            Petitioner               lodged           a  complaint\n\nbefore  Judicial          First          Class          Magistrate,\n\n<\/pre>\n
Chittur   alleging that second respondent<\/p>\n
committed  offence            under          Section       420   of<\/p>\n
Indian  Penal       Code         and        Section        138  of<\/p>\n
Negotiable      Instruments                     Act.        Learned<\/p>\n
Magistrate     has           taken             cognizance        in<\/p>\n
S.T.5226\/1998 for the offence under Section<\/p>\n
417 of Indian Penal Code                      alone, based on<\/p>\n
the  evidence          recorded.                By      Annexure-B<\/p>\n
judgment, second           respondent was acquitted<\/p>\n
under Section 255(1) of Code of Criminal<\/p>\n
Procedure    on         9\/12\/1998.                       Petitioner<\/p>\n
challenged the order of acquittal by filing<\/p>\n
Crl.A.422\/1999            before            this        Court.   By<\/p>\n
Crmc 4699\/10              2<\/span><\/p>\n
judgment dated 11\/7\/2007 the order of acquittal<\/p>\n
was set aside and the case was sent back to the<\/p>\n
trial court for fresh consideration, as this<\/p>\n
Court        found     that    matter     requires<\/p>\n
reconsideration. This Court also directed the<\/p>\n
Magistrate to afford opportunity to both the<\/p>\n
second respondent and the petitioner to adduce<\/p>\n
further evidence, if they so desires and to<\/p>\n
dispose the case untramelled by any observation<\/p>\n
in the earlier judgment. Petitioner subsequent<\/p>\n
to    the    order  of  remand  filed  Annexure-D<\/p>\n
petition, C.M.P.474\/2008, to alter the charge,<\/p>\n
for      the   offence   under  Section   138   of<\/p>\n
Negotiable Instruments Act contending that as<\/p>\n
per subsequent decision of this Court, even if,<\/p>\n
the cheque was issued on an account which was<\/p>\n
closed,     an   offence  under Section   138  of<\/p>\n
Negotiable     Instruments  Act is  attracted.  By<\/p>\n
Annexure-E order, learned Magistrate dismissed<\/p>\n
Crmc 4699\/10               3<\/span><\/p>\n
the petition. Petitioner challenged that order<\/p>\n
before        Sessions    Court,     Palakkad    in<\/p>\n
Crl.R.P.89\/2008.      Learned  Additional   Sessions<\/p>\n
Judge      by  Annexure-F  order  dated  13\/8\/2010,<\/p>\n
dismissed      the  revision  holding  that  as  the<\/p>\n
learned Magistrate has not taken cognizance of<\/p>\n
the offence under Section 138 of          Negotiable<\/p>\n
Instruments Act, it is to be treated as an<\/p>\n
order of acquittal\/discharge of that offence<\/p>\n
against the accused and therefore, the charge<\/p>\n
cannot be altered as sought for. Petition is<\/p>\n
filed under Section 482 of Code of Criminal<\/p>\n
Procedure to quash Annexures-E and F orders and<\/p>\n
alter the charge for the offence      under Section<\/p>\n
138 of      Negotiable Instruments Act.<\/p>\n
            2.   Learned  counsel appearing for the<\/p>\n
petitioner was heard.\n<\/p>\n
            3. Argument of the    learned   counsel<\/p>\n
appearing for the      petitioner is that   learned<\/p>\n
Crmc 4699\/10              4<\/span><\/p>\n
Magistrate originally did not take cognizance<\/p>\n
of the offence under Section 138 of     Negotiable<\/p>\n
Instruments Act. Decisions      of this Court, as<\/p>\n
then stood was that if a cheque is drawn     is an<\/p>\n
account, which was already closed, an offence<\/p>\n
under Section 138 of       Negotiable Instruments<\/p>\n
Act is not attracted. Later Division Bench of<\/p>\n
this Court held that even in such an event, an<\/p>\n
offence      under  Section  138   of   Negotiable<\/p>\n
Instruments Act is     attracted. Argument is that<\/p>\n
in     such   circumstances,  learned   Magistrate<\/p>\n
should have altered the charge for the offence<\/p>\n
under Section 138. Relying on the decision of<\/p>\n
this Court in Prakasan v. State of Kerala<\/a> (2008<\/p>\n
(1) Kerala ILR 17) it was argued that even<\/p>\n
though,      learned Magistrate   has  not   taken<\/p>\n
cognizance of the offence under Section 138 of<\/p>\n
Negotiable Instruments Act, no reason has been<\/p>\n
shown      why the  said  offence  was  not  taken<\/p>\n

cognizance and therefore, the order, not taking<\/p>\n
cognizance would only be a nullity     and if that<\/p>\n
be so, courts below were not justified in not<\/p>\n
altering      the charge  for  the  offence  under<\/p>\n
Section 138 of      Negotiable Instruments Act for<\/p>\n
the reason that failure to take cognizance for<\/p>\n
the offence under Section 138 of        Negotiable<\/p>\n
Instruments Act would amount to an order of<\/p>\n
discharge or acquittal.\n<\/p>\n
            4.   Learned Magistrate had originally<\/p>\n
taken cognizance for the offence under Section<\/p>\n
417     of    Indian  Penal  Code  alone,   though<\/p>\n
complaint      was  filed  alleging  that   second<\/p>\n
respondent committed an offence under Section<\/p>\n
420 of Indian Penal Code and Section 138 of<\/p>\n
Negotiable Instruments Act. That was in 1998.<\/p>\n
Petitioner     did  not  challenge the  order  not<\/p>\n
taking cognizance for the offence under Section<\/p>\n
138      of    Negotiable  Instruments   Act.   He<\/p>\n

participated in the trial in S.T.5226\/1998. The<\/p>\n
second respondent was acquitted on 9\/12\/1998.<\/p>\n
Petitioner challenged       the order of acquittal<\/p>\n
before      this  Court. Before  this  Court,  the<\/p>\n
petitioner had no case that     learned Magistrate<\/p>\n
should have taken cognizance for the offence<\/p>\n
under Section 138 of        Negotiable Instruments<\/p>\n
Act or that an offence under Section 138 is<\/p>\n
attracted. Even when criminal appeal was heard,<\/p>\n
petitioner did not sought an opportunity to<\/p>\n
alter the charge or raise any contention that<\/p>\n
on the facts, an offence under Section 138 of<\/p>\n
Negotiable Instruments Act was attracted.      The<\/p>\n
decision of the Division Bench of this Court<\/p>\n
that     even  if  the  cheque  was  issued in  an<\/p>\n
account      which  was closed  would  attract  an<\/p>\n
offence      under   Section  138   of   Negotiable<\/p>\n
Instruments Act overruling the earlier decision<\/p>\n
was much earlier to the filing of the appeal.<\/p>\n

That     decision  was  available even  when  the<\/p>\n
appeal was heard and disposed by this Court on<\/p>\n
11\/7\/2007. The remand was only for the purpose<\/p>\n
of adducing further evidence and disposal. The<\/p>\n
Magistrate was bound by the order of remand.<\/p>\n
Annexure-D application to alter the charge was<\/p>\n
filed before the Magistrate only on 17\/1\/2008,<\/p>\n
about ten years after taking cognizance for the<\/p>\n
offence under Section 417 of Indian Penal Code.<\/p>\n
Evidently, attempt of the petitioner is to take<\/p>\n
cognizance of the offence under Section 138 of<\/p>\n
Negotiable     Instruments  Act  in 2008,  on   a<\/p>\n
complaint filed in    1998.\n<\/p>\n
            5. Under  Section  468  of  Code  of<\/p>\n
Criminal      Procedure,    Court  cannot    take<\/p>\n
cognizance of the     offence after the period of<\/p>\n
limitation provided thereunder. Under Section<\/p>\n
468(2)(c), the period of limitation     is three<\/p>\n
years,      if the  offence  is  punishable  with<\/p>\n

imprisonment for a term not exceeding one year<\/p>\n
but not exceeding three years. Hence cognizance<\/p>\n
could not have been taken after three years,<\/p>\n
even if the period of limitation as provided in<\/p>\n
Section 138 of       Negotiable Instruments Act is<\/p>\n
not applicable. In such circumstances, I find<\/p>\n
no reason      to interfere   with the order passed<\/p>\n
by the      learned Magistrate, as confirmed by the<\/p>\n
learned Sessions Judge,       refusing to alter the<\/p>\n
charge for the offence under Section 138 of<\/p>\n
Negotiable Instruments Act.\n<\/p>\n
            Petition is dismissed.\n<\/p>\n<\/p>\n
