                  Petitioner was third accused<\/p>\n
in C.C.526\/2001 on the file of Judicial<\/p>\n
First    Class            Magistrate’s                   Court-IV,<\/p>\n
Kozhikode. As petitioner along with the<\/p>\n
second accused was absconding, the case<\/p>\n
against them was split up and refiled as<\/p>\n
C.C.87\/2005.       First accusd was tried. By<\/p>\n
Annexure-III      judgment,                he was acquitted<\/p>\n
for the offence under Section 482 of Indian<\/p>\n
Penal Code. Prosecution case is that on<\/p>\n
15\/5\/1999         first            accused,              with  the<\/p>\n
intention to evade payment of tax, went to<\/p>\n
the workshop to change chasis number of<\/p>\n
Maruti  car    KL-01.H.1267                  and       on  getting<\/p>\n
information,      Sub          Inspector                of  Police<\/p>\n

\n                          2<\/span><\/p>\n
proceeded to the workshop. By      that time   the<\/p>\n
vehicle was taken away. On search, it was found<\/p>\n
parked on the side of the road at West Hill<\/p>\n
Chunkam. On search of the car photocopy of the<\/p>\n
registration certificate of       another vehicle<\/p>\n
was found inside the car. Alleging that first<\/p>\n
accused      committed the offence in furtherance<\/p>\n
of their common intention with accused 2 and 3,<\/p>\n
an offence under Section 482 of Indian Penal<\/p>\n
Code was committed     final report was filed.  By<\/p>\n
Annexure-III     judgment     learned   Magistrate<\/p>\n
acquitted the first accused finding that there<\/p>\n
is no evidence to prove that first accused had<\/p>\n
used false property mark and prosecution case<\/p>\n
is only that copy of registration certificate<\/p>\n
of another vehicle and     the registration number<\/p>\n
of    that   vehicle  was found  inside  the  car.<\/p>\n
Petition is filed under Section 482 of Code of<\/p>\n

\n                          3<\/span><\/p>\n
Criminal Procedure to quash the proceedings now<\/p>\n
pending against the petitioner as C.C.87\/2005<\/p>\n
on     the   file   of   Judicial   First   Class<\/p>\n
Magistrate’s     Court-IV,  Kozhikode  contending<\/p>\n
that      as maximum  sentence  provided  for  an<\/p>\n
offence under Section 482 of Indian Penal Code<\/p>\n
is      imprisonment upto one year, as provided<\/p>\n
under Section 468 of Code of Criminal Procedure<\/p>\n
cognizance should have been taken within one<\/p>\n
year and cognizance of the offence was taken<\/p>\n
only      on 25\/9\/2001   beyond  the   period  of<\/p>\n
limitation and therefore, on that sole ground,<\/p>\n
cognizance taken is to be quashed. It is also<\/p>\n
contended that in view of the prosecution case,<\/p>\n
even if petitioner is to be tried, there is no<\/p>\n
likelihood of a conviction as first accused<\/p>\n
who was found in possession of the vehicle was<\/p>\n
acquitted.<\/p>\n
\n\nCrmc 4741\/10\n                          4<\/span>\n\n\n                  2.    Learned  counsel appearing\n\nfor     the      petitioner  and  learned   Public\n\nProsecutor     were heard.\n\n                  3. Section 482 of Indian Penal\n\n<\/pre>\n
Code provides for punishment for using a false<\/p>\n
property mark. Under the Section whoever      uses<\/p>\n
any false property mark shall be punished with<\/p>\n
imprisonment of either description for a term<\/p>\n
which may extend to one year      or with fine, or<\/p>\n
with     both,  unless  he  proves that  he  acted<\/p>\n
without     intent to defraud. As rightly pointed<\/p>\n
out by the     learned   counsel appearing for the<\/p>\n
petitioner prosecution has no case that accused<\/p>\n
had used the property mark of another vehicle<\/p>\n
namely,     either  the    chasis  number,  engine<\/p>\n
number or registration number of another car<\/p>\n
which was found in the possession of the first<\/p>\n
accused.     The  only  allegation is  that  first<\/p>\n

accused had gone to a workshop to change the<\/p>\n
chasis number and the registration number and<\/p>\n
getting information Sub Inspector reached the<\/p>\n
workshop and then it was disclosd to the Sub<\/p>\n
Inspector that ten minutes earlier a person<\/p>\n
had    approached   the  workshop to  change  the<\/p>\n
chasis number and he was in his possession copy<\/p>\n
of registration certificate of another vehicle<\/p>\n
and     he   had  left   the  workshop.  On   this<\/p>\n
information, Sub Inspector proceeded and found<\/p>\n
the car parked on the side of road. It was<\/p>\n
found that inside the car there was another<\/p>\n
registration       number   and    photocopy    of<\/p>\n
registration     certificate of  another  vehicle.<\/p>\n
Even if this case is accepted and petitioner is<\/p>\n
tried, he cannot     be convicted for the offence<\/p>\n
under      Section 482   of  Indian  Penal  Code,<\/p>\n
especially when by Annexure-III judgment, first<\/p>\n

accused, who alone was found in possession of<\/p>\n
the vehicle, was already acquitted. More over,<\/p>\n
as    pointed  out  by  the   learned    counsel<\/p>\n
appearing for the petitioner, Section 468(b) of<\/p>\n
Code of Criminal Procedure   provides  period of<\/p>\n
limitation,    for an  offence  punishable  with<\/p>\n
imprisonment for a term not exceeding one year,<\/p>\n
as one year. Under Sub Section 1 of Section<\/p>\n
468, no Court      shall take cognizance of an<\/p>\n
offence     of the  category  specified in   sub<\/p>\n
section     2 after the  period  of  limitation.<\/p>\n
Therefore,     when  the  offence  was allegedly<\/p>\n
committed    on 15\/5\/1999,    learned Magistrate<\/p>\n
could not have taken cognizance of the offence<\/p>\n
as provided      under Section 468 of Code of<\/p>\n
Criminal Procedure, after expiry of one year<\/p>\n
from 15\/5\/1999, except by exercising the power<\/p>\n
provided under Section 473 of Code of Criminal<\/p>\n

Procedure. The final report does not show that<\/p>\n
any reason was shown to enable the Court to<\/p>\n
exercise the jurisdiction under Section 473 of<\/p>\n
Code       of Criminal   Procedure.   In    such<\/p>\n
circumstances, on that ground also the case<\/p>\n
pending against the petitioner is liable to be<\/p>\n
quashed.\n<\/p>\n
                Petition is allowed. C.C.87\/2005<\/p>\n
on     the   file  of   Judicial   First   Class<\/p>\n
Magistrate’s Court-IV, Kozhikode is quashed.<\/p>\n
