Justice M.SASIDHARAN NAMBIAR\n\n Dated :17\/12\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n           CRL.M.C.NO.4699 OF 2010\n           ---------------------------------------------\n           Dated 17th December, 2010\n\n\n                          O R D E R\n<\/pre>\n<pre>            Petitioner               lodged           a  complaint\n\nbefore  Judicial          First          Class          Magistrate,\n\n<\/pre>\n<p>Chittur   alleging that second respondent<\/p>\n<p>committed  offence            under          Section       420   of<\/p>\n<p>Indian  Penal       Code         and        Section        138  of<\/p>\n<p>Negotiable      Instruments                     Act.        Learned<\/p>\n<p>Magistrate     has           taken             cognizance        in<\/p>\n<p>S.T.5226\/1998 for the offence under Section<\/p>\n<p>417 of Indian Penal Code                      alone, based on<\/p>\n<p>the  evidence          recorded.                By      Annexure-B<\/p>\n<p>judgment, second           respondent was acquitted<\/p>\n<p>under Section 255(1) of Code of Criminal<\/p>\n<p>Procedure    on         9\/12\/1998.                       Petitioner<\/p>\n<p>challenged the order of acquittal by filing<\/p>\n<p>Crl.A.422\/1999            before            this        Court.   By<\/p>\n<p><span class=\"hidden_text\">Crmc 4699\/10              2<\/span><\/p>\n<p>judgment dated 11\/7\/2007 the order of acquittal<\/p>\n<p>was set aside and the case was sent back to the<\/p>\n<p>trial court for fresh consideration, as this<\/p>\n<p>Court        found     that    matter     requires<\/p>\n<p>reconsideration. This Court also directed the<\/p>\n<p>Magistrate to afford opportunity to both the<\/p>\n<p>second respondent and the petitioner to adduce<\/p>\n<p>further evidence, if they so desires and to<\/p>\n<p>dispose the case untramelled by any observation<\/p>\n<p>in the earlier judgment. Petitioner subsequent<\/p>\n<p>to    the    order  of  remand  filed  Annexure-D<\/p>\n<p>petition, C.M.P.474\/2008, to alter the charge,<\/p>\n<p>for      the   offence   under  Section   138   of<\/p>\n<p>Negotiable Instruments Act contending that as<\/p>\n<p>per subsequent decision of this Court, even if,<\/p>\n<p>the cheque was issued on an account which was<\/p>\n<p>closed,     an   offence  under Section   138  of<\/p>\n<p>Negotiable     Instruments  Act is  attracted.  By<\/p>\n<p>Annexure-E order, learned Magistrate dismissed<\/p>\n<p><span class=\"hidden_text\">Crmc 4699\/10               3<\/span><\/p>\n<p>the petition. Petitioner challenged that order<\/p>\n<p>before        Sessions    Court,     Palakkad    in<\/p>\n<p>Crl.R.P.89\/2008.      Learned  Additional   Sessions<\/p>\n<p>Judge      by  Annexure-F  order  dated  13\/8\/2010,<\/p>\n<p>dismissed      the  revision  holding  that  as  the<\/p>\n<p>learned Magistrate has not taken cognizance of<\/p>\n<p>the offence under Section 138 of          Negotiable<\/p>\n<p>Instruments Act, it is to be treated as an<\/p>\n<p>order of acquittal\/discharge of that offence<\/p>\n<p>against the accused and therefore, the charge<\/p>\n<p>cannot be altered as sought for. Petition is<\/p>\n<p>filed under Section 482 of Code of Criminal<\/p>\n<p>Procedure to quash Annexures-E and F orders and<\/p>\n<p>alter the charge for the offence      under Section<\/p>\n<p>138 of      Negotiable Instruments Act.<\/p>\n<p>            2.   Learned  counsel appearing for the<\/p>\n<p>petitioner was heard.\n<\/p>\n<p>            3. Argument of the    learned   counsel<\/p>\n<p>appearing for the      petitioner is that   learned<\/p>\n<p><span class=\"hidden_text\">Crmc 4699\/10              4<\/span><\/p>\n<p>Magistrate originally did not take cognizance<\/p>\n<p>of the offence under Section 138 of     Negotiable<\/p>\n<p>Instruments Act. Decisions      of this Court, as<\/p>\n<p>then stood was that if a cheque is drawn     is an<\/p>\n<p>account, which was already closed, an offence<\/p>\n<p>under Section 138 of       Negotiable Instruments<\/p>\n<p>Act is not attracted. Later Division Bench of<\/p>\n<p>this Court held that even in such an event, an<\/p>\n<p>offence      under  Section  138   of   Negotiable<\/p>\n<p>Instruments Act is     attracted. Argument is that<\/p>\n<p>in     such   circumstances,  learned   Magistrate<\/p>\n<p>should have altered the charge for the offence<\/p>\n<p>under Section 138. Relying on the decision of<\/p>\n<p>this Court in <a href=\"\/doc\/384103\/\">Prakasan v. State of Kerala<\/a> (2008<\/p>\n<p>(1) Kerala ILR 17) it was argued that even<\/p>\n<p>though,      learned Magistrate   has  not   taken<\/p>\n<p>cognizance of the offence under Section 138 of<\/p>\n<p>Negotiable Instruments Act, no reason has been<\/p>\n<p>shown      why the  said  offence  was  not  taken<\/p>\n<p><span class=\"hidden_text\">Crmc 4699\/10              5<\/span><\/p>\n<p>cognizance and therefore, the order, not taking<\/p>\n<p>cognizance would only be a nullity     and if that<\/p>\n<p>be so, courts below were not justified in not<\/p>\n<p>altering      the charge  for  the  offence  under<\/p>\n<p>Section 138 of      Negotiable Instruments Act for<\/p>\n<p>the reason that failure to take cognizance for<\/p>\n<p>the offence under Section 138 of        Negotiable<\/p>\n<p>Instruments Act would amount to an order of<\/p>\n<p>discharge or acquittal.\n<\/p>\n<p>            4.   Learned Magistrate had originally<\/p>\n<p>taken cognizance for the offence under Section<\/p>\n<p>417     of    Indian  Penal  Code  alone,   though<\/p>\n<p>complaint      was  filed  alleging  that   second<\/p>\n<p>respondent committed an offence under Section<\/p>\n<p>420 of Indian Penal Code and Section 138 of<\/p>\n<p>Negotiable Instruments Act. That was in 1998.<\/p>\n<p>Petitioner     did  not  challenge the  order  not<\/p>\n<p>taking cognizance for the offence under Section<\/p>\n<p>138      of    Negotiable  Instruments   Act.   He<\/p>\n<p><span class=\"hidden_text\">Crmc 4699\/10               6<\/span><\/p>\n<p>participated in the trial in S.T.5226\/1998. The<\/p>\n<p>second respondent was acquitted on 9\/12\/1998.<\/p>\n<p>Petitioner challenged       the order of acquittal<\/p>\n<p>before      this  Court. Before  this  Court,  the<\/p>\n<p>petitioner had no case that     learned Magistrate<\/p>\n<p>should have taken cognizance for the offence<\/p>\n<p>under Section 138 of        Negotiable Instruments<\/p>\n<p>Act or that an offence under Section 138 is<\/p>\n<p>attracted. Even when criminal appeal was heard,<\/p>\n<p>petitioner did not sought an opportunity to<\/p>\n<p>alter the charge or raise any contention that<\/p>\n<p>on the facts, an offence under Section 138 of<\/p>\n<p>Negotiable Instruments Act was attracted.      The<\/p>\n<p>decision of the Division Bench of this Court<\/p>\n<p>that     even  if  the  cheque  was  issued in  an<\/p>\n<p>account      which  was closed  would  attract  an<\/p>\n<p>offence      under   Section  138   of   Negotiable<\/p>\n<p>Instruments Act overruling the earlier decision<\/p>\n<p>was much earlier to the filing of the appeal.<\/p>\n<p><span class=\"hidden_text\">Crmc 4699\/10              7<\/span><\/p>\n<p>That     decision  was  available even  when  the<\/p>\n<p>appeal was heard and disposed by this Court on<\/p>\n<p>11\/7\/2007. The remand was only for the purpose<\/p>\n<p>of adducing further evidence and disposal. The<\/p>\n<p>Magistrate was bound by the order of remand.<\/p>\n<p>Annexure-D application to alter the charge was<\/p>\n<p>filed before the Magistrate only on 17\/1\/2008,<\/p>\n<p>about ten years after taking cognizance for the<\/p>\n<p>offence under Section 417 of Indian Penal Code.<\/p>\n<p>Evidently, attempt of the petitioner is to take<\/p>\n<p>cognizance of the offence under Section 138 of<\/p>\n<p>Negotiable     Instruments  Act  in 2008,  on   a<\/p>\n<p>complaint filed in    1998.\n<\/p>\n<p>            5. Under  Section  468  of  Code  of<\/p>\n<p>Criminal      Procedure,    Court  cannot    take<\/p>\n<p>cognizance of the     offence after the period of<\/p>\n<p>limitation provided thereunder. Under Section<\/p>\n<p>468(2)(c), the period of limitation     is three<\/p>\n<p>years,      if the  offence  is  punishable  with<\/p>\n<p><span class=\"hidden_text\">Crmc 4699\/10               8<\/span><\/p>\n<p>imprisonment for a term not exceeding one year<\/p>\n<p>but not exceeding three years. Hence cognizance<\/p>\n<p>could not have been taken after three years,<\/p>\n<p>even if the period of limitation as provided in<\/p>\n<p>Section 138 of       Negotiable Instruments Act is<\/p>\n<p>not applicable.
