Justice T.R.RAMACHANDRAN NAIR\n\n Dated :20\/05\/2010\n\n O R D E R\n                T.R.RAMACHANDRAN NAIR, J.\n                   -------------------------------------\n                    W.P.(C)No.5417 of 2010\n                   --------------------------------------\n              Dated this the 20th day of May, 2010\n\n                              JUDGMENT\n<\/pre>\n<p>      This writ petition is filed by the petitioner aggrieved by the<\/p>\n<p>proposal for the widening of Kottayam-Kumarakom Road. It is<\/p>\n<p>submitted that without initiating any valid proceedings under the<\/p>\n<p>Land Acquisition Act respondents are taking steps for forcible<\/p>\n<p>acquisition violating all the principles of law.<\/p>\n<p>      2.   The learned Government Pleader on instructions<\/p>\n<p>submitted that no proceedings have been initiated so far under<\/p>\n<p>the Land Acquisition Act and no notification has been issued. In<\/p>\n<p>the light of the above it is clear that proceedings are yet to be<\/p>\n<p>initiated. In that view of the matter there is no basis for the<\/p>\n<p>apprehension of the petitioner. Only under due process of law<\/p>\n<p>properties can be acquired. It is open to the petitioner to<\/p>\n<p>challenge the Land Acquisition Proceedings after the Land<\/p>\n<p>Acquisition notification is issued, if they are aggrieved by the said<\/p>\n<p>notification.\n<\/p>\n<p>      The writ petition is accordingly disposed of.
