enhancement of compensation.   1. <\/p>\n

\ncart from  Helmet with an accident
\nwhen a   negligent manner by
\nits dfi;irer_  and dashed against the bullock
\ncart.   the claimant su\ufb02ered injuries<\/p>\n
 one of the  at the spot. The claimant moved<\/p>\n
      Section 166 of the Motor Vehicles<\/p>\n
  ‘V-compensation. I-le examined himself as P.W.1<\/p>\n
 thelloctor by name Mariswamy was examined as P.W.4.<\/p>\n
 ggExs.l7’~1_.it’to Ex.P18 were produced and marked. The Tribunal<\/p>\n
  ‘cl,nhbed together three claims arising out of the same accident<\/p>\n

4. Having held that the accident occurred due to the
\nactionable negligence on the part of the driver of the-pprivate<\/p>\n
bus, the Tribunal has awarded Rs.30,000\/- as <\/p>\n
for the personal injuries suffered by the  <\/p>\n

  bya agricultural work. In the face of the<\/p>\n
   itecord, the Tribunal has awarded compensation in<\/p>\n
“st  sf’t:isls’3o,ooo\/–. Though the Tribunal has awarded only<\/p>\n
 towards pain and sujfering. the fact that a sum of<\/p>\n
it ~  Rs\u00ab..20,V(s)0O[- is awarded towards alleged permanent disability<\/p>\n
 to be kept in mind. In fact, there is no material to<\/p>\n
V  establish that such a permanent physical disability was<\/p>\n
suffered by the claimant. In that view of the matter, though a<\/p>\n

meagre amount is awarded towards pain and suffering. in View
\nof the award made in a sum of Rs.20,000\/\u00a7.~=.__towan_1s<\/p>\n
