Advocate\n\nHon'ble Abdul Mateen,J.\n<\/pre>\n<p>Hon&#8217;ble Yogendra Kumar Sangal,J.\n<\/p>\n<p>Criminal Application No. 37019 of 2010.\n<\/p>\n<p>Heard learned counsel for the appellant and the learned Additional<br \/>\nGovernment Advocate on the prayer for bail of appellant in<br \/>\npending appeal.\n<\/p>\n<p>This criminal appeal has been preferred by appellant Ajay Singh<br \/>\nagainst judgment dated 27.03.2010 passed by the Special Judge,<br \/>\nSC\/ST Act, Faizabad in Sessions Trial No. 81 of 1996 whereby he<br \/>\nhas been convicted under Sections 302\/34 IPC read with Sections<br \/>\n3(2)(5) SC\/ST Act and has been sentenced for maximum term of<br \/>\nlife imprisonment with fine stipulation.\n<\/p>\n<p>We have gone through the judgment and record of lower court,<br \/>\nincluding FIR lodged by Awadhesh Kumar with respect to an<br \/>\nincident said to have been committed on 29.09.1995 at about 11<br \/>\nP.M.\n<\/p>\n<p>As it comes out appellant Ajay Singh was driving a motorcycle<br \/>\nand Brajendra Singh and Ajeet Singh, who were sitting on pillion<br \/>\nseat, fired on Tidi (deceased), who was coming back to his home<br \/>\nthrough a culvert. The deceased after receiving firearm injury said<br \/>\nto have been fired by Brajendra Singh and Ajeet Sing fell down<br \/>\nand succumbed to the same. Postmortem of the deceased indicates<br \/>\nonly one wound of entry<\/p>\n<p>It is argued by the learned counsel for the appellant that the<br \/>\nappellant has been convicted with the aid of Section 34 IPC since<br \/>\nrole assigned to him is of driving the motorcycle on which the<br \/>\npersons, who have assigned role of firing, were sitting. It is further<br \/>\nargued that there is no specific averment either in the FIR or in the<br \/>\nstatement of prosecution witnesses in any manner that appellant-<br \/>\nAjay Singh fired on the deceased. It is stated that the appellant was<br \/>\non bail during the course of trial and he did not misuse the liberty<br \/>\n of bail granted to him. It is also stated that there is no likelihood of<br \/>\nthe appeal being heard and decided in near future.\n<\/p>\n<p>In view of the submissions made by the learned counsel for the<br \/>\nappellant, without going further into merit of the case, we find it a<br \/>\nfit case for bail.\n<\/p>\n<p>Let appellant-Ajay Singh, convict of aforesaid sessions trial, be<br \/>\nreleased on bail on his furnishing a personal bond and two sureties<br \/>\neach in the like amount to the satisfaction of Chief Judicial<br \/>\nMagistrate concerned.\n<\/p>\n<p>Realization of half of the fine is stayed and remaining half of the<br \/>\nfine shall be deposited by the appellant within one month from the<br \/>\ndate of his release on bail.\n<\/p>\n<p>Chief Judicial Magistrate concerned is directed to transmit to this<br \/>\nCourt photocopies of bond and sureties filed by the appellant to be<br \/>\npreserved in the record maintained here.\n<\/p>\n<p>Order Date :- 1.7.2010<br \/>\nChauhan\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Ajay Singh vs State Of U.P. on 1 July, 2010 Court No. &#8211; 25 Case :- CRIMINAL APPEAL No. &#8211; 1000 of 2010 Petitioner :- Ajay Singh Respondent :- State Of U.P.
