   Court I, Davangere in S.C.No. 17\/ 2002 acquitting<\/p>\n
 ._th’e_ ;5es;4;$e;{gde[1jiv:*”ef the offences punishabte 13 \/Ss 498–A. 304-<\/p>\n
B”‘a.nd..__306\u00abf’r\/w Section 34 of {PC and Sections 3, 4 and 6 of<\/p>\n
V .. Dowry V-Prohibition Act.\n<\/p>\n
2. The case of the prosecution is that the respondent<\/p>\n
22 2′ “No.1 married the deceased — Urna on 21.11.93 and prior to<\/p>\n
the marriage, it is aiieged that Respondents 1 t.o 3 have<\/p>\n
\/X<\/p>\n
their intention to receive further dowry they wer”e’al1ieged  u<\/p>\n
have been giving ill–treatment to the deceased:and’-ithereby -\u00ab, <\/p>\n
they are alleged to have committed  <\/p>\n
IPC. It is further alleged that on 2lf.?_.\u00a7)’8 theuvdecevasfedijrria7cg<\/p>\n
being unable to tolerate illuitreatnientl  harassment
\ncaused due to demandifor  suicide by
\nconsuming poison along  3 1\/2 years,
\nthereby the resgtroridenits  al1eged–..to_::have committed an<\/p>\n
offence U.s.=:’i\u00e9vo\u00e9ra”6f’–w3o6–V1′;>.c” Section 34 IPC.<\/p>\n
 -presence of the respondent before
\nthe Court,_ the  3irere”fra1ned which was denied by the<\/p>\n
accused; respondent and thereafter, in order to prove the<\/p>\n
 case, the prosecution has examined in all 22 witnesses and<\/p>\n
 got   to Ex. P22. The defence of the accused<\/p>\n
was.__one-of  total denial. They have got examined DWI in<\/p>\n
 their defence and got marked Exs D1 to D9.<\/p>\n
if    4.After hearing the prosecution and the defence, the<\/p>\n
 “learned Sessions Judge was pleased to hold that the<\/p>\n
prosecution has not proved its case beyond reasonable doubt<\/p>\n

and therefore, acquitted the respondents of the offences
\nalleged against them. Aggrieved by the same. the Sut\u00e9tterhas<\/p>\n
\ufb01led this appeal.\n<\/p>\n
5.PW1 — Raju is the younger..bro.therf_oVf” 11<\/p>\n
Urna. He has stated that the marriage  his too\ufb01plwaee<\/p>\n
on 21.11.93 at Shankai’a_d”~..pSheeIai <\/p>\n
Davangere. Prior to the rnarriage}~the._negotiatiVonsVEwere held
\nin their house and du”ri_ngA ri.eg?:\u00a7’tiati’opn,x”the accused l to 3<\/p>\n
had demanded a surn.w'”of~ tholas of gold.<\/p>\n
one s_uit_ of fmarriage as dowry. After
\nnegotiation, itthe”Vdo;\\x.rVry,.  settled for Rs.1.25,000\/~ in cash<\/p>\n
and 1 12.. tholasa of” gold and one pair of suit and marriage<\/p>\n
11*’  toloe metmloy them. 15 days prior to the marriage, a<\/p>\n
 plsumli 1 was deposited in the joint account of Uma<\/p>\n
and \ufb01rstvfaccused in Corporation Bank and a sum of<\/p>\n
 ARs.3.O;()xOO was given by means of cheque drawn in favour of<\/p>\n
  ‘respondent No.1 and balance to be paid subsequently.<\/p>\n
6.It is in the evidence that at the time of marriage. 4<\/p>\n
tholas of Tahli. 30 grams of Chain and one gold ear stud and<\/p>\n

\nwas due to be paid towards the accused were i1l~
\ntreating his sister for the   sending her
\nto their house  They were also
\ndemandinglllon”e.’gi’l’V along with a sum of
\nRs.4\u00a7;’O0O”     to the first accused
\nsubsellquelntly.    that the respondent was<\/p>\n
owning alpoultryl farm  he was demanding for payment of<\/p>\n
 V.  — forstarting the poultry farm business. It is also<\/p>\n
 ‘  that a sum of Rs.40,000 was also paid by<\/p>\n
   of his sister . In spite of the said payment<\/p>\n
heulhasi.heard from his sister that the respondent No.1 was<\/p>\n
  xa’ss_auiting her and il1–treating her. Thereafter, the<\/p>\n
liresptorident was demanding motor cycle and he has been<\/p>\n
‘given 160 CC motor cycle by raising loan from the<\/p>\n
Corporation Bank. His sister and first respondent were<\/p>\n
carrying on the poultry farm business. But the said business<\/p>\n
failed within one year. Thereafter, the first resjiondent<\/p>\n
started giving more ill–treatrnent to his wife\u00ab deceased…_’ —  :_. A’ <\/p>\n
7.on 21.7.1998 when he was an the  Vhelfwas it<\/p>\n
informed that the deceased and   have <\/p>\n
land in Devraj Urs Layout an:d’~..there.fore,t <\/p>\n
house. By the time he ;_reacheAd.—-the._h’ouse, ‘the..deeeased and
\nher child already tak’e’riyto’–  her sister was
\nconscious and t_.h’e_.Doetors” afere’ <\/p>\n
:8_.’1’i1e  to have told him that her<\/p>\n
husbandlxh-as foreeddtos consume poison and the child was in<\/p>\n
 th_e5:,ch_ildIjen’dWard____\u00a2o\u00bbi” the said hospital. Thereafter, the<\/p>\n
‘ V.d’e::ease'(:l. was taken to Bapuji Hospital and thereafter, he<\/p>\n
H  e’t’at’ea tea on 22.11.98, the child of the deceased<\/p>\n
sueeuinloeddl to the ailment. He has further stated that 40<\/p>\n
 ‘days thereafter on 19.98 at 5.60 am, the deceased<\/p>\n
lhvsueeumbed to the injuries. He has stated that he has given<\/p>\n
‘lstatement to the Tahsildar as per Ex.P7. ln the cross<\/p>\n
examination, it is suggested to him that the deceased has<\/p>\n

9.    ‘Manager of Raymond<\/p>\n
showroorri’  has’~st’ated  Ex.P2 is a receipt issued
\nby their shop to’:.evihder_ice,:ithe. purchase of clothes. He has<\/p>\n
also statedthat  bto~.–i;3x.P5 are issued for purchasing tie<\/p>\n
 < _  articies fr\ufb02\ufb02l their shop.\n<\/p>\n
 V   a.  \u00a5I’–Prabhu swamy is another witness working in<\/p>\n
ii\u00e9adydrmond  room and has stated that Ex.P2 to Ex.P5 are<\/p>\n
 issued from their shop to evidence the purchase clothes.<\/p>\n
11. PW 5 — Parvatharnma is the mother of the<\/p>\n
‘deceased M- Uma. She has corrborated the version of PW}<\/p>\n
regarding payment of dowry and also regarding articles given<\/p>\n
to the accused persons on the demand of the accusepciili\ufb01p<\/p>\n
12.PW 6 —- Satish has also stated <\/p>\n
negotiation and marriage of A-1 with t1′.1\u00a2  anC’1’_:~a1so’\u00abVV<\/p>\n
regarding the 1l1–treatment meted Ont * to ‘the’ <\/p>\n
Uma.\n<\/p>\n

\nopinedxthat  to consumption of poison and<\/p>\n

.   9 –  Suresh is the Medical Officer in Bapuji<\/p>\n
   and he has stated that on 21.7.98 at<\/p>\n
m–i..d–nig1it\u00a7’ jthe deceased was brought to their hospital and<\/p>\n
 was ‘sent to emergency ward. Ex.P12 IS the adrnisslon<\/p>\n
 tregjister in respect of the said hospital. He has intimated the<\/p>\n
‘police on 1.9.98 when deceased succumbed to the injuries.<\/p>\n

15. PW 10 — Rashmi is the neighbour of__the”<\/p>\n
and has stated that she came to know..VthVati.VVU:1:1:a._ has  <\/p>\n
committed suicide and was found  thiepgfields ‘: it ‘ ‘ V ‘<\/p>\n
16.PW -11 — Sowbhagya is the”sis=’\u00a3er ofidecedased<\/p>\n
She has stated regarding ‘”demar1d_   and
\nharassment given to heirsisterliwas indthe house of
\naccused No.1 and also regardingdhdieathdvQheiisister.<\/p>\n
17. PW 1?. is ;D\u00e9vap\u00a7a:.”*vV…h.as conducted PM<\/p>\n
examination Vwdejadpgipibodj\/_’of’the deceased on 1.9.98 at
\n5.30 pin.’ and state’d:th.ati’—the death is due to septicimia. He<\/p>\n
has statedithat he’v.has_ traced poison in the dead body of<\/p>\n

it   PW — 14 Krishna is a signatory to Ex.P12 which is<\/p>\n
the inquest report prepared by the Tahsildar.<\/p>\n
20. PW ~ 15 Kalamma is the neighbodr<\/p>\n
accused persons. She has stated that as.Von’-.tth’e:_i.’date1’_ 1′<\/p>\n
incident, the deceased was found:v.;inV rpiay-:<\/p>\n
with child and the deceased [was sieelping.  <\/p>\n
and woke her up and at that itime. . she has tstai\u00e9ddd that 11<\/p>\n
deceased and her child’  and”reqtiested not
\nto touch them. Thereafter, gshe  persons.\n<\/p>\n
21.   the mediator for
\nthe marri.=”1\ufb01e’d:,.”ot\u00a7   A-1. He has stated
\nregarding   during and after the marriage.
\nHowever,’v..sofa;-“V.as”:i1iistrdeatment is concerned. he has not<\/p>\n
witriessed out  has heard from some bodyeise. He has<\/p>\n
   that 1 has come to him and told him that<\/p>\n
 ‘his siste’r.co’nsumed poison.\n<\/p>\n
132′.  1′? — Prakash has turned hostile to the case of<\/p>\n
h   the prosecution.\n<\/p>\n
23. PW 18 — Venkatesh is the Regional Director of FSL,<\/p>\n
11 ‘”1)avanagere and he has stated that the stomach of the<\/p>\n
deceased did not contain any poison and has issued<\/p>\n
certi\ufb01cate as per Ex.P 15. He has stated that sin=:e”th.e  M<\/p>\n
has taken place 40 days back, he could  the <\/p>\n
contents of the stomach.\n<\/p>\n
24.PW 19 — Adevappawho is\u00abthe”–oWneVrv*’V–of: <\/p>\n
Where the deceased was stayingaiong with   turned
\nhostile to the case of  cross
\nexamination, the defence   from this
\nwitness who hasithatesa  near the dead<\/p>\n
body of the   i\u00e9ehen she was found in the<\/p>\n
field  is-eiVicii..ed_p\u00e9tfronrtiie mouth of this Witness that the
\ndeceasetduw\u00e9as  sad, due to loss caused to her in
\nthefousiness.  .A  it <\/p>\n
 i   20 –Wi:~{amesh is the signatory to Ex.P 17 —<\/p>\n
*- inquest ‘ mis\ufb01t-.. V <\/p>\n
26;  21 — Dhananjaya — is the Inspector of Police<\/p>\n
 who registered a case in Crime No. 147\/ 98 and sent FIR<\/p>\n
  to._t_he Court as per Ex.P2 E. It is in his evidence that he went<\/p>\n
  .V   hospital on receipt of intimation, but the deceased was not<\/p>\n
in a position to give any statement when he visited her on<\/p>\n
26.7.98.\n<\/p>\n

27. PW 22~ Cheluvaraj is the Inspector of Police who<\/p>\n
has conducted investigation in this case and recordedrsthe<\/p>\n
statement of the witnesses and seized the articles ‘,(:)fIi.’<\/p>\n
the dead body of the deceased. After receiVing…the;’*record_p<\/p>\n
from the hospital and other authoiritiesg ‘   <\/p>\n
sheet in this case.\n<\/p>\n
28. DW 1 Rain has statedrthat in the if<\/p>\n
shop and deceased was~~..carr\u00a7}ing ~.r)jnV’the medical” business.<\/p>\n
He has further identified the   in Ex.D1 and D2<\/p>\n
whichare ‘theaf,forrrifs’entered intohy the deceased in her own<\/p>\n
_ hand    identified the signature in Ex.\n<\/p>\n
D4 as .4(‘:;}._  A<\/p>\n
  It is frorp_…the evidence of these witnesses that the<\/p>\n
‘ .1earnevd4Se’sis:ions Judge has found that the evidence of the<\/p>\n
‘prosecution isvfnot sufficient and acquitted the respondents<\/p>\n
—  of the offences with which they were charged.<\/p>\n

Respondents — accused. Perused the materials carefully.<\/p>\n

complaint has stated that the said amount as ~<\/p>\n
given as per customary gift and no. wgherg;-thin” is <\/p>\n
stated that the accused have demanded”dowry_  <\/p>\n
materials from con1plainant”si’de atthe time o1’v.n1;irriage..Vgi\u00bb<\/p>\n
Under the circumstances, the o_f_fer.1ce–s_pU\/  and 6 of DP
\nAct are not made out”<-friorn '.the_'materials on record. The
\nversion as narrated  the –.ev.idef1ce the witnesses<\/p>\n
includingl'PWtif,1 isifan  from complaint — EXP}
\nand therefore, We'\u00abare agreement with the reasoning of<\/p>\n
the trial co'u.rt'vthat_ theoffence U \/ Ss 3 and 4 of DP Act is not<\/p>\n
   o1:1t..__'I'heAAorder..of acquittal passed in that respect does<\/p>\n
'  xwarraiitd'interference. in so far as offence U \/ s 304-3 is<\/p>\n
'concenied;  View of the fact that there was no<\/p>\n
considlerati\u00e9on for the marriage and the agreed amount is not<\/p>\n

 demand for balance amount. In that view, the offence<\/p>\n
