PUBLIC PROSECUTOR for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\nDate\n: 22\/04\/2011  \nORAL ORDER<\/pre>\n<p>\tThis<br \/>\nis an application under Sec.439 of the Code of Criminal Procedure,<br \/>\n1973 for regular bail by the applicant who came to be arrested in<br \/>\nconnection with  CR No. I 144 of 2009 registered with  Rakhial police<br \/>\nstation, for the offence punishable under Sections 406, 420, 467,<br \/>\n468, 120-B and 114 of Indian Penal Code.\n<\/p>\n<p>\tLearned<br \/>\nadvocate, at the outset, submitted that the co-accused who is the<br \/>\nmain culprit in the matter is already enlarged on bail by the<br \/>\ncoordinate bench of this Court vide order dated 12.5.2010. Learned<br \/>\nadvocate placed reliance on the order dated 23.3.2011 passed in<br \/>\nCriminal Misc. Application No. 2264 of 2011 in support of the<br \/>\nsubmission that another accused is also enlarged on bail having<br \/>\nalmost identical role. In view of the above, learned advocate<br \/>\nsubmitted that the applicant also deserves to be enlarged on bail<br \/>\neven on the ground of parity.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>H.L. Jani, learned APP, while opposing the bail application submitted<br \/>\nthat the applicant is involved in serious offence punishable under<br \/>\nsections 406, 420, 467, 468, 120-B and 114 of IPC. Taking into<br \/>\naccount the gravity of the offence, the manner in which the offence<br \/>\nis committed and the nature of offence in which the applicant is<br \/>\ninvolved, no lenient view be taken in the matter and the application<br \/>\ndeserves to be rejected out of hand.\n<\/p>\n<p>\tI<br \/>\nhave heard the learned advocates of both the sides at length and in<br \/>\ngreat detail. Considering the rival submissions and on perusal of the<br \/>\naverments made in the application, role attributed to the applicant<br \/>\nwhich is reflected in the FIR at Annexure:A to the application as<br \/>\nwell as the the fact that the co-accused having similar role like the<br \/>\npresent applicant is already enlarged on bail by this Court vide<br \/>\norder dated 12.5.2010  passed in Criminal Misc. Application No.4641<br \/>\nof 2010, as well as the  provisions of Sections 406, 420, 467, 468,<br \/>\n120-B and 114 of IPC, quantum of punishment etc.,  I am of the view<br \/>\nthat the applicant deserves to be enlarged on bail without discussing<br \/>\nthe evidence in detail.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith CR No. I 144 of 2009 registered at  Rakhial Police Station on<br \/>\nexecuting a bond of Rs.10,000\/- [Rupees ten thousand only] with one<br \/>\nsurety of the like amount to the satisfaction of the Trial Court and<br \/>\nsubject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at the concerned Police Station on any day of first week<br \/>\nof every English calendar month between 9.00 AM and 2.00 PM. till the<br \/>\ntrial is over;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tAt the<br \/>\ntrial, the Trial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicant on bail.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute to the aforesaid extent.\n<\/p>\n<p>\tDirect<br \/>\nService is permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t(H.B.ANTANI,<br \/>\nJ.)<\/p>\n<p>pirzada\/-\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<blockquote><p>\t\t   Top<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Rameshbhai vs State on 1 July, 2011 Author: H.B.Antani, Gujarat High Court Case Information System Print CR.MA\/4854\/2011 3\/ 3 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD CRIMINAL MISC.APPLICATION No. 4854 of 2011 ========================================================= RAMESHBHAI KANJIBHAI BAROT &#8211;
