Justice P.BHAVADASAN\n\n Dated :12\/02\/2009\n\n O R D E R\n          J.B.KOSHY, Ag.CJ &amp; P.BHAVADASAN, J.\n                ===========================\n                    W.A.No.720 of 2007\n              ===============================\n         Dated this the 12th day of February, 2009.\n\n                       J U D G M E N T\n<\/pre>\n<p>Koshy, Ag.CJ.\n<\/p>\n<p>     Writ petitioners are employees in the 3rd respondent&#8217;s<\/p>\n<p>company.    They retired from service.    Contention of the<\/p>\n<p>petitioners is that they were paid only 7 days wages for<\/p>\n<p>every completed year of service under the Payment of<\/p>\n<p>Gratuity Act.   Appellants&#8217; contention is that the company<\/p>\n<p>was only a seasonal establishment.      The word &#8216;Seasonal<\/p>\n<p>Establishment&#8217; is not defined under Payment of Gratuity Act.<\/p>\n<p>Section 4 is the charging section of Payment of Gratuity Act.<\/p>\n<p>It provides that for every completed year of service the<\/p>\n<p>employer shall pay gratuity at the rate of 15 days wages<\/p>\n<p>based on the last drawn wages of the employee. Second<\/p>\n<p>proviso says that, for an employee who is employed in a<\/p>\n<p>seasonal establishment and who is not so employed<\/p>\n<p>throughout the year, the employer shall pay the gratuity at<\/p>\n<p>W.A.No.720 of 2007<\/p>\n<p><span class=\"hidden_text\">                             2<\/span><\/p>\n<p>the rate of seven days&#8217; wages for each season.      Second<\/p>\n<p>proviso is applicable only for a seasonal establishment.<\/p>\n<p>Once it was found that in a seasonal establishment<\/p>\n<p>employees who are working throughout the year are entitled<\/p>\n<p>to 15 days&#8217; wages and those employees who are working for<\/p>\n<p>a season will get only 7 days&#8217; wages as gratuity. Here, in<\/p>\n<p>the absence of a definition of &#8216;seasonal establishment&#8217;, we<\/p>\n<p>have to take a general meaning. Admittedly, the factory of<\/p>\n<p>the appellants company runs throughout the year. Even the<\/p>\n<p>workers accepting the contention of the appellants, factory<\/p>\n<p>works throughout the year but workers are        working in<\/p>\n<p>rotation basis during the off season period.      Since the<\/p>\n<p>factory is working throughout the year and employees are<\/p>\n<p>working in the factory throughout the year though on<\/p>\n<p>rotation basis during non-season, it cannot be stated that it<\/p>\n<p>is a seasonal establishment for the purpose of payment of<\/p>\n<p>gratuity. We are of the view that gratuity being a welfare<\/p>\n<p>W.A.No.720 of 2007<\/p>\n<p><span class=\"hidden_text\">                             3<\/span><\/p>\n<p>activity for the workers, a liberal beneficial interpretation<\/p>\n<p>has to be adopted in favour of the persons in whose favour<\/p>\n<p>Act is enacted. Apart from the above, the employees are<\/p>\n<p>fighting for about a decade and the financial liability as far<\/p>\n<p>as these two writ petitioners are concerned are only very<\/p>\n<p>limited.
