Heard learned counsel for the petitioner<\/p>\n<p>                   and the State.\n<\/p>\n<p>                           2. This writ petition has been filed for a<\/p>\n<p>                   direction to Respondent No. 7, the Headmaster,<\/p>\n<p>                   Middle School, Shikarpur, Sonepur, Saran to<\/p>\n<p>                   return the amount given to him for the purpose of<\/p>\n<p>                   raising Complex Resource Centre in the campus of<\/p>\n<p>                   the said school as the said school does not fulfil<\/p>\n<p>                   the criteria for raising the Complex Resource<\/p>\n<p>                   Centre and in appreciation of such fact District<\/p>\n<p>                   Superintendent           of        Education-cum-District<\/p>\n<p>                   Programme Coordinator, Sarva Shiksha Abhiyan,<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>Saran, Chapra instructed Respondent No. 7 to<\/p>\n<p>return the amount so that the Complex Resource<\/p>\n<p>Centre is raised in the campus of Primary School,<\/p>\n<p>Dariyapur, Sonepur, Saran or any other school<\/p>\n<p>which fulfil the criteria for raising the Centre.<\/p>\n<p>        3. It is submitted on behalf of the<\/p>\n<p>petitioner that ignoring the aforesaid direction of<\/p>\n<p>Respondent No. 4, Respondent No. 7 merrily<\/p>\n<p>proceeded    with       the    raising   of   the   Complex<\/p>\n<p>Resource Centre in the campus\/premises of the<\/p>\n<p>Middle School, Shikarpur, Sonepur, Saran.<\/p>\n<p>        4. Counsel for the State also confirms that<\/p>\n<p>during the pendency of this writ petition the<\/p>\n<p>Complex Resource Centre has been raised within<\/p>\n<p>the    campus\/premises             of    Middle      School,<\/p>\n<p>Shikarpur, Sonepur, Saran. Counsel for the State,<\/p>\n<p>however, does not concede the position that<\/p>\n<p>raising of the Complex Resource Centre in the<\/p>\n<p>campus\/premises           of     the     Middle      School,<\/p>\n<p>Shikarpur, Sonepur, Saran is contrary to the<\/p>\n<p>instruction of Respondent No. 4.\n<\/p>\n<p>        5. Having heard counsel for the petitioner<\/p>\n<p>and the State, I direct the petitioner to appear<\/p>\n<p>before the District Magistrate, Saran at Chapra<\/p>\n<p>and invite his attention towards the order of the<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>         District Superintendent of Education, Saran-cum-<\/p>\n<p>         District Programme Coordinator, Sarva Shiksha<\/p>\n<p>         Abhiyan, Saran, Chapra Respondent No. 4 by<\/p>\n<p>         which he had asked Respondent No. 7 to return<\/p>\n<p>         the amount and if the District Magistrate is<\/p>\n<p>         satisfied    that   the     Middle     School,    Shikarpur,<\/p>\n<p>         Sonepur,      Saran       does   not   fulfil   the   criteria,<\/p>\n<p>         appropriate steps be taken for shifting of the<\/p>\n<p>         Complex from the campus\/premises of the said<\/p>\n<p>         school to any other school which fulfils the criteria<\/p>\n<p>         for raising of such complex. District Magistrate<\/p>\n<p>         shall pass orders in compliance of this order, as<\/p>\n<p>         early as possible, in any case within a reasonable<\/p>\n<p>         time.\n<\/p>\n<p>                     6.
