Shethna, learned advocate for the applicant and<br \/>\nrespondent wife (who appears as party-in-person).\n<\/p>\n<p>2.<br \/>\nWith regard to the earlier application, made by the advocate of the<br \/>\napplicant, by which certain details\/documents were requested for it<br \/>\nhas been submitted today by Mr. Shethna, learned advocate for the<br \/>\napplicant that the applicant\/applicant&#8217;s advocate has received reply<br \/>\nto the said application and two options have been offered for further<br \/>\ncourse of action with regard to the said application. He has also<br \/>\nsubmitted that though the reply as aforesaid has been received by<br \/>\napplicant\/applicant&#8217;s advocate, having regard to the nature and scope<br \/>\nof present\/main application and in the interest of justice the<br \/>\napplicant and the applicant&#8217;s advocate are not inclined to pursue the<br \/>\nsaid application any further and do not intend to adopt either of the<br \/>\ncourse suggested in the above referred reply dated 26.1.2011<br \/>\n(received on 3.2.2011) so as to bring about final decision in the<br \/>\npresent\/main application.  It is also clarified by the learned<br \/>\nadvocate for the applicant that the applicant and the applicant&#8217;s<br \/>\nadvocate do not intend to press in service the said separate<br \/>\napplication for detail\/documents and do not want to rely on the<br \/>\ndetails\/documents for which request was made in the said earlier<br \/>\napplication and instead would prefer to rely upon the record of<br \/>\npresent application and the documents\/affidavit which are presently<br \/>\nobtaining on the record of this\/main application and that therefore<br \/>\nthe said earlier application and the said proceedings may be treated<br \/>\nas closed or waived and instead the application may be decided on its<br \/>\nown merits on the basis of the material available on record of<br \/>\npresent application.\n<\/p>\n<p>3.<br \/>\nThe said submission is not opposed by the respondent wife (who<br \/>\nappears as party-in-person).\n<\/p>\n<p>4.<br \/>\nHence, in view of the submission and the stipulation made by the<br \/>\nlearned advocate for the applicant the said earlier application<br \/>\nseeking certain details\/documents is treated as having been waived<br \/>\nand i.e. not persued.\n<\/p>\n<p>5.<br \/>\nHaving regard to the fact that today it is already 5.10 p.m. when the<br \/>\napplication is taken up for hearing and it is already passed court<br \/>\nhours it would not be feasible to undertake further hearing of the<br \/>\napplication, hence, the hearing of the application is required to be<br \/>\nadjourned.\n<\/p>\n<p>6.<br \/>\nIn view of the joint request by the parties further hearing of the<br \/>\napplication is adjourned to 23.2.2011 at 4.45 p.m. <\/p>\n<p>7.<br \/>\nSince main petitions being SCA No. 8137 of 2008, SCA No.10866 of 2008<br \/>\nas well as CA No.5486 of 2009 are pending before the Court taking up<br \/>\nthe said petitions and civil application as per the regular roster,<br \/>\nit is clarified that pendency of present application does not have<br \/>\nany connection or bearing with regard to the said two petitions or<br \/>\napplication.\n<\/p>\n<p>(K.M.THAKER,J.)<\/p>\n<p>Suresh*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Rakesh vs Heard Mr. Homraz B.
