Shri B N Nande counsel for the appellant\n\n^ Shri Abhishek sharma Advocate appears on behalf of Shri R Pradhan counsel for respondent No 1 None for respondents No 2 &amp; 3 \n\n CORAM: Honble Shri Justice R L Jhanwar  \n\n Dated: 19\/01\/2011\n\n: Judgement \n\n                            ORDER\n<\/pre>\n<p>                     Passed on 19012011<\/p>\n<p>   APPEAL UNDER SECTION 173 OF THE MOTOR VEHICLES ACT 1988              <\/p>\n<p>      This  is  an appeal by the National Insurance  Company<br \/>\nLimited against the order dated 04.02.2000 passed by the 5th<br \/>\nAdditional  Motor Accidents Claims Tribunal, Durg  in  Claim<br \/>\nCase  No.36\/95  whereby  the  learned  Claims  Tribunal  has<br \/>\nawarded  Rs.25,000\/- as total compensation to the respondent<br \/>\nNo. 1\/claimant in an injury case.\n<\/p>\n<p>2.    Brief facts of the case, in a nutshell, are on fateful<br \/>\nday of 15.05.1995 at about 7.00 a.m. when the respondent and<br \/>\nhusband  were  going from Bhilai to Durg on scooter  bearing<br \/>\nNo. M.P. 24\/7935, at the same time, the respondent No.2, who<br \/>\nwas  driving TATA tipper bearing registration M.P. 24 C\/2072<br \/>\n(for  short  `the offending vehicle&#8217;), owned  by  respondent<br \/>\nNo.3  and  insured by the appellant, in a rash and negligent<br \/>\nmanner,  dashed the scooter after hitting a  tree.   Due  to<br \/>\nsuch  dash,  both  the respondent No.1 and her  husband  got<br \/>\nserious  injuries,  as  a result of which,  the  husband  of<br \/>\nrespondent No.1 died instantaneously.\n<\/p>\n<p>3.    As against the compensation of Rs.1,00,000\/- sought by<br \/>\nthe  respondent  No.1 by filing claim petition  166  of  the<br \/>\nM.V.Act  for  the  injuries sustained by her  in  the  motor<br \/>\naccident on 15.5.1995, the learned Claims Tribunal, on close<br \/>\nscrutiny  of the evidence led by the parties and submissions<br \/>\nmade by them, awarded a sum of Rs.25,000\/- with interest  at<br \/>\n6%  per annum from the date of filing of claim petition till<br \/>\nrealization.  The Tribunal further directed respondents No.1<br \/>\nto  3 to pay compensation amount jointly and severally.   It<br \/>\nis  this  order, which is under challenge by the  insurer  \/<br \/>\nappellant.\n<\/p>\n<p>4.    Shri  B.N.Nande,  learned counsel  for  the  appellant<br \/>\nargued  that  in  this case, doctor has not  been  examined,<br \/>\ntherefore,  no  compensation  should  be  awarded   to   the<br \/>\nclaimant.  The next argument is that the driver was  holding<br \/>\na  licence  No.11366 which was found to be fake,  after  due<br \/>\ninvestigation.  According to him, the learned  Tribunal  had<br \/>\nappointed a commissioner to take the evidence of the persons<br \/>\nworking  in  the Office of Regional Transport  Authority  at<br \/>\nJhansi  and Shri N.L.Shrivastava, Advocate was appointed  as<br \/>\nCommissioner   to  enquire  about  the  matter   about   the<br \/>\nverification  of  the licence.  The said Advocate  conducted<br \/>\nenquiry  and took the evidence of Yogendra Kumar Garg  C.W.1<br \/>\nand  Deepak  Khare  C.W.2  in which  they  stated  that  the<br \/>\nLicensing  Authority, Jhansi did not issue  any  licence  to<br \/>\nBhagwan  Singh  whereas it was issued in  the  name  of  one<br \/>\nSajjan  Singh.  Despite all this, the learned  Tribunal  did<br \/>\nnot  rely  nor did consider the evidence of above witnesses.<br \/>\nIt  was  further argued that the learned Claims Tribunal  on<br \/>\nconjectures  and  surmises has recorded a finding  that  the<br \/>\nowner of the offending vehicle has after verification of the<br \/>\nlicence  held  by his driver Bhagwan Singh  allowed  him  to<br \/>\ndrive  the  offending vehicle.  On this point, the  Tribunal<br \/>\nhas  fastened  the  liability to  pay  compensation  on  the<br \/>\ninsurer, which is not in accordance with law.\n<\/p>\n<p>5.    On  the  other  hand,  Shri Abhishek  Sharma,  learned<br \/>\ncounsel appearing on behalf of respondent No.1 supported the<br \/>\nimpugned judgment.\n<\/p>\n<p>6.    Having heard rival submissions of the parties, I  have<br \/>\nperused  the  record  of  the Claims Tribunal  and  impugned<br \/>\norder.   A  perusal of pleadings and evidence of  respondent<br \/>\nNo.1  \/  claimant  would clearly reveal that  she  sustained<br \/>\ninjuries  in the accident on 15.05.1995 caused by respondent<br \/>\nNo.2.   It is clear from the record that no doctor has  been<br \/>\nexamined.   But  on  this count, no compensation  should  be<br \/>\nawarded  is not proper.  After perusal of evidence  of  Smt.<br \/>\nRenue  A.W.1, it is clear that she was admitted in Sector  &#8211;<br \/>\n9,  Hospital, Bhilai where she remained for a period  of  13<br \/>\ndays  for the injuries sustained by her on head and stomach.<br \/>\nIt  is  further evident from her evidence that one intestine<br \/>\nwas  found out and on this point, she did not contradict  in<br \/>\nher cross-examination.  In rebuttal, neither the insurer nor<br \/>\nthe  owner  could adduce evidence that she has not sustained<br \/>\ninjuries  in the motor accident.   Considering the  injuries<br \/>\nsustained  by her in the accident and also lost her  husband<br \/>\nin  that  accident,  no  doubt, she  would  have  definitely<br \/>\nsuffered  pain and mental agony.  Of course, she  could  not<br \/>\nproduce  any  medical bills but considering the  number  and<br \/>\nnature  of  the  injuries proved to have been  sustained  by<br \/>\nrespondent No.1 in the motor accident and some amount  could<br \/>\nhave  been spent on the treatment, the Tribunal has  rightly<br \/>\nawarded a sum of Rs.25,000\/- as total compensation in favour<br \/>\nof respondent.\n<\/p>\n<p>7.     Now   so  far  as  the  question  that  remains   for<br \/>\nconsideration   is   as  to  who  is  responsible   to   pay<br \/>\ncompensation amount awarded by the Tribunal.  On perusal  of<br \/>\nthe  impugned  order, it is clear that  the  learned  Claims<br \/>\nTribunal   did   not  see  the  evidence  adduced   by   the<br \/>\nCommissioner,  who  was appointed by the  learned  Tribunal.<br \/>\nAfter  perusal of evidence of Yogendra Kumar Garg C.W.1  and<br \/>\nDeepak  Khare  C.W.2, it is clear that the  driving  licence<br \/>\nNo.1366 was not issued from Jhansi and was not renewed  from<br \/>\nJhansi.   The  same was exhibited as Ex.C.3.   The  copy  of<br \/>\noriginal  license  was filed and the same was  exhibited  as<br \/>\nEx.C.2  (A).  A perusal of copy of original licence,  it  is<br \/>\nclear  that  licence  number was 11366\/R\/Jhansi\/88  and  was<br \/>\nrenewed  upto  20.11.2000  and  if  both  licences  verified<br \/>\ntogether,  it  appears  that  licence  which  was  held   by<br \/>\nrespondent No.1 at the time of accident was fake one because<br \/>\nit  was  not issued from Jhansi.  In this way, it  is  clear<br \/>\nthat  licence issued in the name of respondent No.1 is  fake<br \/>\none.  The  Apex  Court while dealing with the question  that<br \/>\nwhether  or  not the renewal of a fake driving licence  does<br \/>\nnot  transform  it  into genuine and insurance  company  was<br \/>\njustified in repudiating the claim, has held in the case  of<br \/>\n<a href=\"\/doc\/584313\/\">Oriental  Insurance Co. Ltd. v. Prithvi Raj,<\/a>  2008  ACJ  733<br \/>\nthat once the licence is a fake one, then the renewal cannot<br \/>\ntake  away  the  effect of fake licence, and therefore,  the<br \/>\ninsurance company has no liability.\n<\/p>\n<p>8.   For the foregoing reasons, I am of the opinion that the<br \/>\nlearned  Claims  Tribunal  has,  without  any  evidence  and<br \/>\npleadings  of the owner, recorded a finding that licence  of<br \/>\nthe  driver  \/  respondent  was  verified  by  its  owner  \/<br \/>\nrespondent No.3, which is not in accordance with  law.   The<br \/>\nlearned  Tribunal  has passed the order on  conjectures  and<br \/>\nsurmises and without appreciating the evidence available  on<br \/>\nrecord.\n<\/p>\n<p>9.    In  the  result, the appeal filed by  the  insurer  is<br \/>\nallowed.   Relying upon the above judgment, it is held  that<br \/>\nthe appellant \/ insurance company is exonerated and thus not<br \/>\nliable to pay compensation.  The impugned order in so far as<br \/>\nits relates to pay compensation of Rs.25000\/- by the insurer<br \/>\nand owner, jointly and severally, is set aside.  Instead, it<br \/>\nis  ordered  that the compensation awarded by  the  Tribunal<br \/>\nshall  be  paid  by  the  owner i.e.  respondent  No.3.  The<br \/>\nappellant \/ insurer may initiate proceedings for recovery of<br \/>\ncompensation, if any, paid by it from the owner.
