No. 1640 OF 2007\n               ...................................................................................\n                              Dated this the 9th August, 2007\n\n\n                                           J U D G M E N T\n<\/pre>\n<p>H.L. Dattu, C.J.:\n<\/p>\n<\/p>\n<p>        This Writ Appeal arises out of the order passed by the learned single<\/p>\n<p>Judge in W.P.(C) No. 31727 of 2005 dated 18.01.2006.<\/p>\n<p>        2.   The appellant\/petitioner in this Writ Appeal pleads her financial<\/p>\n<p>inability to comply with the orders                      and directions issued by this Court.<\/p>\n<p>Therefore she\/appellant             is requesting us to grant her the facility of easy<\/p>\n<p>instalments to pay off the entire arrears due to the respondents. An affidavit<\/p>\n<p>in this regard is also filed by the appellant.<\/p>\n<p>        3. Paragraph &#8216;4&#8217; of the affidavit reads as under:<\/p>\n<p>         &#8220;This appellant is ready to pay the balance amount in monthly<\/p>\n<p>         instalments of Rs.5000\/- each                         till the whole              liability is<\/p>\n<p>         discharged.         This appellant hereby                   undertakes to pay the<\/p>\n<p>         instalment without any break&#8221;.\n<\/p>\n<p>        4.   Taking into consideration the                     financial inability pleaded by the<\/p>\n<p>appellant\/petitioner, in our opinion, if we modify the orders passed by the<\/p>\n<p>learned single Judge and grant some relief to the appellant\/petitioner, no<\/p>\n<p>injustice would be caused to the respondents. Accordingly, the following:<\/p>\n<p>                                              O R D E R<\/p>\n<p>        i)       Writ Appeal is disposed of.\n<\/p>\n<p>W.A. No. 1640 OF 2007<\/p>\n<p><span class=\"hidden_text\">                                         2<\/span><\/p>\n<p>       ii)      The appellant\/petitioner will   now pay, monthly instalment of<\/p>\n<p>Rs.5,000\/- (Rupees five thousand only) each, till the entire liability is<\/p>\n<p>discharged.\n<\/p>\n<p>       iii)     If for any reason, the appellant\/petitioner commits any default in<\/p>\n<p>payment of the monthly instalment, as ordered by this court, the respondents<\/p>\n<p>are at liberty to initiate such proceedings to recover the entire amount due<\/p>\n<p>from the appellant\/petitioner.\n<\/p>\n<p>       iv)      With these observations and directions, the Writ Appeal is<\/p>\n<p>disposed of.\n<\/p>\n<p>       Ordered accordingly.\n<\/p>\n<\/p>\n<p>                                                        H.L.
