Bohra, for respondent No.4.\n\n           This   habeas      corpus     petition     has   been\nfiled by father of the corpus Sangita in which it\nis stated that the date of birth of his daughter\nSangita is 4.8.1995 as per her school certificate\nAnnexure-2, therefore, she is minor and she has\nbeen illegally detained by respondent Nos. 4 and\n5.     In the writ petition filed by the petitioner,\nnotices    were   issued      and   in    pursuance    of   the\nnotice, the corpus Sangita was produced before us\nby the respondent Nos. 4 and 5 on 19.4.2010.                  On\nthat day, learned counsel for the respondents took\ntime for the purpose of satisfying that corpus is\nmajor because she is more than 18 years of age.\nFurther, corpus herself stated before us that she\nis major and she does not want to go with her\nfather and she is willing to go with her husband\nbecause she is legally wedded wife of respondent\nNo.4 - Ramesh Kumar Bhati.\n           According to the certificate produced on\n                                          2\n\n     record as Annexure-2, the date of birth of corpus\n     has been shown as 4.8.2010.                       Therefore, in the\n     interest     of    justice,        we    have       sent   the    corpus\n     Sangita to the Nari Niketan, Jodhpur on 19.4.2010\n     with   the      direction       that    she     shall      be   produced\n     before us on the next date of hearing.\n                  Today      again,     we      have     ascertained       the\n     desire     of     the    corpus        Sangita      repeatedly,       the\n     corpus Sangita has stated before us that now she\n     is desirous to go with her father, who is present\n     today in the Court. It is also stated by corpus\n     Sangita    that      she    is    minor     and      the   certificate\n     produced by her father Annexure-2 is correct.\n                  In this view of the matter, this habeas\n     corpus    petition         is    allowed      and    custody     of   the\n     corpus Sangita is hereby given to her father who\n     is present in the Court because corpus Sangita is\n     minor and she is desirous to go with her father.\n                  We have also recorded the statement of\n     corpus - Sangita separately for ascertaining her\n     desire where she wants to go.
