution of some document.           During course of<\/p>\n<p>                     argument, it is submitted by learned counsel<\/p>\n<p>                     for the petitioner that though he has taken<\/p>\n<p>                     the   money,   but   paid     of    major    portion,      of<\/p>\n<p>                     course no amount is paid towards interest on<\/p>\n<p>                     the amount so advanced.            However, petitioner<\/p>\n<p>                     is ready to make payment of the remaining<\/p>\n<p>                     amount, but up to the last month of June,<\/p>\n<p>                     2011.      During    course    of    argument,       it   is<\/p>\n<p>                     further    agreed    that   over     the    total   amount<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>advanced simple interest at the rate of 8%<\/p>\n<p>shall    be        calculated         from     the     date   of<\/p>\n<p>advancement till its final realization and<\/p>\n<p>total amount be paid by the petitioner by<\/p>\n<p>30th June, 2011, deducting the amount already<\/p>\n<p>refunded either through cash or cheque.                       In<\/p>\n<p>case of non-payment of the amount by the date<\/p>\n<p>fixed    i.e.         30th   June,    2011,     the    rate   of<\/p>\n<p>interest 8% shall be treated converted from<\/p>\n<p>simple to compoundable.               It is further agreed<\/p>\n<p>that on final refund, the complainant shall<\/p>\n<p>return      the        undated       cheques    received       as<\/p>\n<p>mentioned in the complaint petition.<\/p>\n<p>            Considering               the       facts         and<\/p>\n<p>circumstances of the case, the petitioner on<\/p>\n<p>the event of filing an undertaking in support<\/p>\n<p>of the agreement aforesaid regarding payment<\/p>\n<p>with interest order till 30th June, 2011, in<\/p>\n<p>the event of his arrest\/surrender before the<\/p>\n<p>court below within four weeks of receipt of<\/p>\n<p>the copy of this order, petitioner, namely,<\/p>\n<p>Bimlesh Kumar Das, is directed to be released<\/p>\n<p>on   bail     on       furnishing       bail    bond    of    Rs.<\/p>\n<p>10,000\/-      (ten           thousand       only)     with    two<\/p>\n<p>sureties      of      the     like    amount    each    to    the<br \/>\n<span class=\"hidden_text\">                         3<\/span><\/p>\n<p>          satisfaction      of    Chief   Judicial        Magistrate,<\/p>\n<p>          Purnea in connection with Complaint Case No.<\/p>\n<p>          CA 2673 of 2010, subject to condition laid<\/p>\n<p>          down under Section 438 (2) of the Criminal<\/p>\n<p>          Procedure Code with additional condition to<\/p>\n<p>          remain physically present before the court<\/p>\n<p>          below on each and every date at least for one<\/p>\n<p>          year or till disposal of the case whichever<\/p>\n<p>          is   earlier,      in   case     of     failure     on    two<\/p>\n<p>          consecutive       dates,   the        liberty     shall    be<\/p>\n<p>          deemed to be cancelled.\n<\/p>\n<p>                   It is further, made clear that on<\/p>\n<p>          non-payment by scheduled date, the privilege<\/p>\n<p>          granted shall be deemed to be cancelled.<\/p>\n<pre>Praveen                              (Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Bimlesh Kumar Das vs State Of Bihar &amp;Amp; Anr on 18 November, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
